2Detailed Description of Proposed Development

2.1The application site is located within The Parade along Prestwick Road in South Oxhey. The property has recently been converted into a Café under the trading name of ‘Sarnies & Tatties’ and is currently pending consideration under planning reference 09/0999/RSP. The shopping parade within the area comprises of a variety of fascia signs with many projecting signs also evident.

2.2This application seeks retrospective advertisement consent for a non illuminated fascia sign and one internally illuminated projecting sign.

2.3The existing façade décor consists of a red external appearance with a white aluminium fascia board with red lettering reading ‘Sarnies & Tatties.’ The fascia sign is non illuminated and measures 5.8m in width and 0.8m in height. The advert sign stands 3m above ground level.

2.4The existing projecting sign is internally illuminated measures 0.9m in height and projects 0.6m from the shop front. The projecting sign which stands 2.3m above ground level is made out of aluminium and has a white background with red lettering which reads:

7.Analysis

7.1Design and Shop Front Considerations:

7.1.1The Parade in South Oxheycontains a variety of premises which include internally illuminated fascia signs that differ in colour and design. Within PolicyS2 of the Three Rivers Local Plan 1996-2011 it states that ‘Shop fronts and displays appropriate to the shopping area should be maintained.’It is considered that thefascia sign does not appear out of keeping with existing surrounding signage within the shopping parade. Additionally, the signage does not appear visually intrusive with a white background and red lettering and consequently is considered to be acceptable and comply with PoliciesGEN1, S2 and Appendix 1 of the Three Rivers Local Plan 1996-2011.

7.1.2It is considered that no nearby properties are affected by this proposal as the fascia sign is non-illuminated, whilst the projecting sign is not considered to cause any significant adverse impacts to residential properties sited above the shop.

7.2Highway Safety:

7.2.1Policy T7 requires that development will only be permitted where the development will not compromise the safe movement and free flow of other highway users, particularly pedestrians, cyclists, equestrians and the disabled. The fascia sign and projecting sign would not be considered to be in a location where it would conflict with highway or pedestrian safety. The Highway Authority has been consulted and had no objection to this submitted application. Conditions have been attached with regards to the luminance of the illuminated sign.

7.2.2Therefore, the proposal would comply with Policy T7 of the Three Rivers Local Plan 1996-2011 as the development would not compromise the safe movement and free flow of other highway users.

7.3Conclusion

7.3.1In conclusion, the advertising signs are considered to be appropriate to the surrounding shopping parade and do not detract from the character and appearance of the area.

8.Recommendation

8.1That RETROSPECTIVE ADVERTISEMENT CONSENT BE GRANTED subject to the following conditions:-

C1Advert – Standard conditions:

(1)The period of the validity of this permission is for five years commencing from the date of the decision notice.

(2)No advertisement is to be displayed without the permission of the owner of the site or any other person with an interest in the site entitled to grant permission.

(3)No advertisement shall be sited or displayed so as to:

(a)Endanger persons using any highway, railway, waterway, dock, harbour or aerodrome (civil or military);

(b)Obscure, or hinder the ready interpretation of, any traffic sign, railway signal or aid to navigation by water or air; or

(c)Hinder the operation of any device used for the purpose of security or surveillance or for measuring the speed of any vehicle.

(4)Any advertisement displayed, and any site used for the display of advertisements, shall be maintained in a condition that does not impair the visual amenity of the site.

(5)Any structure or hoarding erected or used principally for the purpose of displaying advertisements shall be maintained in a condition that does not endanger the public.

(6)Where an advertisement is required under these Regulations to be removed, the site shall be left in a condition that does not endanger the public or impair visual amenity.

REASON: To comply with the Town and Country Planning (Control of Advertisements) Regulations 2007 (as amended).

C2The luminance of the illuminated signs shall not exceed the candela per square metre given in ‘The Institution of Lighting Engineers Technical report Brightness of Illuminated Advertisements’.

REASON: To avoid glare which could lead to danger to users of the adjacent highway and in the interests of amenity and to meet the requirements of Policies GEN1 and T7 and Appendix 1 of the Three Rivers Local Plan 1996 – 2011.

C3The light sources must be shielded such that they are not directly visible to motorists using the adjacent highway.

REASON: To avoid glare which could lead to danger to users of the adjacent highway and in the interests of amenity and to meet the requirements of Policies GEN1 and T7 and Appendix 1 of the Three Rivers Local Plan 1996 – 2011.

INFORMATIVES:

I1Subject to the conditions attached to this permission, the advertisement signs are in compliance with Policies GEN1, S2, T7and Appendix 1 of the Three Rivers Local Plan 1996-2011 and do not have a significant adverse effect on the residential amenities of any neighbouring properties to such an extent to justify the refusal of advertisement consent, or otherwise result in demonstrable harm.
