RELEASE, INDEMNITY, AND ASSUMPTION OF RISKAGREEMENT

In consideration of Arizona State University andthe Ira A. Fulton Schools of Engineeringofferingprogramming, on the ASU campus, I hereby grant permission for ______

(the “Participant”)to participate in the “SEE@ASU.” This Release, Indemnity and Assumption of Risk covers all activities and occurrences associated with the Ira A. Fulton Schools of Engineering. As used herein, “ASU” means Arizona State University, the Arizona Board of Regents, the State of Arizona, the Ira A. Fulton Schools of Engineering and their employees and agents.

I further grant permission to ASU to copyright and publish all or any part of photographs and/or motion pictures and/or voice recordings and/or written/spoken statements taken of me or the Participant in any and/or all of the sponsored events and activities for use in university publications, including printed, moving, audio and electronic, all exhibitions, public displays, publications, commercial art, and advertising purposes in any media without limitation or reservation; and I waive any right to royalties or other compensation arising from or related to the use of the photographs/motion pictures/voice recordings/written/spoken statements.

I certify that:

  • I am the parent or legal guardian of the Participant. I am over the age of eighteen.
  • The Participant is in good health, I am unaware of any ailments or conditions that could interfere with the Participant’s ability to participate in the Program and I have satisfactorily resolved with the Participant’s physician any health concerns implicated by the Participant’s program participation.
  • I understand that there are risks inherent in participating in the Program. These risks include the risk of bodily harm and property damage or loss. Being fully cognizant of these risks, I, to the extent permitted by law, hereby assume those risks on my behalf and on behalf of the participant and waive and release any claims or causes of action, which I may now or hereafter have against ASU arising from or in connection with participation in the “SEE@ASU.”

I agree:

  • To the extent permitted by law, to indemnify the State of Arizona, Arizona Board of Regents, and Arizona State University for, from and against any and all costs or expenses incurred, of any kind or nature (except for those that are the result of ASU’s negligence), including reasonable attorneys fees, that ASU or its agents or employees may incur as a result of the Participant’s participation in the Program.
  • Not to assert thatASU, its agents or employeesare liable for any liabilitiesrelated tothe Participant’s Program participation.

Ihave read this agreement in its entirety and fully understand the contents, consequences and implications of signing this document. I acknowledge that the conditions set forth in this document apply to me individually,as well as to the Participant, and agree to the terms included above with the same force and effect as if I were the Participant referenced herein. This release shall be binding on my heirs, my personal representatives and assigns, and me and shall be governed by and construed under the laws of the State of Arizona, which shall be the venue for any legal action.

ASU has my permission to use the contact information provided below to mail future event materials to me or the Participant.Release constitutes the entire agreement among the parties hereto with respect to the subject matter covered herein and supersedes any and all such previous agreements among the parties, whether written or oral.
