Release from Liability and Hold Harmless Agreement

RELEASE FROM LIABILITY AND HOLD HARMLESS AGREEMENT

In consideration for receiving permission from the United States Military

Academy (USMA) to enter upon the premises of the USMA and to use government

facilities and property for the purpose of participating in: Tony Manganiello Youth Lacrosse Clinics in Foley Athletic Center, USMA, 7 & 14Mar10;being hereby acknowledged, the undersigned, intending to be legally bound, waive, and release, for any and all claims, demands, and any other causes of action whatsoever, which the undersigned may have against the Department of the Army, the United States Military Academy, and their agents, officers, employees, representatives, servants, successors, and assignees arising out of participation mentioned above, including, but not limited to, any and all loss, damage, death or injuries suffered or sustained to or upon any person or property as a result of participation in the aforementioned activity, while in, on, or upon the premises of the United StatesMilitaryAcademy. This includes the USMA vehicle transport around the site, if applicable. I further attest that I am physically fit, able, and qualified to participate in this event.

The undersigned further agrees that they will indemnify and will hold harmless

the Department of the Army, the United StatesMilitaryAcademy, or their agents,

officers, employees, representatives, servants, successors, and assignees from any and all costs, charges, claims, demands, and liabilities of any kind arising from the willful or negligent acts of the undersigned. The undersigned further acknowledges that they know and understand that participation in, and use of, the USMA facilities as the site of the aforementioned activity does not constitute agreement with or endorsement by the Department of the Army, the United States Military Academy, or their agents, officers, employees, representatives, servants, successors, and assignees, of any opinions

expressed by the undersigned or its masters or agents, or endorsement of or agreement with the undersigned. The provisions of this paragraph shall survive any termination of this Agreement for any reason whatsoever.

For Minors*: In addition to the above, the undersigned certifies that he/she is the parent or legal guardian of, and has the authority to sign this release for the below minor(s) and agrees that he or she will assume liability for any loss, damage, injury, death claims, demands, actions, or causes of action which may be brought by the participant, or his/her representatives as a result of the requested activity. The parent or legal guardian also agrees that he or she will indemnify the Department of the Army, the USMA, the Superintendent and their agents, employees and trustees from all costs, claims, demands and liability arising from the willful or negligent act of the participant.
