RELEASE AND INDEMNITY AGREEMENT

IT IS THE INTENTION OF THE UNDERSIGNED BY THIS AGREEMENT TO EXEMPT AND RELIEVE BELLARMINE COLLEGE PREPARATORY AND ITS EMPLOYEES, STUDENTS, AND VOLUNTEERS FROM LIABILITY FOR PERSONAL INJURY OR WRONGFUL DEATH CAUSED BY NEGLIGENCE.
The undersigned acknowledges that this trip entails risk of serious injury or death and on behalf of himself/herself, on behalf of his/her heirs, executors, administrators, and assigns, and on behalf of the student, specifically assumes all such risks and releases and waives any and all claims or legal actions for personal injury or wrongful death occurring to anyone arising as a result of or in any way connected with this trip, or incidental to the trip, wherever or however such death or injury may occur, and agrees that under no circumstances will the undersigned or the student or any of the heirs, executors, administrators, or assigns, of either the undersigned or the student initiate or prosecute any claim for personal injury or wrongful death against Bellarmine College Preparatory,
its officers, agents, faculty, staff, and other employees, students, or any person volunteering as a chaperon for the trip (“Released Parties”), even if such claim or cause of action shall arise by the negligence of any of the Released Parties.
The undersigned, for himself/herself and on behalf of the student agrees that in the event any claim for personal injury or wrongful death shall be prosecuted by the undersigned or his/her heirs, executors, administrators, or assigns, or by the student or his/her heirs, executor, administrators or assigns, against the Released Parties, he/she shall indemnify and hold harmless the Released Parties from any and all such claims or causes of action.
The undersigned acknowledges that he/she has read the foregoing, is fully aware of the potential dangers incidental to this trip, and is fully aware of the legal consequences of signing this release and indemnity agreement.
