Approval of Statement of Proceedings/Minutes for meeting of October 29, 2008.

ACTION:

ON MOTION of Director Slater-Price, seconded by Director Horn, the Board of Directors of the San Diego Sanitations Districts approved the Statement of Proceedings/Minutes for the meeting of October 29, 2008.

Spring Valley and Alpine Sanitation Districts Agenda Items

OVERVIEW:
The Spring Valley and Alpine Sanitation Districts must use odor control products at two wastewater pump station locations where facility conditions warrant such application. The Districts combined spend nearly $400,000 per year on odor control chemicals. Department of Public Works’ staffs working on behalf of Spring Valley have evaluated alternative products, but the only suitable product that is both effective and safe to use is Bioxide.
DPW staff on behalf of Spring Valley and the Alpine Sanitation District (Alpine) would recommend the use of Bioxide in each of the agencies facilities. Spring Valley and Alpine both utilize Board Policy A-87, Competitive Procurement, to authorize the procurement of goods. Board Policy A-87 allows for the acquisition of patented goods on a sole source basis when there are no comparable products available.
Bioxide odor control chemical is available only from the patent holder, Siemens Water Technologies Corp./U.S. Filter. Action requested would authorize purchase of up to $400,000 of Bioxide per year for three years for Spring Valley and Alpine facilities, with an option to renew for up to two additional years. Staff will continue to review alternate odor reduction products in an attempt to competitively procure this type of product in future years while continuing to ensure public health and safety.
FISCAL IMPACT:
Funds for this proposal are budgeted in the Spring Valley and Alpine Sanitation Districts. Funding source is sewer service fees for the Spring Valley and Alpine Sanitation Districts. In addition, the cost of the product purchased for Spring Valley Sanitation District will be 70% reimbursed from the Otay Municipal Water District next fiscal year. If approved, this request will authorize purchases of the odor control chemical, not to exceed $4,000 total current year cost and $400,000 annual cost. This action will require no additional staff years and will have no effect on the County General Fund.

RECOMMENDATION:
CHIEF ADMINISTRATIVE OFFICER
1.  Find that the proposed activity is exempt from review under the California Environmental Quality Act (CEQA) pursuant to Section 15301 of the CEQA Guidelines.
2.  In accordance with Board Policy A-87, Competitive Procurement, approve and authorize the Director, County of San Diego Department of Purchasing and Contracting, on behalf of the Spring Valley and Alpine Sanitation Districts to enter into negotiations with the patent holder, Siemens Water Technologies Corp./U.S. Filter and, subject to successful negotiations and determination of a fair and reasonable price, award a contract for the acquisition of Bioxide odor control chemical for three years, with an option to renew for an additional two years.
ACTION:
ON MOTION of Director Slater-Price, seconded by Director Horn, the Directors of the San Diego County Sanitation Districts took action as recommended, on Consent.
