I understand that works must not commence without the prior approval of the Environmental Health Team Manager, otherwise grant may not be paid.

EXPLANATORY NOTES

  1. An eligible person is either-

a) A responsible person within the meaning of the 2006 regulations. This generally means the person who owns or is otherwise responsible for a domestic distribution system within the supply.

b) A relevant person within the meaning of the 2006 regulations. This is generally those persons who-

  • provide the supply;
  • occupy the land from, or on which, the supply is obtained or located; or
  • exercise powers of management or control in relation to the supply.

Eligibility is also dependent on there being a need for improvement works to be carried out, i.e. the supply must be subject to:

  • a temporary departure authorised under Part V of the 2006 Regulations; or
  • a risk assessment carried out in accordance with the 2006 Regulations; or
  • a notice served under section 79G of the Water (Scotland) Act 1980.
  1. Application for grant where works have already begun will not be approved unless the local authority is satisfied that there was a good reason for this.
  1. The local authority may pay to an eligible person:

a) a grant of £800; or

b) a grant of the amount of the approved expenditure, whichever is the lower; or

c) a grant in excess of £800 where North Ayrshire Council is satisfied that the eligible person could not, without undue hardship, finance the expense of the approved works without such a grant. (Please note that in such cases, 2 competitive estimates for the approved works may be required.)

UNDUE HARDSHIP DECLARATION

I hereby certify that the cost of the approved improvement works on the private water supply serving ______is in excess of £800 and declare that I could not, without undue hardship, finance the expense of the approved works without a grant in excess of £800.

Conditions for Grants in Excess of £800

  1. Grant will only be provided for works which have been identified as necessary through the completion of an approved Risk Assessment.
  2. Treatment at point of entry alone will only be considered where there is no viable alternative.
  3. All applicants for grants in excess of £800 will pay a financial hardship contribution of £100 towards the cost of approved works.
  4. The maximum amount of grant available is £2000.
