Public & Products Liability Insurance Summary of Cover

This policy is an annually renewable and is underwritten by Royal & SunAlliance Insurance plc in accordance with the Terms and Conditions of the Standard Public Liability Insurance Policy Wording.

Limit of Indemnity:See Certificate of Cover

Occupation/Business

Fitness Trainers and Therapists in accordance with the details lodged with the Company.

The Company will provide indemnity to any Person Entitled to Indemnity up to a Limit of Indemnity against legal liability for damages in respect of

A)accidental injury of any person

B)accidental loss of or damage to Property

C)nuisance trespass to land or trespass to goods or interference with any easement right of air light water or way other than legal liability for damages which result from a deliberate act or omission of the Insured or which is a natural consequence of the ordinary conduct of the Business and which could reasonably have been expected by the Insured having regard to the nature and circumstances of such act or omission happening during any Period of Insurance in connection with the Business

Further, where injury has not occurred this Insurance is extended to provide indemnity against legal liability in respect of claims for breach of Professional Duty consequent upon any neglect error or omission in providing advice treatment or prescriptions in the course of the business.

The Insurance will apply to work undertaken in the following countries, whilst working abroad under a fixed term contract for a period, up to 6 months:-

Austria / Belgium / Denmark
Finland / France / Germany
Greece / Italy / Luxembourg
Netherlands / Portugal / Republic of Ireland
Spain / Sweden / United Kingdom
Czech Republic / Hungary / Iceland
Norway / Slovakia / Switzerland

You are advised to check with the Authorities in the country that you are visiting that this Insurance is acceptable to

them.

Significant Exclusions or Limitations

-the policy will usually compensate the claimant’s costs and expenses in addition to the Limit of Indemnity

-arising from risks that require more specific insurance e.g. motor, marine

-for injury to employees

-arising from loss of or damage to property in your custody or control

-fines and penalties

-nuclear risks and war risks

-electronic risks

-fear of contracting asbestos related diseases

-pre-claim asbestos clean up costs

-defective products and work and the repair, replacement or recall of such products or work

-arising from Abuse

Abuse shall mean:

A)acts of hurting or injuring mentally or physically by maltreatment or ill-use

B)acts of forcing sexual activity upon rape or molestation or

C)repeated or continuing contemptuous course or insulting words or behaviours

This policy is an annually renewable Public/Products Liability insurance with options to also insure Employers Liability and/or Personal Accident Insurance, underwritten by Royal & SunAlliance Insurance plc.

Personal Accident Insurance Summary of Cover

This policy is an annually renewable and is underwritten by Royal & SunAlliance Insurance plc in accordance with the Terms and Conditions of the Standard Personal Accident Policy Wording.

The age limits for this Policy = 16 - 65

Personal Accident Benefits - Operative time – Whilst taking part in or travelling directly to or from occupational fitness, movement and well being activities details as lodged with the Company

Death - £50,000

Permanent Total Disablement from gainful employment

of any and every kind/Continental Scale Benefits-£50,000

Temporary Total Disablement payable for a maximum of 26 weeks

with a 14 day deferment period-£100 per week

This Benefit will be restricted for persons working less than

16 hours per week to-£50 per week

Significant Exclusions or Limitations to the Personal Accident cover

-flying other than as a passenger

-committing or attempting to commit suicide

-war in Britain or the insured person’s county of residence

-war or terrorism caused by any nuclear chemical or biological incident

-illness or disease not resulting from accidental bodily injury

-any naturally occurring condition or degenerative process, or any gradually operating cause

-any pre-existing health defect or infirmity which was known to the Insured Person at the inception of this insurance or prior to the latest renewal thereof

Employers Liability Insurance Summary of Cover

This policy is an annually renewable and is underwritten by Royal & SunAlliance Insurance plc in accordance with the Terms and Conditions of the Standard Employers Liability Policy Wording.

Limit of Indemnity:£10,000,000

Occupation/Business

Fitness Trainers and Therapists in accordance with the details lodged with the Company.

The Company will provide indemnity to any Personal Entitled to Indemnity

1against legal liability for damages in respect of Injury of any Person Employed caused during any Period of Insurance

A)in Great Britain Northern Ireland the Channel Islands or the Isle of Man

or

B)while temporarily outside these territories

arising out of and in the course of employment by the Insured in the Business

2against legal liability for claimant’s costs and expenses in connection with 1 above

3in respect of

A)costs of legal representation at

1)any coroner’s inquest or inquiry in respect of any death

2)proceedings in any court arising out of any alleged breach of statutory duty resulting in Injury

which may be the subject of indemnity under this Section

B)all other costs and expenses in relation to any matter which may form the subject of a claim for indemnity under 1 above

incurred with the Company’s written consent

Provided that in respect of any one Event

1the total amount payable under this Section (including all Extensions and Memoranda) shall not exceed the Limit of Indemnity

2the Company may at any time pay the Limit of Indemnity (less any sums already paid or incurred) or any less amount for which at the absolute discretion of the Company the claims arising out of such Event can be settled

The Company will then relinquish control of such claims and be under no further liability in respect thereof

Significant Exclusions or Limitations

-Limit of Indemnity £10,000,000 for any one event (restricted to £5,000,000 in respect of Terrorism)

-Indemnity does not apply to nuclear risks, where liability is that of any principal or accepted under contract

-offshore risks

-injury for which you are required to arrange Motor insurance in accordance with road traffic legislation within the European Union

Property Definitions

All property and other interests described in this Cover are declared to belong to or be the responsibility of the Policyholder unless otherwise stated.

Machinery plant fixtures fittings and other trade equipment including

(a)all office equipment and other contents

(b)patterns models moulds plans and designs

(c)computer records documents manuscripts and business books for the value of the materials as stationery

Excluding

(a)stock and materials in trade

(b)any machinery separately Insured elsewhere

Significant Exclusions or Limitations

  1. Theft cover is restricted whilst not in use to entry to and exit from a building by forcible and violent means

or

  1. Theft by actual or threatened assault or violence

Excluding

(a)from any part of the building not occupied by the Insured for the purposes of the Business

(b)from the open or from any outbuilding

Exclusion of Theft from Unattended Vehicles

The Company shall not be liable for Theft of Attempt thereat of Property Insured contained in any vehicle operated by the Insured which is not individually attended by the driver or some other competent person authorised by the Policyholder unless that such vehicle is

(a)Securely locked and

(b)That the Business Equipment is concealed from view in a locked boot or under the parcel shelf of any hatchback vehicle or the tonneau cover of any estate vehicle and kept within any locked premises between the hours of 9.00pm and 6.00am.

Subject to the provisions and exclusions noted the cover granted under this policy is extended to include cover anywhere within the UK and Western Europe including Transit..

Compensation

Royal & Sun Alliance Insurance plc is a member of the Financial Services Compensation Scheme (FSCS). This provides compensation in case any member goes out of business or into liquidation and is unable to meet any valid claims against its policies. You may be entitled to compensation if we cannot meet our obligations, depending on the circumstances of the claim. Further information about the compensation scheme can be obtained from the FSCS.

Law applicable to the Policy

UNDER THE LAWS OF THE UNITED KINGDOM (ENGLAND, SCOTLAND, WALES AND NORTHERN IRELAND) BOTH PARTIES MAY CHOOSE THE LAW WHICH APPLIES TO THIS CONTRACT TO THE EXTENT PERMITTED BY THOSE LAWS.

UNLESS THE PARTIES AGREE OTHERWISE IN WRITING THE INSURER HAS AGREED WITH THE INSURED THAT THE LAW WHICH APPLIES TO THIS CONTRACT IS THE LAW WHICH APPLIES TO THE PART OF THE UNITED KINGDOM THAT THE INSURED IS BASED OR IF BASED IN THE CHANNEL ISLANDS OR THE ISLE OF MAN THE LAW OF WHICHEVER OF THOSE TWO PLACE IN WHICH THE INSURED IS BASED.

THE PARTIES HAVE AGREED THAT ANY LEGAL PROCEEDINGS BETWEEN THEM IN CONNECTION WITH THIS CONTRACT WILL ONLY TAKE PLACE IN THE COURTS OF THE UNITED KINGDOM THAT THE INSURED IS BASED OR IF BASED IN THE CHANNEL ISLANDS OR THE ISLE OF MAN THE LAW OF WHICHEVER OF THOSE TWO PLACE IN WHICH THE INSURED IS BASED
