Proposed Guideline for each GR to reviewTechnical Regulations Applicable to IWVTA

General:

Each GR will review the provisions of those ECE Regulations under their competence which have been identified in document IWVTA-06-04-Rev.1 as IWVTA base candidate (category (1))...

In addition, this review will also include the "items with regionally applicable requirements" listed in document IWVTA-06-04-Rev.1 under category (2), with a view to establish whether the UNECE Regulations identified for each of these items can be amended to accommodate any jusitified differentiation in the requirements to accommodate regional differences. In this context, GRs will make their best efforts to minimize differences in requirements dueto differences in local characteristics among the contracting parties (differences in infrastructure, weather, philosophy, etc.) to ensure that the Regualtions concerned can successfully incorporated in the IWVTA concept#1 and that the ultimate goal of IWVTA, as described in document in IWVTA-04-10 can be achieved#2.

In reviewing the ECE Regulations under its competence, each GR shall take due account of the principle that the requirements are expressed as quantitative ones focused on performance.

When after the review undertaken by GRs there would still remain unresolved issues, the GR involved will report on such "disagreements", "the history of discussion", and "the background and reasons of disagreements" to WP.29, which will discuss solutions and, if necessary, commission the GR to do further work to resolve the issues.

#1 IWVTA Concept:

The regulation ECE0 will prescribe requirements for whole vehicle type approval, including ECE regulations identified in IWVTA 06-04-Rev.1, and this for the categories:
(1) IWVTA base candidate
(2) Items with regionally applicable requirements
The ECE0 regulation will be developed based on the following principles (see also IWVTA-03-09-Rev.1):

Contracting Parties to the 1958 Agreement (hereafter “Contracting Parties”) can chose to apply ECE0. (No mandatory link between accession to the 1958 Agreement and the adoption of ECE0.)

A Contracting Party who applies ECE0 (hereafter “ECE0 contracting party”) accepts and issues the ECE0 approvals (pursuant to Article 2 of the 1958 Agreement)

. An ECE0 contracting party is allowed to continue to accept and issue individual ECE approvals. (pursuant to Article 2 of the 1958 Agreement)

Further examination will be necessary as to whether ECE0 Contracting Parties may or may not impose additional National/regional requirements .

When a contracting party has adopted ECE0, it is deemed to have automatically adopted all the ECE regulations (but limited to M1 category) included in the list of applicable regulations under IWVTA, even if this contracting party has not adopted them individually.

–Once an ECE0 approval is obtained, it shall be unnecessary to obtain and affix each individual ECE type approval mark (Vehicle system approval only)

Complete mutual recognition of whole vehicle approval, without any additional national requirements or approvals remaining

N.B. How to proceed at GR:

Before proceeding to the review of the identified ECE Regulations under their competence, GR members shall establish a common understanding on the ultimate goals of IWVTA and the principles upon which the ECE0 Regulation will be developed

To proceed to specific review of items with regionally applicable requirments , the chairperson and secretariat of each GR will invite contracting parties to clarify the difference between their national/regional requirements and the ECE regulations, and to indicate what changes to the ECE Regulations are considered necessary to apply the ECE Regulations in their territory, and eventually submit proposals for amendment to the GR together with justification.The GRs will examine such requests and develop proposals to ensure that the concerned Regulations can be included in ECE0 to achieve at maximum the ultimate goal of IWVTA.

If GRs consider that there is no need for amending anECE regulation, such ECE regulation will be deemed as IWVTA base candidate.

For the cases wherethere is no ECE regulation correspondent to domestic requirements, GRs will assess the suitability of including such domestic requirements within the Annexes of the 1958 Agreement (either by amending existing ECE Regulations or developing new ECE Regulations), based on the justification and the request provided by the concerned Contracting Party. If GRs would confirm the justification and suitability of such request, they develop appropriate proposals.

Each GR will proceed with the review keeping the following in mind:

―Based on the inventory provided in document IWVTA-06-04-Rev.1, proceed with reviewing the identified ECE Regulations under its competence, to ensure that each technical requirement in these ECE Regulations is a unified, single quantitative requirement. At the same time best efforts should be made to eliminate, or when this is not possible, to minimize differences in requirements due to differences in local conditions. In case it would appear not possible to eliminate these differences, GRs should flag the issue to WP.29for consideration.

―Based on the assessment provided in document IWVTA 06-10 (Validity of existing Regulations (M1)), verify the validity of existing regulations and the appropriate to split the identified Regulations and report the results to WP.29. * The final decision on the validity of existing Regulations and the need to split some of them will have to be made by WP.29. If WP.29 considers that a regulation should be split, it will request the GR responsible for the concerned regulations to elaborate proposals to that extent and based on the instructions of WP.29.

―For the time being, discussion on IWVTA concerns solely vehicles of MI category, concentrating efforts for harmonization firstly on those vehicles. * If the GR would find it necessary to sort out requirements for vehicles of category M1 and requirements for other vehicles within one and the same ECE Regulation, it will report to WP.29 accordingly, and develop proposals, based upon the decision WP.29 has taken and any guidance WP.29 may have issued, . If WP.29 finds it adequate to distinguish vehicles of category M1 and other vehicles, the draft will be passed to each GR for further examination according to the instructions of WP.29.
