PROPOSED CONSENT USE ONERF 5702,MALMESBURY

Your application dated 30July 2016, with reference MAL/9716/JL/MK, refers.

By virtue of the authority that is delegated to the Director: Development Services in terms of the decision of Council No. 7.25 dated 13 May 2015 as determined in Section 69(1) of the Swartland Municipal Land Use Planning By-Law (PG 7420 of 3 July 2015), the application for consent use, in order to establish a house tavern on Erf 5702, Malmesbury, is approved in terms of Section 60 of the abovementioned By-law, subject to the conditions that:

  1. TOWN PLANNING AND BUILDING CONTROL

a)the house tavern be limited to a 13m² portion of the property, in accordance with the site development plan proposed in the land use application;

b)alcohol may solely be traded for off-consumption purposes;

c)the trading hours of the tavern is regulated in terms of the Swartland Municipal By-Law on the Control of Undertaking that Sell Liquor to the Public (PG 7394 of 22 May 2015);

d)the owner of the tavern obtains a liquor licence in terms of the relevant legislation, and should the liquor licence be withdrawn or suspended, the approved consent use will automatically become void;

e)the approval be restricted to Erf 5702, Malmesbury and will not be transferable;

f)the dominant use of the residential dwelling remains for the occupation of a single family;

g)the owner/developer submits the required building plans to the Director: Development Services for consideration;

h)the necessary structural alterations are made in terms of health and safety in order to ensure that the impact of the house tavern on the surrounding land uses is minimal;

i)only one advertising sign will be permitted:

  • no larger than 1 m² in extent;
  • affixed to a wall of the dwelling or outbuilding;
  • no portion thereof may protrude over a building line;
  • the sign may only indicate the name of the owner, the name of the business and the nature of the business;

j)in terms of section 66(2)(w) of the Swartland Municipality By-law relating Municipal Land Use Planning (PG 7420 of 3 July 2015) this appoval is only valid for a period of 5 years;

a)the existing connection be utilised and that no additional connection will be provided;

  1. SEWERAGE

a)the existing connection be utilised and that no additional connection will be provided;

  1. ROADS

a)deliveries may only be made with light delvery vehicles;

  1. REFUSE REMOVAL

a)the basic refuse removal tariff be levied separately for the dwelling unit and the business and in the instance of the business, the tariff will be amended in accordance with the amount of refuse generated;

b)refuse be placed in refuse bags on the nearest municipal street on the morning of refuse removal.
