A local charity organization appoints you to design a new facility for destitute families. The development must provide accommodation for separate families. Food preparation, and meals will be in a communal but central building. The total budget is R10 000 000,00 excluding VAT. A further R1 500 000, 00 excluding VAT is budgeted for development of food gardens, workshop and implement store. R500 000,00 of this budget to be allocated to buildings. The remaining R1 000 000,00 will be for a specialist company to plan and execute the gardens. The appointment is for a full service (stage 1-6). Board Notice 194 of 2011 Project Cost Based Fee recommends a fee of R87 000,00 (Base Fee) plus 6.75%. A Lump-sum contract to be signed.

It is essential to contract out of the Common Law Rule which holds that ‘the architect would only become entitled to his fees when he has completed his mandate for the entire project’ and agree that fees be payable at the end of each of work stages 1 to 4, the respective amounts being the percentages stated in clause 5.4 of the Tariff, and in work stage 5, that fees be payable monthly, calculated on the value of interim payment certificates.
