FODO INSURANCE
STATEMENT OF OPTICAL COVER
The FODO insurance is designed specifically to meet the professional indemnity and legal defence needs of optical practices, optometrists, opticians and their staff in the UK and Republic of Ireland. The FODO insurance has been providing reassurance and peace of mind to the optical sector and patients for over 25 years.
Professional Liability insurance& Product Liability
Professional liability and product liability cover is provided
- for all member practices, their professional and non-professional staff (on an unnamed basis)*
- in respect of legal liability for death, injury or disease that occurs in the testing of sight, the dispensing of eye wear or other professional duties carried out by registered optometrists, ophthalmic medical practitioners and opticians, or staff working under their supervision
- on a claims occurring basis which (uniquely in optics) means there is no need for run-off cover if a person leaves the scheme.
Indemnity levels: £5m per incident
£5m in aggregate per year for product liability
* includes persons undertaking study, work experience or pre-registration training or on secondment to a School of Optometry and carrying out normal professional duties
Legal Defence
Legal defence is provided to all members practices, optometrists and opticians in the UK in respect of
- any disciplinary investigation by the General Optical Council, NHS Commissioning board, health board, professional association
- action in a civil court for an alleged breach of discrimination legislation (eg on grounds of gender, race, disability, age, religious belief, political opinion, sexual orientation)
- statutory notice served under the Health and Safety at Work Act 1974
- claims under the Data Protection Act and compensation awards under the Act
- other party’s costs resulting from the above circumstances where the insured is held liable by a relevant court.
Indemnity levels - £250,000 per incident and in aggregate per year
An excess applies on all claims

Where a claim involves both an employer and an employee Chinese Walls and total confidentiality apply. Separate defence teams are instructed, from separate solicitors firms, for each party unless otherwise agreed.
