The Regular Meeting of the City Council of the City of Hackensack was held at City Hall, 65 Central Avenue, Hackensack, New Jersey, on Monday, August 3, 2015at8:03 p.m.

Mayor John Labrosse Jr. called the meeting to order andthe City Clerk Deborah Karlsson announcedthat the meeting was being held in accordance with the Sunshine Law, notice having been published according to law, with a copy on file in the City Clerk’s office, and a copy posted on the bulletin board in City Hall.

Ms. Karlsson called the roll: Mayor John P. Labrosse Jr., Councilman Leonardo Battaglia, Councilman David Sims,and Councilman Jason Some were present. City Manager David Troastwas in attendance. Attorney John Visconi was in attendance.Deputy Mayor Kathy Canestrino was absent.

Approval of Minutes

A motion to accept the Executive Session and Regular Meeting Minutes from June 9, 2015 was offered by Councilman Some, seconded by Councilman Battaglia and approved by Mayor Labrosse, Councilman Battaglia, and Councilman Some. Councilman Sims abstained.

City Manager’s Report

The reimbursement procedure for the ambulance billing will be the following: Hackensack University Medical Center will bill residents’ insurance for emergency services, HUMC will bill resident for any insurance copay, the resident will pay the HUMC bill, and submit proof of payment to the City’s Finance Department. The Finance Department will process a purchase order that will be mailed to the resident to be signed and returned to the City. The refund will be put on the next Council Meeting for approval and checks will be mailed two days after the Council Meeting. HUMC will discount the emergency ambulance services by 80% for residents without insurance, like they have been. The charge of $500 will be dropped to $100. The residents will then pay HUMC and submit the proof of payment to the City. The resident can and is encouraged to submit for charitable care. If accepted by the hospital, the bill will be dismissed by the hospital. The City Staff will be here to assist with any paperwork dealing with the hospital. There are HIPPA Rules and the City is well aware of these rules. Names will not appear on the Bills List using designation of numbers. This will be posted on the website and send out an email blast. Reverse 9-1-1 will be considered.

An analysis has been completed on the waste trucks. Certain vehicles have been prioritized for repairs. An evening shift of mechanics has been scheduled. He is still accessing if we should purchase new equipment or do major repairs.

Twice a week pick up will be instituted next week in specific areas chosen based on amount of garbage and odor issues. As the trucks get in order we will expand that.

The National Night Out is tomorrow at 6 p.m. The City will have tables, including Stigma Free.

Stigma Free training will be held the 5th and 6th from 5-9p.m., also on August 11th and 12th from 9a.m. to 1p.m.

Building Department Update: 77 notices, 95 inspections, 80 properties were in compliance, 10 C.C.O.’s and 16 sidewalk inspections. We are hiring a code officer scheduled to start August 18th.

Open Swim Night has been approved by the Board of Education and will be opening August 12th. Registration is this week; first come first serve.

WHEREAS, pursuant to N.J.S.A. 40:48-2, the governing body of a municipality may make, amend, repeal, and enforce such other ordinances, regulations, rules and by-laws not contrary to the laws of this state or of the United States, as it may deem necessary and proper for the good of government, order and protection of person and property, and for the preservation of the public health, safety and welfare of the municipality and its inhabitants, and as may be necessary to carry into effect the powers and duties conferred and imposed by this subtitle, or by any law; and

WHEREAS, the City of Hackensack (“City”) wishes to amend Part II ofThe City of Hackensack Municipal Codeentitled “General Legislation, Article VII entitled, “Sale of Tobacco Products,” Chapter 90 entitled, “Food and Drink, of the City of Hackensack Municipal Code (“City Code”)to update various provisions to comply with New Jersey State statutes; and

NOW, THEREFORE, BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY OF HACKENSACK, as follows:

Section 1.Part II ofThe City of Hackensack Municipal Code entitled “General Legislation,” Chapter 90 entitled “Food and Drink,” Article VII entitled, “Sale of Tobacco Products,” Section 50 entitled “Tobacco sales to minors prohibited; sign required” is amended, such that it states:

§90-50 Tobacco sales to minors prohibited; sign required.

In addition to the existing New Jersey State prohibitions regarding the sale of tobacco products to minors under 19 years of age, the following shall apply throughout the City of Hackensack.

  1. Sign requirements. A sign having a minimum size of six by eight inches shall be posted in a conspicuous place near each cash register in all retail establishments which sell tobacco products and shall contain the following language:

SALE OF TOBACCO PRODUCTS TO MINORS UNDER THE AGE OF NINETEEN IS PROHIBITED BY LAW. Legal proof of age must be shown. A person who sells or offers to sell a tobacco product to a person under 19 years of age may be prosecuted in accordance with state and local ordinances.

Section 2:Part II ofThe City of Hackensack Municipal Code entitled “General Legislation,” Chapter 90 entitled “Food and Drink,” Article VII entitled, “Sale of Tobacco Products,” Section 56 entitled “Violations and penalties” is amended, such that it states:

§90-56 Violations and penalties.

  1. Any person violating § 90-50 or § 90-51 of this Article shall, pursuant to N.J.S.A. 2A:170-51.1, be punished by a fine not to exceed $500.

PUBLIC HEARING – Mr. Campagna – Congrats for the changes in the Police Department. I have had problems in the past and I hope the fear element is not trying to creep back in. I know that tasers can be overused. I hope that there will be training on these items and other equipment as well. Maybe some sensitivity training, look before you shoot, do not overreact. Thank you.

BE IT ORDAINED by the Mayor and Council of the City of Hackensack, in the County of Bergen, New Jersey, as follows:

Section 1. The City of Hackensack, in the County of Bergen, New Jersey (the "City") is hereby authorized to make the following Capital equipment acquisitions, by and for the City, including all work, materials and appurtenances necessary and suitable therefor:

(A)Taser Units

Twenty (20) Taser Units, including handle, holster, Taser Cam, cartridges and hardware and software.

Section 2. The sum of $40,000 is hereby appropriated to the payment of the cost of the acquisitions authorized and described in Section 1 hereof (hereinafter referred to as "purpose").Said appropriation shall be raised from the Fund Balance of General Capital Fund of the City of Hackensack. The City expects to receive reimbursement through the Federal Equitable Share Program which will be applied as a reimbursement to this appropriation.

Section 3. Said improvements are lawful capital improvements of the City having a period of usefulness of at least five (5) years. Said improvements shall be made as general improvements, no part of the cost of which shall be assessed against property specially benefited.

Section 4. The capital budget is hereby amended to conform with the provisions of this capital ordinance to the extent of any inconsistency therewith and the resolutions promulgated by the Local Finance Board showing full detail of the amended capital budget and capital program as approved by the Director, Division of Local Government Services, is on file with the City Clerk and is available for public inspection.

Section 5. This ordinance shall take effect at the time and in the manner provided by law.

WHEREAS, the City Council finds it in the City’s best interest to make this change.

WHEREAS, pursuant to N.J.S.A. 40:81-10, a municipal council may create and determine and define the powers and duties of such executive and administrative departments, boards, and offices, that it deems necessary for the proper and efficient conduct of the affairs of the municipality; and

WHEREAS, the City of Hackensack (“City”) is committed to honoring our nation’s veterans and promoting events and activities for the benefit of such veterans; and

WHEREAS, the City has determined that the interests of the City will be served by creating a Veterans’ Advisory Board that will keep the City Council informed of developments regarding veterans; advise, recommend, and arrange ceremonies honoring veterans; and respond to any ordinances introduced by the City Council that may have an impact upon veterans; and

WHEREAS, the City of Hackensack (“City”) wishes to amend Part II of The City of Hackensack Municipal Codeentitled “General Legislation,” to add Chapter 43 entitled, “Veterans’ Advisory Board”; and

NOW, THEREFORE, BE IT ORDAINED, BY THE CITY COUNCIL OF THE CITY OF HACKENSACK, as follows:

Chapter 43.Part I, entitled “Administrative Legislation,” is amended to add Chapter 43, entitled “Veterans’ Advisory Board,” such that The City of Hackensack Municipal Code, Part I entitled “Administrative Legislation,” states:

Chapter 43: Veterans’ Advisory Board

§43-1Establishment

There is hereby established, within the City of Hackensack, a Veterans' Advisory Board.

§43-2Membership; terms; compensation

The membership of the Board shall consist of five persons who are residents of the City. At least two of the members must currently serve or have served in a branch of the United States Armed Forces. The members of the Board shall be appointed the City Manager with the advice and consent of the City Council. The Board members first appointed shall be appointed for the following terms: two members for three years, two members for two years and one member for one year. Following the initial appointments, all appointments shall be for three years, and vacancies shall be filled for the unexpired term only. The members shall receive no compensation for their services. With the exception of the Board members first appointed, the terms of office of each appointee shall commence on the first day of January and shall expire on the 31st day of December of the appropriate years. The Board members first appointed shall also serve from the date of their respective appointments through and including December 31, 2015, at which time the term of years of their full appointments shall commence.

§44-3Organization

With the exception of the Chairperson, who shall be designated annually by the City Manager, the Board shall choose its own officers, make its own rules and regulations for the discharge of its duties and for the proper exercise of the powers conferred upon it by the Mayor and Council, and keep a record of its proceedings. The Chairperson shall serve as a liaison between the Board and the City Council. The Board shall meet at least quarterly, but as frequently as may be required in its rules and regulations and as circumstances may require.

§44-4Duties

The duties of Veterans’ Advisory Board shall be to:

  1. Serve as an ad hoc advisory board to the City Council for the purposes of keeping the City Council informed of developments regarding veterans, including any new state or federal laws that would impact veterans in the City;
  2. Recommend and arrange appropriate ceremonies honoring veterans on holidays and otherwise;
  3. Prepare such advisory reports and perform such other duties as may from time to time be requested by the Mayor and Council concerning city services, programs and policies which are the subject of consideration or evaluation by the City Council;
  4. Respond to any ordinances introduced by the City Council that may have an impact upon veterans; and
  5. Entertain public proposals and suggestions and articulate the same to the Mayor and Council.
