PROCEDURE FOR TRAINING SERVICES

Purpose

Toprovidegeneraldirectioninprovidingtrainingservicestoadultsanddislocatedworkers,includingdisplaced homemakers.

Policy

Training Services:Trainingservicesmaybemadeavailabletoemployedandunemployedadultsanddislocatedworkers (includingdisplacedhomemakers)whohavemettheeligibilityrequirementsforintensiveservices,havereceivedatleastoneintensiveservice,andhavebeendeterminedtobeunabletoobtainor retainemployment orobtainself-sufficientwagewithoutreceivingtrainingservices.Inaddition,aftertheneedfortrainingservicesisdeterminedthroughaninterview,objectiveassessment,evaluation,orcasemanagement,theOneStopoperatororserviceprovidermustdetermine:

•Theparticipanthastheskillsandqualificationsnecessarytosuccessfullycompletetheselectedtrainingprogram.

•Thetrainingprogramisdirectlylinkedtoemploymentopportunitiesinthelocalareaorinanotherareatowhichtheparticipantiswillingtorelocateuponcompletionoftraining.

AvailableServices:Trainingservicesinclude,butarenotlimitedto,thefollowing:

•Occupational skillstraining,includingtrainingfornon-traditionalemployment

•On-the-JobTraining

•Trainingthatcombinesworkplacetrainingwithrelated instruction,whichmayincludecooperativeeducationprograms

•Trainingprogramsoperatedbytheprivatesector

•Skillupgradingandre-training

•Entrepreneurialtraining

•Jobreadinesstraining

•Adulteducationandliterary-skillstrainingprovidedincombinationwiththetrainingservicesidentifiedabove

•Customizedtraining

FinancialAssistance:FinancialassistanceundertheWorkforceInnovation and Opportunity Act isavailablefortrainingservicesforadultsanddislocatedworkerswhoareunabletoobtaingrantassistancefromothersourcestopayfortheirtraining,orwhorequirefinancialassistance beyondtheassistanceavailablefrom othersourcestopayfortheirtraining.OthergrantassistanceincludePellGrants,WelfaretoWorkfunds,Statetrainingfunds,scholarships,andTradeAdjustmentAssistancefunds.

AllparticipantsreceivingtrainingservicesundertheWorkforceInnovation and Opportunity ActprogrammusthaveanIndividualTrainingAccount(ITA)establishedontheirbehalftofinancetrainingactivitiesand associatedcosts.Thefollowingexceptionsapply:

•On-the-JobTrainingorcustomizedtrainingprojects.

•InstanceswheretheWorkforceDevelopmentBoardhasdeterminedthereareaninsufficientnumberofeligibletrainingprovidersinthelocalareato establishanindividualtrainingaccountsystem.(TheGreaterNebraska Workforce DevelopmentBoardhasnotmadethisdetermination.)

•Atrainingprogramofdemonstratedeffectiveness,ifofferedinthelocalareabyacommunity­basedorganizationorprivateorganization,whichservesspecialpopulationswhofacemultiplebarrierstoemployment.

Toidentifytherequirementsforon-the-jobtrainingcontractsandcustomizedtrainingprojects.

Policy

On-theJobTraining:On-the-jobtraining(OJT)istrainingbyanemployerprovidedtoapaidclientwhileengagedinproductiveemployment.The employermaybefromthepublic,privatenon-profitorprivatesectors.TheOJTtrainingprogram:

•Providesknowledgeorskillsessentialtothefullandadequateperformanceofthejob.

•Providesreimbursementtotheemployerforuptofiftypercentofthewagerateoftheclients,fortheextraordinarycostsofprovidingthetrainingandadditionalsupervisionrelatedtothetraining.

•Islimitedin durationas appropriate totheoccupationtheclientisbeingtrainedfor,takingintoaccountthetrainingcontent,participant'spriorexperience,andtheservicestrategyoftheparticipant.

CustomizedTraining:Customizedtrainingmeanstraining:

•Designedtomeetthespecialrequirementsofanemployeroragroupofemployers.

•Conductedwithacommitmentbytheemployer(s)toemploytheclientuponsuccessfulcompletionofthetraining.

•Employerpaysfornotlessthan50percentofthetrainingcosts.

•CustomizedtrainingprojectsmustbeapprovedbytheWorkforceDevelopment Board.

On-The-JobTrainingContract:Atrainingcontractmustbedevelopedbetweentheserviceproviderandtheemployerprovidingthetraining.The serviceprovidermustconductapre-awardreviewtodetermineiftheemployerisqualifiedandcapableofentering intoacontractualagreementtoprovideon-the-jobtraining.The pre-awardreview,inadditiontotheclient'semploymentplan,willprovidesupportingdocumentationfortheappropriatenessoftheon-the-jobtrainingassignment.Apre-awardreviewmustbecompleted priortothenegotiationandapprovaloftheOJTcontract.

Limitations:

•TheOJTcontractmustbelimitedtotheperiodoftimerequiredfortheclienttobecomeproficientintheoccupationforwhichthetraining isbeingprovided.

•EmployerswhohaveexhibitedapatternoffailingtoprovideOJTclientswith continuedlongterm employmentandwages,benefits,andworkingconditionsequaltoregularemployeeswhohaveworkedasimilarlengthoftimeatthesametypeofwork,shallnotbeconsideredforOJTcontracts.

•Employerswhohavebeendebarredorsuspendedfromreceivingfederalcontracts shallnoteligibleforanOJTcontract.

•OJTcontracts shall notbedevelopedfor:

oPositionswhichdonotprovideaself-sufficientwage. (Aself-sufficientwageisdefinedasawagethatprovidessufficientincome tosupportaminimallydecentstandardofliving,withoutpubliccashassistance.)

oPositionswhichreceiveamajorityofpayfromcommissionorpieceratewages.

oPositionswhichareintermittentorseasonal.

oTemporaryemployeeswhoaresuppliedtoanemployer byatemporaryagency/contractor.

oTemporarypositionsexceptwhenthe employerhasthecommonpracticeofhiringallemployeesonatemporarybasis,andlettingthemworkintofull-timepermanentstatusafterachievingpre-determinedproductivitylevels,meetingqualitativestandards,maintainingsatisfactoryattendancerecord,and/orothercriteriaasspecified inthecompany'spersonnelpolicy.

oOccupationsincompanieswhichhaveexperiencedagreaterthanaverageturnoverrateduringtheprecedingtwelve-monthperiodforsimilartypesofindustries.

oIndustrieswithasubstantialnumberofexperiencedandableworkerswhoarepresentlyunemployedwithinthesamelabormarketarea(50-mileradius).

oAnyestablishment, orpartthereof,thathasrelocatedwithintheUnitedStates,

WashingtonDC,andits territories,until120daysafterthedateonwhichsuchestablishmentcommencesoperationsatthenewlocation,iftherelocationresultsinalossofemploymentforanyemployeeattheoriginallocation.

Workers'Compensation:AllemployerscoveredbytheNebraskaWorkers'Compensation lawarerequiredtoprovideWorkers' CompensationInsuranceforOJTemployees.EmployersexemptfromWorkers'Compensation(farm/ranchlaborersandhouseholddomesticworkers)arerequiredtoprovideadequateon-sitemedicalandaccidentinsurance.Workers'compensationprovidesmedicalcareandincomemaintenance protectiontoworkers disabledfrom work-relatedinjuryor illness.

Incomemaintenancecoverageisnotrequiredforclientswhoare employedbyexemptemployers.

Exemptemployersarerequiredtocertifyinwritingtheyprovideadequateon-the-jobtrainingsitemedicalandaccidentinsurance.Inaddition,theOJTclientshoulddocumentthathe/sheunderstandsthejobisnotcoveredbyWorkers'Compensationinsuranceandintheeventofaninjury;he/shewouldhavenoclaimagainsttheStateofNebraska,theGreaterNebraskaWorkforceDevelopmentBoardortheServiceProviders.

TypesofContracts:MostOJTcontractswillbeforfull-timeemployment,or40hoursperweek. ParttimeOJTsmaybewrittenfor20ormorehoursperweekforpersons whoseneedforemploymentisbestserved bylessthanfulltimework(forexample,asappropriate,olderworkers,handicapped,singleparents). Inaddition,aparttimeOJTcontractof20ormorehoursperweekmaybewrittenforapersonseekingfulltimeemploymentwhennoappropriatefulltimeemploymentisrealisticallyavailable.Aclientmaynotreceivetrainingconcurrentlyontwo parttimeOJTcontracts.

WorkOpportunitiesTaxCredit(WOTC): Foremployerstoreceiveataxcreditundertheseprograms,theapplication forsuchcreditmustbeforwardedtotheNebraskaEmploymentServiceonorbeforethestartdateofthejob.Eventhoughtheone-yearclockforWOTCstartsonthefirstdayoftheOJT,theemployercannotclaimataxcredituntilthecontractiscompleted.QuestionsonWOTCshouldbereferredtothe Employment and Training WOTC officeat(402)471-9977 .

EmployerReferrals:Employersmayrefer individualstotheserviceproviderforadeterminationofprogrameligibilityandassessmentofsuitabilityforthe-jobtraining.Employerreferralscannotexceedthirtythreepercent(33%)ofthetotalOJTcontractsdevelopedbytheServiceProvider.

OJTToolContract:WorkforceDevelopmentisthepurchaserandownerofallOJTtoolsand/orequipmentfortheclient'suseduringtheOJT.UponsuccessfulcompletionoftheOJTthetoolsandequipmentpurchasedwillbecometheclient'sproperty.If theclientdoesnotcompletethecontractedOJTforanyreason,alltoolsandequipmentmustbereturnedtoWorkforceDevelopment.

Forms:TemplatesoftheOJT PlanandtheOJTRelatedEducationOnlineformsareavailable.Theserviceprovider mayelecttousetheseformsordevelopformsthatbettersuittheirpurpose.
