  1. CALL TO ORDER

Commissioner Toomer called the meeting to order at 6:07 p.m. and welcomed everyone. The roll call noted that commissioners Justice and Nielson were present with Commissioners Conover and Bloomer absent.

  1. APPROVAL OF MINUTES Dated 8-11-2015

Commissioner Nielson moved to approve the minutes as written. Commissioner Justice seconded the motion. The motion carried with commissioners Toomer, Nielson, and Justice voting aye and commissioners Conover and Bloomer absent from the vote.

  1. BUSINESS LICENSE

BK GARDENS-230 WEST 300 NORTH-BEAU KILLPACK

Beau Killpack addressed the commission with an application for a business license for a green house. He would like to move it backto the original place for now until he can find his own property. He was told he would have to get written permission from dad stating that it was okay for him to do that.It’s been 10 years since the green house was removed from the property. It was suggested to clear it with CommissionerChair Bloomer and check to see it he is required to have a building inspection and fire inspection done.

Commissioner Nielson moved to approve the business license pending a letter of permission from the land owner and confirming with Commission Chair Bloomer. Commissioner Justice seconded the motion. The motion carried with commissioners Toomer, Nielson, and Justice voting aye and commissioners Conover and Bloomer absent from the vote.

POPZ REPAIR SHOP – 390 SOUTH 400 WEST – KELLY HOWES

Kelly Howes addressedthe commission with an application for a home based business license for repairing small engines out of his garage. He would be doing small engine repair onATV’s and lawn care equipment like lawn mowers and trimmers. He has had the fire inspection and fixed the requirement to pass it. Commissioner Justice noted concern about the noise ordinance with him being by the Jr. High and with the school zone when he test drives the dirt bikes. Kelly stated he would be the only one test driving the dirt bikes and will follow the noise ordinance and school zones.

Commissioner Justice moved to approve the business license for Popz Repair Shop. Commissioner Nielson seconded the motion. The motion carried with commissioners Toomer, Nielson, and Justice voting aye and commissioners Conover and Bloomer absent from the vote.

  1. UNFINISHED BUSINESS

The City has been getting a lot of complaints on lot number five in Ethan Hurdsman’strailer park located at 75 south 100 West on Canyon Road.The residents have been having a yard sale that started the first part of September. The city has sent Ethan Hurdsman three letters already and the commission agreed that they will take away his business license if he doesn’t do something about it. It was reported that the state has repossessed the mother’s property located on 800 west and now the kids are trying to sortit out. It was suggested to send a letter to the countyasking them to clean the mother’s property up.

It was discussed if we have a permit to stay in a camper and for how long.

AJClark has been issued a 48 hour notice for cars being parked on the streets.

Brian Aldridgehas had complaints about cars being parked on the streets as well.It was suggested to put the ordinance in the news letterstatinghow long cars can be parked on the street. Commissioner Justice wanted to thank the Emery County Sheriff’s office for patrollingCanyon Road. AJ and Patricia Clark’s animal complaints were discussed and it was suggested to send them a letter stating that it needs to be cleaned up and then hand it over to the attorney orcall the health department. The pet problem in the city is getting out of control and it was discussed that we need an animal enforcement officer and an ordinance enforcer who would go around and enforce the ordinances.It was noted that the current city employees should be doing this and it was suggested to talk to Mayor Jackson about appointing one of them to do it.

Commissioner Nielson moved to adjourn the meeting. Commissioner Justice seconded the motion. The motion carried with commissioners Nielson, Toomer, and Justice voting aye and commissioners Conover and Bloomer absent from the vote. The meeting adjourned at 6:35 p.m.
