Waiver: Upon being accepted to join the Potter County Artisan Center as a vendor, I understand and agree to adhere to the Artisan Center By-laws and Contractual Agreement. I understand that the display and sale of my work is subject to the discretion of the Membership Committee and the size and location of my display will be dependent on the type of work I do and available space at the Artisan Center at any given time. I understand that the Potter County Visitors Association is not responsible for any theft, loss or damage of my work.

Potter County Artisan Center Artist Contractual Agreement
Mission:
The Potter County Artisan Center is dedicated to providing a venue for regional artists to display and sell original work and to promote art in the community. The Artisan Center strives to encourage and support artists and budding artists whose work reflects our inspiring environment, cultural heritage and arouses passion for art in our community. We also assist artisans to understand small business dynamics through their experience and educational programming.
1)TERM & TERMINATION: This agreement shall commence upon signing and after one year may be terminated by either party after giving 30 days written notice.
No member is exempt from the stated duties in this Contract without forfeiting his/her privileges to exhibit and remain a member in good standing of the Artisan Center. A member may be terminated by a majority vote of the Roundtable for non-compliance. Exemptions are granted on a case-by-case basis by the Joint Organization Leadership Team.
2)DUES:Artisan agrees to pay a yearly, non-refundable membership fee of $100. This will be due when invoiced in the first quarter, or may be paid at a rate of $25 quarterly in March, June, September and December. Dues and fees may be re-evaluated annually at the January Roundtable meeting.
3)SALES COMMISSIONS: Commission from the sale of items will be 65/35 split (Artisan 65% / Artisan Center 35%) for those choosing not to volunteer and not serving on a committee. Artists who choose to work pay a commission of 30% which is reduced by 1% for each hour worked. Shifts are covered in 4 hour blocks. Artists shall establish the retail value of works, and agrees not to undercut that price at other regional venues. For more detailed information, please see the attached schedule (Appendix A) for details regarding the sales commissions
4)ARTISAN CENTER STAFFING:Artisans are asked to work a minimum of eight (8) hours per month and to sign up on a monthly basis. If unable to fulfill the scheduled time, the artisan is responsible to make arrangements for a replacement. All artisans are expected to participate in Artisan Center events when able. Artisan hours worked will be verified monthly prior to payments being mailed.
5)SALES TAX: The Artisan Center will add the applicable tax to the retail price established by the Artisan. The Pennsylvania State sales tax will then be paid by the Coudersport Area Chamber of Commerce.
6)PAYMENTS: The Coudersport Area Chamber of Commerce will do their best to mail checks by the 15th of the month for the previous month’s sales. Each payment will be accompanied by a list of items sold during the prior month.
7)NEW MEDIA: Any work in a media previously not exhibited by an artist must be accepted by the Membership committee in accordance with the By-laws.
8)INVENTORY:Artisans are responsible to re-stock, re-display or change out their own inventory with the assistance of the Gallery Manager. Artisans are responsible to keep area neat and tidy. Inventory can be completed during established business hours. Each item must be clearly labeled by the artisan and have an inventory tag with the Artisan’s brief description and the retail price. Items that are non-taxable like jams, jellies and teas need to have NT in red on the tag as well. Artisans are required to use Inventory Tags that will be provided by the Artisan Center or those provided by the Pennsylvania Wilds for those juried artisans. The inventory will be put in the POS by either the Gallery Manager or by the Chamber Office Assistant. The Gallery Manager will place new items in the Center.
9)DISPLAY CONDITIONS: The number of works selected will depend upon the size of work and available space. Display units will be accompanied by a printed name and business description to be displayed in an 8x10 black frame. Artisan biography must also be provided for a variety of uses. The Facilities Committee has the final decision on any display or related issues.
10)MEETING ATTENDANCE: All Artisan Center Meetings are open to the public. Artisans are strongly encouraged to attend all Roundtable meetings. Decisions are passed by a majority vote of members present at any given meeting. Those artisans that are unable to attend will have the ability to vote on items within 48 hours of the meeting. Items will be sent by the Secretary via email and artisans are asked to respond quickly.
11)INSURANCE: The Coudersport Area Chamber of Commerce agrees to provide liability insurance pertaining to building use. Artists are encouraged to acquire their own liability insurance through their broker.
12)SECURITY: Although the Artisan Center is located in a secure, protected building, the Coudersport Area Chamber of Commerce is not responsible for damage, loss or theft from the Artisan Center.
13)DISPUTES: Any disputes will first be addressed to the Roundtable for resolution. If the resolution is not acceptable to either party, the issue will be brought to the Joint Organization Leadership Team. The decision of the Joint Organization Leadership Team shall be final.

NOTE: The rates for the first four hours worked are all-inclusive of a 5% increase in seller
revenue and a 1% increase in each hour worked, totaling 9% for the first four hours worked.
Hours may not be carried over each month.
At the beginning of a new month, the compensation rates starts at the base rate.
Seller compensation is capped at 30 hours, where the seller receives 100% of their sales
on their items.
