POINTS ON WHICH ANSWER IS REQUIRED FROM PAN MANAGEMENT

We request the Management to give their specific comments against the grievances highlighted below:-

  1. Penalty for delay in Possession of flats to be paid to all buyers with immediate effect. The arrears of the penalty for delay to be paid to the buyers with interest rate of 24%. PAN Management to confirm in writing that they would not invoke provision of clause 21A and 21C of the FBA for denying payment of Penalty for delay in possession except for Force Majeure (acts of God, War, Flood, Riots).

Ans PAN:

  1. PAN Management to provide a copy of the approval of Noida, regarding purchase of additional FAR. Pan Management to confirm that the Studio Apartments, Additional Floors in some of the towers, Extension of Balcony and Commercial Shops being constructed are approved by NOIDA and to provide a copy of approved drawing /layouts of these extra constructions. PAN management also to commit that they would not procure any additional FAR than the FAR approved by NOIDA as on date further PAN Management pass on all the benefits arising out of extra FAR bought by them so far such as reduction in proportionate area etc.

Ans PAN:

  1. PAN Management not to charge payment for those facilities (Parking, Club House etc.). Which are not handed over to buyers at the time of giving possession. Pan Management confirms that they would charge payment of these facilities from the buyers only when they are handed over to buyers in ready to use condition.

Ans PAN:

  1. When does PAN intend to hand over the Flats of Towers A, B, C and D? Kindly give us specific date.

Ans PAN:

  1. When does PAN intend to hand over the Flats with respect to other Towers? Kindly give us specific date.

Ans PAN:

  1. Kindly provide us the List of Works that has to be completed for handing over of all towers and common area including amenities.

Ans PAN:

  1. Please provide us the detailed working plan to achieve these left over work within the time promised.

Ans PAN:

  1. Kindly provide us the list of labourers (from the attendance register or muster role) that have been deployed & sub-contractor at site in the last three months. Pls provide the details of targeted deployment of laboures & actually deployed at site in the last 3 months

  1. What are the correct issues with the contractors of the project? Kindly give us the details for each contractor with whom you have issues with full details.

Ans PAN:

  1. What are details of the current subcontractors for the project? Like Architect, subcontractors for civil work, electrical work, horticulture, painter etc. kindly give us the copy of the contract entered with them?

Ans PAN:

  1. From which date PAN intends to deploy at least 1000 labourers to complete the remaining work within the time promised?

Ans PAN:

  1. The buyers are not happy with the exterior paint applied at Towers A, B, C and D. Kindly change the exterior paint of Towers A, B, C and D with prior sanction of colors from the buyers.

Ans PAN:

  1. Why PAN is applying poor quality of materials at site like worst quality of glasses on windows and door panels, poor quality of doors and windows, poor quality of tiles, poor quality of tin to cover the exterior pipes in the Balconies. Kindly give us a commitment that these issues would be resolved before the possession of the Apartments is handed over to the Buyers.

Ans PAN:

  1. Kindly give us a commitment that the Penalty in terms of Buyer’s Agreement would be released to the legal buyers immediately.

Ans PAN:

  1. There are substantial deviations from the initial plan projected to the Buyers at the time of sale of individual units. The brochure shows play area in front of Towers A, B, C and D and also shows Tennis court diagonally opposite Tower A (road facing). However, at the actual site these are missing and Transformers and A.C. Units have been installed in place of them. Such transformers and A.C. Units would be a threat to the children playing around in the common area. Kindly re-plan and remove the Transformers and A.C. Units from the present location.

Ans PAN:

  1. We suggest that a joint committee of the PAN Management and the buyers be formed to monitor the completion of the remaining work.

Ans PAN:

  1. PAN Management to provide clear cut basis of measurement of the area of the Flats and that of increase in area of Flats by 4%.

Ans PAN:

  1. The premium paid to NOIDA authority for land and lease rent, If all paid then receipt for the same if not then why???

Ans PAN:

  1. The extended commercial space is with approval with the competent authority or not?????? If yes then why tennis court and green park has been abolished in revised plan ?

Ans PAN:

  1. Status of H, J and K tower is same as last 1 and half years, give the reasons and what action is taken from you, Ist phase tower is far behind their schedule.

Ans PAN:

  1. Kindly let us know the details of last paid installment to NOIDA against the premium paid for land and lease rent granted to PAN.
