Referral Agreement

A referral is a job fromExclusively Baby Nursesrequesting newborn services. EBN will post it as a referral job. EBN’s requires a referral fee for you to accept that position.

This Agreement between ______(Your name) herein referred to as: Referred NCS and Exclusively Baby Nurses: will commenceon the ______day of ______2015

Location of Service: Referral services are requested from all over the U.S and sometimes abroad. The Referred NCS wishes to be placed on the list for

______(State), ______(other states) ______Nationwide or ______world wide.

Terms of Agreement: This Agreement begins on the date listed above and continues indefinitely until either of the parties decides to terminate the agreement.

Termination of Agreement: This Agreement may be terminated by either party. Should you (the Referred NCS) want to terminate the arrangement, written notice will be required. Should I (the Referring NCS) want to terminate this agreement, written notice with cause is required.

Compensation. Compensation is to be paid on a weekly basis. Payment to be posted to the account no later than Saturday 12 pm of each week. Upon written agreement and if the position is over one (1) month, monthly compensation may be paid. Monthly payments will be due on the 30th of each month. Compensation will be made via PayPal using the personal gift option (as to not incur further charges). Payments not made on time will incur a late fee of $5 per day for each day late.

Payment structure is as follow:

8 hours: $10.00 fee

For shifts that are not worked in 8 hour increments, the referral fee is $1.25 an hour. (Simply multiply the total hours times $1.25.)

When working a round-the-clock job, the referral fee is $30 per day.

Sleep training job: Flat fee of $50 or the above $10 per hour shift whichever is more

Consultation referral: Flat fee $50

Documentation: The Referred NCS agrees to send the Exclusively Newbornsa copy of hours worked along with her payment each week/month. It is understood that should the Exclusively Newbornsbelieve the hours reported to be false; the Exclusively Newbornshas the right to notify the client to verify the hours. This is also grounds for termination of the referral agreement and immediate payment of all fees.

Contact: The Exclusively Newbornshas the right to contact the referred client at any time. This contact may include confirmation of the Referred NCS’s service, hours or any general information the Exclusively Newbornsmay need for her records concerning the position.

Contracts: The Referred NCS and the Client will forge a contract between them without the aid or approval of the Referring NCS. The Exclusively Newbornsis NOT responsible or liable to the client for any actions done by the referred NCS. The Exclusively Newbornsis simply giving the client the referred NCS’s phone number or email. The referring NCS’s responsibility ends once this information is given to the potential client.

Communication: Communication is of utmost importance. Should either party have an issue that needs to be addressed it is to be done in a timely manner and with kindness.

Responsibilities of the Referred NCS:

1.Once the Referred NCS has made contact with the client, she is responsible to inform the Exclusively Newbornsof the outcome within 24 hours. This contact may be made by email, text or a phone call.

2.When a contact has been signed or an agreement reached with the client, the Referred NCS must send the Exclusively Newbornsthe start date, end date, hours per day, and the date the contract was signed within 24 hours. This information must be sent in an email with the client’s name in the subject line along with the word ‘REFERRAL’

3.Should the Referred NCS be asked by the client for additional names for her friends or should the position be something the Referred NCS be unable to fill and the client asks you for a referral to someone, you are required to refer the client back to the Exclusively Newborns failure to do this will result in you owning the Referred NCS compensation for all work you or the person you referred gained from this client.

4.Should something occur that makes it impossible for you to complete or begin the signed contract, you must notify the Exclusively Newbornswithin 24 hours. You may not refer another NCS to the position. It must go back to the Exclusively Newbornsto refer to another. Should you refer another NCS you will be responsible for all the fee’s payable to the Exclusively Newborns

5.I do not collect referral fees from anyone who helps you on the job, you must pay those fees. You can back charge them if you wish. In other words; if you are on a job with triplets and mom decides to have someone else come on the job and help and you suggest a fellow NCS, you will owe me double the fee, one fee for you and one fee for her. If mom finds someone on her own, you owe only your fee.

If you refer the client back to me for another NCS you do not owe the additional fee.

6.Once the job is compete and for the next year (from the end of that position) if they call you back for any reason, you must clear it through me. And you will owe referral fees. After the year + period, you do not owe any fee’s.

7.If while on the job you are referred to another job by my clients you are free to take that job at no charge from me.

In signing this agreement you are signifying your acknowledgement of the terms. You are also agreeing to provide the highest and best service to those you have signed a contract with under this agreement.
