31. APPLICATION FOR PLANNING PERMISSION H/70423 – WILLIAMS TARR LTD – 231 ASHLEY ROAD, HALE

The Chief Planning Officer submitted a report concerning an application for planning permission for the erection of four storey building with basement, to comprise 7 self contained apartments; provision of car parking with new vehicular access following closure of existing access and provision of landscaping.

RESOLVED -

(1) That the application will propose a satisfactory development for the site upon the completion of an appropriate Legal Agreement and that such Legal Agreement be entered into to secure financial contributions towards off-site open space provision (£4,614.19) and outdoor sports facilities (£2,190.62); and a sum of £940 as a contribution towards Red Rose Forest tree planting off-site (to be reduced by £235 per tree planted on-site as part of an agreed planting scheme).

(2) That upon the completion of the above Legal Agreement, planning permission be granted subject to the conditions and standard reasons now determined.

32. APPLICATION FOR PLANNING PERMISSION H/71109 – DESIGN AND BUILD PROJECTS LTD – HOLMESIDE, ST. MARGARET’S ROAD, BOWDON, ALTRINCHAM

The Chief Planning Officer submitted a report concerning an application for planning permission for the erection of a two storey detached dwelling and detached garage building (providing garaging for proposed dwelling and for Holmeside), following demolition of two existing blocks of lock-up garages.

RESOLVED –

(1) That the application will propose a satisfactory development for the site upon the completion of an appropriate Legal Agreement and that such Legal Agreement be entered into to secure:-

·  A contribution to play space or sports facilities of £2,865.19 of which £1,942.82 would be toward open space provision and £922.37 toward outdoor sports facilities in accordance with the Council’s SPG ‘Informal/Children’s Playing Space and Outdoor Sports Facilities Provision and Commuted Sums’.

·  A contribution to tree planting of a maximum of £705 in accordance with the Council’s SPG ‘Developer Contributions towards the Red Rose Forest’.

(2) That upon the completion of the above Legal Agreement, planning permission be granted subject to the conditions now determined.

33. APPLICATION FOR RETROSPECTIVE PLANNING PERMISSION H/71270 – NCM 2000 LTD – BOWLER’S EXHIBITION CENTRE, LONGBRIDGE ROAD, TRAFFORD PARK

The Chief Planning Officer submitted a report concerning an application for retrospective planning permission for the retention of use of the site for car boot sales on Sundays and Bank Holidays.

RESOLVED: That retrospective planning permission be granted subject to the conditions now determined and that Condition 3 be amended as follows:-

Retail sales in connection with the use hereby permitted shall only take place between the hours of 06.30 and 14.30 on Sundays and Bank Holidays and shall not take place outside these hours or on any other day. The site shall not be open to customers or stall holders in connection with the use hereby permitted outside the hours of 06.00 to 15.00 on Sundays and Bank Holidays and all stalls and associated equipment shall be removed from the site by 15.00 on those days.

Reason: In the interests of highway safety and the amenity of the occupiers of nearby premises and in the interests of the vitality and viability of nearby town centres and local shopping centres, having regard to Proposals D1 and D2 of the Revised Trafford Unitary Development Plan and the Council's Planning Guidance, "Car Boot Sales in Trafford".

34. APPLICATION FOR PLANNING PERMISSION H/71290 – STEPHEN CHESLETT – LAND TO THE REAR OF HOLLY TREE COTTAGE, CLAY LANE, HALE

The Chief Planning Officer submitted a report concerning an application for planning permission for the change of use of agricultural barn to residential dwellinghouse and garden and erection of detached garage.

RESOLVED –

(1) That the application will propose a satisfactory development for the site upon the completion of an appropriate Legal Agreement and that such Legal Agreement be entered into to secure a financial contribution (£2,865.19) towards open space provision and outdoor sports facilities and a sum of £705 as a contribution towards Red Rose Forest tree planting off-site (to be reduced by £235 per tree planted on-site as part of an agreed planting scheme).

(2) That upon the completion of the above Legal Agreement, planning permission be granted subject to the conditions and standard reasons now determined and to the following additional condition:-

Notwithstanding the submitted plans, no demolition or partial demolition of the external walls, external steps or roof of the building shall take place unless details of the extent of such works have previously been submitted to and approved in writing by the Local Planning Authority.

Reason: In the interests of the character and appearance of the building and the Green Belt having regard to Proposals C4, C5, C6, ENV17, D1 of the Revised Trafford Unitary Development Plan.

35. APPLICATION FOR PLANNING PERMISSION H/71450 – CRAZY KIDS CLUB (MR. DOUGLAS GLENDON) – UNIT 1 AND THE EMMA SOMERSET BUILDING, PARK ROAD INDUSTRIAL ESTATE, PARK ROAD, TIMPERLEY

[It was noted at Committee that by reason of the lodging of an Appeal against non-determination the Committee did not have the power to determine the Application. However, an indication as to the Committee’s views on the Application was sought.]

The Chief Planning Officer submitted a report concerning an application for planning permission for the change of use from B8 (Storage) and B1 (Business Offices) to D2 (Assembly and Leisure) to form children’s play centre. Unit to include café and associated car parking; various external alterations.

RESOLVED: That the Council is minded to refuse planning permission for the following reasons:-

(1) The applicant has failed to overcome concerns in terms of the safety and security of users of the site and to satisfactorily address the risk of potential conflict between pedestrians and vehicular traffic, with particular reference to the nature of the use of the existing adjacent Industrial units. As such, the development would be contrary to Proposals D1 and D2 of the Revised Trafford Unitary Development Plan.

(2) The development will create a significant demand for car parking provision. The applicant has failed to demonstrate that the provision of car parking within the site is sufficient to meet this significant demand in a satisfactory manner, with the result that vehicles could be forced to park elsewhere in the estate, on the public highway or in neighbouring residential roads to the detriment of residential amenity, the convenience of other users of the estate, the health and safety of users of the estate, highway safety and the convenience of other users of the highway. As such the proposal would be contrary to Proposals D1 and D2 of the Revised Trafford Unitary Development Plan, and the Council's approved 'Car Parking Standards'.

[Note: Councillor Weston declared a Personal and Prejudicial Interest in Application H/71450, due to previous involvement, and left the room during its consideration.]

36. APPLICATION FOR PLANNING PERMISSION H/71476 – MANCHESTER AND DISTRICT HOUSING ASSOCIATION – HARVEST HOUSING

The Chief Planning Officer submitted a report concerning an application for planning permission for the redevelopment of existing vacant site through erection of 6 no. 3 bedroom and 5 no. 4 bedroom affordable houses with associated car parking, landscaping and access from Laurel Walk.

RESOLVED –

(1) That the application will propose a satisfactory development for the site upon the completion of an appropriate Legal Agreement and that such Legal Agreement be entered into to secure financial contributions of £12,000 towards open space provision; outdoor sports facilities; and towards public transport improvements and highway infrastructure improvements. The Legal Agreement will also include an overage clause to ensure that an appropriate commuted sum is secured should the applicant’s current assumptions about the viability of the scheme prove to be incorrect in due course.

(2) That upon the completion of the above Legal Agreement, planning permission be granted subject to the conditions now determined.

37. APPLICATION FOR PLANNING PERMISSION H/71517 – IAN HUNTER ARCHITECTS – LAND TO THE REAR OF 89 BLOOMSBURY LANE, TIMPERLEY

The Chief Planning Officer submitted a report concerning an application for planning permission for the erection of a dwellinghouse including access, landscaping and parking.

RESOLVED –

(1) That the application will propose a satisfactory development for the site upon the completion of an appropriate Legal Agreement and that such Legal Agreement be entered into to secure a contribution of £2,417.50 towards outdoor sports and play facilities in accordance with the Council’s SPG ‘ Informal/Children’s Playing Space and Outdoor Sports Facilities Provision and Commuted Sums’.

(2) That upon the completion of the above Legal Agreement, planning permission be granted subject to the conditions and standard reasons now determined.

38. APPLICATION FOR PLANNING PERMISSION H/71565 – MR. TAHIR SALEEM – 139 AYRES ROAD, OLD TRAFFORD

The Chief Planning Officer submitted a report concerning an application for planning permission for the change of use of ground floor from shop (Class A1) to hot food takeaway (Class A5) and installation of extraction flue to rear.

It was moved and seconded that planning permission be granted.

As the votes cast were tied, the Chairman used her casting vote to vote against granting the application.

RESOLVED: That planning permission be refused for the reasons now determined.

39. APPLICATION FOR PLANNING PERMISSION H/71588 – SOUTHERN CROSS – 130 STRETFORD ROAD, URMSTON

The Chief Planning Officer submitted a report concerning an application for planning permission for the erection of a part three, part two storey building to provide a 63 bedroom residential care home, provision of associated parking areas and landscaping (revised submission).

RESOLVED –

(1) That the application will propose a satisfactory development for the site upon the completion of an appropriate Legal Agreement and that such Legal Agreement be entered into to ensure compliance with covenants contained in the Legal Agreement linked to Application H/69757.

(2) That upon the completion of the above Legal Agreement, planning permission be granted subject to the conditions now determined.

40. APPLICATION FOR PLANNING PERMISSION H/71614 – BECKHALL PROPERTIES – 158 BROAD ROAD, SALE

The Chief Planning Officer submitted a report concerning an application for planning permission for the conversion of existing dwellinghouse to provide 4 no. two bedroom apartments and 1 no. one bedroom apartment with associated external alterations to all elevations, including insertion of new windows and creation of basement lightwells. Creation of car parking for five vehicles and erection of new bin store enclosure.

RESOLVED –

(1) That the application will propose a satisfactory development for the site upon the completion of an appropriate Legal Agreement and that such Legal Agreement be entered into to secure a contribution of £8,596.01 towards outdoor sports and play facilities in accordance with the Council’s SPG ‘Informal/Children’s Playing Space and Outdoor Sports Facilities Provision and Commuted Sums’ and £1,175 towards off-site tree planting in accordance with the Council’s SPG ‘Developer Contributions towards Red Rose Forest’.
