36APPLICATIONS FOR PERMISSION FOR DEVELOPMENT

The Director, Economy and Environment submitted a written report detailing the following applications which had been submitted in accordance with the Town and Country Planning Act 1990 and the Town and Country Planning (Development Management Procedure) (England) Order 2015 and reported orally on the following:-

(A) APPLICATION NUMBER 17/00113 – AMENDED PLAN (BUILDING NOT TO BE EXTENDED). CONSTRUCTION OF EXTERNAL FLUE AND CHANGE OF USE OF EXISTING BUILDING FROM RECYCLING USE (B2) TO HEAD AND ENERGY RECOVERY PROCESS (SUI GENERIS) AND INTRODUCTION OF MECHANICAL DRYING OF INERT SOILS AND AGGREGATES (B2) ADJACENT TO THE EXISTING RECYCLING SHED TOGETHER WITH THE INSTALLATION IN UNDERGROUND DUCTS OF PIPES CONNECTING THE ENERGY RECOVERY PLANT IN THE SAID BUILDING TO THE DRYER AT CALDER VALLEY SKIP HIRE, BELMONT INDUSTRIAL ESTATE, ROCHDALE ROAD, TRIANGLE, SOWERBY BRIDGE (recommended mindful to permit by the Director, Economy and Environmentsubject to the conditions set out in the list submitted and referral to the Secretary of State for Communities and Local Government)

The applicant’s agent and an objector’s representative attended the meeting and addressed the Committee. Councillor Mrs Carter, Councillor D Foster, Councillor Holden and Councillor Payne attended the meeting as Ward Councillors and addressed the Committee.

Before the meeting Members had received e-mails from the applicant’s agent and an objector, the Benbow Group, directly making their case. In addition, Members had also received an additional e-mail from Benbow Group attaching draft reasons for refusal. Members were reminded and agreed that they were approaching this application with an open mind.

RESOLVED that the application be refused subject to the following reason:

R1The applicant has failed to demonstrate that the proposed incineration process will acceptably mitigate emissions of pollutants to the atmosphere. Furthermore the polluting emissions will materially reduce air quality in the vicinity of the site and be harmful to human health. The application is therefore contrary to policies WM 9 (Incineration) and EP 1 (Protection of Air Quality) of the Replacement Calderdale Unitary Development Plan.

(Councillor Baines declared an interest in the above application as he was acquainted with Mr D Sawrij who he believes has a financial interest in the applicant’s company. He has had infrequent meetings with Mr Sawrij as he has a business within his Ward and confirmed that he had not discussed this application with him).

(B) APPLICATION NUMBER 17/00114 – VARIATION OF CONDITIONS 5 (TO ALLOW 24 HOUR USE WITHIN THE BUILDING MONDAY TO FRIDAY INCLUSIVE) AND 12 (TO ALLOW USE OF HEAT AND ENERGY RECOVERY PLANT) OF PLANNING APPLICATION 04/02712 AT CALDER VALLEY SKIP HIRE, BELMONT INDUSTRIAL ESTATE, ROCHDALE ROAD, TRIANGLE, SOWERBY BRIDGE (recommended mindful to permit by the Director, Economy and Environmentsubject to the conditions set out in the list submitted and referral to the Secretary of State for Communities and Local Government)
