The Hyde Park City Planning Commission meeting began at 7:00 P.M. and was conducted by Chairman Mark Lynne.

APPROVAL OF MINUTES
Brandon made a motion to approve the minutes of the Planning Commission meeting held April 19, 2017 as is. Melinda seconded the motion. Mark Lynne, David Zook, Melinda Lee, Brandon Buck, Tiffany Atkinson and Connor Balls voted in favor.

CITY COUNCIL REPORT
Councilman Brad Robinson reported on the City Council Meeting held April 26, 2017:
1. Discussed the subdivision ordinance forwarded from the Planning Commission. Council could not decide or agree on the 80%/20% rule, nor estate lots. They discussed limiting frontage but the item was tabled until each member clearly states their position.
2. Briefly discussed the Master Trails Plan and look forward to seeing a version from the Planning Commission to approve.
3. Charles noted the plans for the new park are moving forward. A temporary pit was dug to test water drainage. The funds for the park are linked to the land swap with the building of the new Green Canyon High School.
4. The Utah Trust presented a safety award to Hyde Park City which includes reduced premiums and a rebate.
5. Held a public hearing regarding the sewer rate increase. No one came or spoke.
6. Discussed changes in the election laws. Anyone desiring to run must declare candidacy by June 1.
7. Discussed and approved the tentative budget.
8. Approved a cooperative agreement regarding fire fighting.
9. Mark gave an update on the Hyde Park City Celebration plans.
MOUNTAIN GATE SUBDIVISION PHASE 4, FINAL PLAT (Administrative)
Reviewed and considered the Final Plat of Mountain Gate Subdivision Phase 4 located at approximately 750 East 600 North. The proposal is for 24 lots on the previously approved single lot 64. They used the Bonus Density option and designated six lots accordingly (lots 63, 101, 102, 107, 113 and 117). Mark noted lot 119 needs to be re-shaped or dropped due to its proximity to the water line. The plat notes a 15’ setback (30’ during construction) for the “west line easement” and a “non-buildable area”. Lot 118 may be affected as well. The water line easement is also a likely future trail. Melinda noted the Post Office is restricting individual mailboxes and requiring new subdivisions to install community mailboxes.
Mark made a motion to approve the Mountain Gate Subdivision Phase 4 Final Plat contingent on 2 items:
1. The city engineer review the water line setback and assure lots 118 and 119 do not infringe on the water line easement.
2. The developer works with the post office on placement of community mailboxes.
David seconded the motion. Mark Lynne, David Zook, Melinda Lee, Brandon Buck, Tiffany Atkinson and Connor Balls voted in favor.
PUBLIC HEARING – STEVE SEAMONS MINOR SUBDIVISION (Administrative)
Held a public hearing to review and consider the Minor Subdivision submitted by Steve Seamons for two lots on 0.73 acres in a residential (R1) zone. The location is 270 North 200 West. Neighbor Gary Earl spoke in favor of the subdivision and is happy to have Steve living closer. The public hearing was closed.
David asked about the minimum lot size in the area, where the new driveway will line up with 260 North road across the street, and if sidewalk is required. The minimum size is 13,000 square feet, the driveway will be north of the road and Mark noted money will be put in sidewalk ‘kitty’. Steve asked how that amount is figured and when it is due. Mark directed him to talk to Donja in the office about a development agreement. Mark answered Steve that the plat will be recorded after the development agreement is signed.
Mark made a motion to approve the Steve Seamons Minor Subdivision. Brandon seconded the motion. Mark Lynne, David Zook, Melinda Lee, Brandon Buck, Tiffany Atkinson and Connor Balls voted in favor.
PUBLIC HEARING – HYDE PARK CITY MASTER TRAILS PLAN (Administrative)
Held a public hearing to review and consider a Hyde Park City Master Trails Plan. Rob Gunn asked how this plan is involved with canal trails. Mark said they are separate. Melinda requested clarification. Mark agreed this trails plan includes canal trails.
Four items were added to the draft:
1. Color designating the newest park along 250 East. It includes approximately 60 parking stalls which could also serve as a trails parking.
2. Bike lane on 250 East/North Logan’s 800 East.
3. Continued yellow dotted line west on 3100 North (possibly 3200 North).
4. Trail on 300 South from the middle canal to the lower canal.
“TH” designates Trailheads with parking. Three were added:
1. On the northeast corner of the intersection at 200 South 1000 East.
2. On the west side of the middle water tank, north of Juniper Ridge Subdivision.
3. Gravel parking where three trails meet between TH 1. and TH 2. above, along the power line.
City Council plans for a Public Hearing in June so the Planning Commission will continue editing the draft until we need to vote to pass it on to the Council.
KENNEL PERMITS (Legislative)
Connor disagrees with the requirement that every dog be spayed/neutered to avoid a permit fee. Melinda read (and agreed with) an email from resident Rob Gunn (who had to leave early). He is “emphatically opposed to increasing the limit to 3 dogs for a kennel requirement. No one NEEDS more than 2 dogs.” He feels there are too many dogs in Hyde Park already. He hears dogs barking “constantly” and claims each time they have 2-3 dogs each. He concurred with Nolan Krebs that “too many people are irresponsible with their dogs.” John Lee loves animals but feels the intent of most Hyde Park residents is not to encourage, but discourage multiple dogs. Everyone agreed it is difficult to police. Connor feels that with easier restrictions more dog owners will abide by the law. Tiffany feels we need to address cats separately from dogs (instead of Mark’s proposed mixed limit). Brandon and Tiffany noted someone in their neighborhood has multiple cats but Nolan cannot do anything because Hyde Park City does not regulate “cats”. Someone brought up hoarders. Mark pointed out that “no ordinance” will fix hoarders. All agreed to delete reference to cats. Most agreed to allow up to 2 dogs without a permit, and allow 3 dogs (maximum) with a permit, removing the minimum lot size requirement. Discussion will continue next meeting.
