RESOLVED: THAT the minutes of the meeting of the Planning and Transportation Regulatory Panel, held on 19th January, 2012, be approved as a correct record.

146. MATTER ARISING

§  MINUTE 138 – PLANNING APPLICATIONS DETERMINED UNDER DELEGATED AUTHORITY11/60786/FUL – VEHICLE RESCUE SERVICE, MOSS LANE, WORSLEY – RETENTION OF A SINGLE STOREY BUILDING (REMOVAL OF CONDITION 5 PLACED ON PLANNING APPLICATION 09/58324/FUL ERECTION OF A TWO STOREY INDUSTRIAL BUILDING)

Members were advised that condition 5 had related to the removal of an existing smaller building within a certain time of the main building being occupied, and that the application to remove the condition had been approved on the basis that, in planning terms, there were no concerns in relation to the retention of the building when assessed against the development plan.

The harm by reason of visual intrusion and clutter was judged to be of such weight that was not overcome by the approach given by the applicant to its alternative site assessment.
The Panel advised that the applicant should approach the City Council for assistance with alternative sites.

148.  10/59701/FUL – HARBOUR CITY EASTERN END OF DOCK 9, BROADWAY, SALFORD – EXTENSION OF TIME LIMIT FOR THE IMPLEMENTATION OF PLANNING PERMISSION 07/54041/FUL ERECTION OF PART 13/18/23 STOREY BUILDING COMPRISING 300 – ONE, TWO AND THREE BEDROOM RESIDENTIAL APARTMENTS TOGETHER WITH UNDERCROFT CAR PARKING, ASSOCIATED LANDSCAPING AND CONSTRUCTION OF NEW, AND ALTERATION TO EXISTING VEHICULAR ACCESS

RESOLVED: THAT planning permission be granted, subject to minor corrections being made to conditions 5, 6, 12, 14 and 19, and that:-

(i)  The Strategic Director of Customer and Support Services be authorised to enter into a legal agreement under Section 106 of the Town and Country Planning Act to secure the same heads of terms as those from the original planning approval in relation to the provision of open space and off site affordable housing provision.

(ii)  The applicant be informed that the Council is minded to grant planning permission, subject to the conditions, on completion of such a legal agreement.

(iii)  Authority be given for the decision notice relating to the application to be issued (subject to the conditions and reasons stated) on completion of the above-mentioned legal agreement.

(iv)  Authority be given to refuse the application if the applicant fails to complete the S106 agreement on the grounds that the proposals do not support the aims and objectives of PPS1 Delivering Sustainable Development, PPS3 Housing, Policies ST3, ST14, H4, DEV5 and DES3 of the adopted City of Salford Unitary Development Plan and the adopted City of Salford Supplementary Planning Document: Planning Obligations.
