It is agreed by the Photographer on behalf of the Photographer and the Photographer’s employer that unless a specific written agreement has been made between Darlington Raceway and/or the Sanctioning Body and the photographer or the photographer’s employer, “still” or “video/film” or “recordings” taken at Darlington Raceway:
a.will be used for news purposes only, and the “video/film” may only be used within 96 hours of the completion of the event weekend.
b.may not be used for advertising or commercial purposes nor used in any way to imply commercial endorsement or sponsorship, or for any other commercial use.
c.allowed to use up to (two) minutes of racing footage which occurs from the green flag to the checkered flag. Highlights in any single program shall not be in excess of two minutes daily for each event in each division and shall not purport to be live, or be portrayed as live, play-by-play coverage from the track.
d.highlights MUST be part of a bona fide regularly-scheduled, recurring news program or in regularly-scheduled sports update show that is aired year round on at least a weekly schedule and must not unduly focus on the respective sanctioning body (NASCAR, Grand-Am, etc.).
e.will only occur at times other than during any network and/or cable television live coverage of the event or its attendant activities.
f.will comply with media guidelines provided by the Sanctioning Body.
g.that any other uses than as specified herein must be approved in advance in writing by International Speedway Corporation and/or the Sanctioning Body.
Unless a separate agreement by Darlington Raceway and/or Sanctioning Body exists authorizing other use of film, photographs, or recordings taken by the Photographer, any deviation from the foregoing must be requested in writing with a full explanation of intended use, and submitted to Darlington Raceway and/or Sanctioning Body before permission or authorization can be considered.
Photographer agrees to display camera sticker provided by Darlington Raceway on all media and commercial film and video cameras while on Raceway property.
The undersigned accepts this as an Agreement between the Photographer, the Agency and Darlington Raceway and it is clearly understood by the Photographer and the Agency that any violations of this Agreement may result in forfeiture of accreditation and credential to the Raceway, injunctive relief and the exercise of any other remedy available by law.

Note: This form must be filled out and signed by all photographers and ALL TV PERSONNEL for whom credentials are being requested (including directors, producers, talent, etc.). The signed form(s) MUST be returned with the Credential Application Form. No credentials will be issued if this procedure is not followed.
