BAGREEMENT:

  1. I/We and CHRISTO DIPPENAAR ATTORNEYS hereby agree that the attorney’s tariffs which will be applicable, are as follows:

1.1 Fees according to the directives of the Law Society of the Orange Free State published from time to time.

1.2 A deposit of R______ at signing hereof/on request, which will be utilised for the payment of fees and expenses as they become due.

1.3 Accounts (which may be preliminary or final accounts) will be paid within 30 (THIRTY) days of rendering thereof.

1.4 Interest on outstanding balances will be payable at 2 (TWO) % per month, from the due date until date of payment.

1.5 A certificate issued by a director of CHRISTO DIPPENAAR ATTORNEYS shall be prima facie proof of any amount outstanding and due by me/us.

  1. I/We furthermore expressly confirm that:

2.1 The difference between the statutorily prescribed tariffs and the directives with respect to attorney and client tariffs was explained to me/us, and that I/we hereby agree to pay the tariffs as set out in 1.1 and 1.2 above;

2.2 The attorney may withdraw from record and terminate this agreement should I/we fail to give instructions or to pay any fees or expenses due by me/us and in such an event the attorney shall be entitled to retain all documentation in their possession until payment of the outstanding amount has been made by me/us;

2.3 The attorney is entitle to subtract all outstanding amounts from any amount collected on my/our behalf and/or from any deposit kept on any other file/matter, in which I/we have instructed them;

2.4 Should a dispute arise with respect to fees owing or the amount of an account delivered to my/us, such dispute will be submitted to a committee of the Law Society of the Free State to be taxed in accordance with the provisions hereof, and should a higher amount be taxed, CHRISTO DIPPENAAR ATTORNEYS reserves its rights to claim such amount.

CSURETY:

In the event that I/we act herein as representative(s) of a legal entity, I/we do hereby bind myself/ourselves irrevocably and unconditionally in my/our personal capacity as surety/ies in solidum and as co-principal debtor(s) for the due and proper fulfilment of all the legal entity’s present and future obligations towards CHRISTO DIPPENAAR ATTORNEYS, and hereby renounce all benefits arising from the legal exceptions available to sureties, the meaning of which was explained to me/us, as well as the effect of the renunciation thereof.
