1.  This permit application is for a vehicle storage yard located at 8617 Central Avenue Parcel 10. Pt of Parcel 10 is zoned I-1 and is within the Subregion 4 DDO Zone as of June 1, 2010. A vehicle storage yard is a prohibited use in the Subregion 4 DDO Zone. In order for this permit to be approved a vehicle storage yard had to have legally existed with an issued permit prior to June 1, 2010 and can document continuous operation. No prior permits have been issued for the subject property per the Community Standards Division. A certificate of occupancy was submitted with the subject permit for permit 28783-2010-U for auctions. My review does not indicate that this permit was approved by M-NCPPC or issued by DPIE. Per Section 27-548.26 of the Prince George’s Zoning Ordinance an owner of the property in the Development District may request changes to the underlying zones or the list of allowed uses. The owner shall contact Cheryl Summerlin at 301-952-3578 to pursue this process. The Alta/Ascm Land Title Survey Plan submitted is inadequate for review. A site plan, drawn to scale, must be submitted in accordance with Section 27-254 of the Prince George’s County Zoning Ordinance clearly distinguishing the limits of storage area. 12/24/15 – Ok per updated site plan predating Subregion 4 DDO Zone with aerial photo.

7/29/15 – The updated permits are per the permit application revision to change the proposed use to public utility vehicle parking lot:

2.  The site plan submitted indicates existing gravel paving with 194 total parking spaces. Aerial photos indicate that this area has not been cleared therefore a grading/building permit is required. 12/22/15 – Per email from John Ferrante, no grading permit is required at this time.

8/14/15 – See email between MNCPPC and DPIE. Per Rey De Guzman a grading permit will be required. The site will be required also to meet the new swm code. Per Katina Shoulars A NRI will be required and Environmental Planning will need to look at the TCP2 and compare it to what’s been graded out there. I called and informed Mike Lyles of the decision. 12/22/15 – Per email from John Ferrante, no grading permit is required at this time. 12/22/15 – Fence permit 54883-2015-CE has been approved per TCPII-132-98 by Environmental Planning, Megan Reiser.

12/22/15 - Updated permit comments:

3.  The proposed use should be updated to include storage Yard. 12/24/15 – Ok per updated site plan.

4.  Outdoor storage shall not be visible from the street in the I-1 Zone per Section 27-469(c)(1) of the Prince George’s County Zoning Ordinance or a variance will be required to be approved from the Board of Zoning Appeals. This requirement came into effect on March 1, 1979. The 1977 aerial photos do not show that the existing storage area was adjacent to Truck Way. There were trees adjacent to Truck Way per the 1977 aerial photos that were possibly used as screening that are no longer on the property therefore screening from the street is required. Fence permit 54883-2015-CE is for a proposed tree protection fencing which does not meet the screening requirements. 12/24/15 – Ok per updated site plan for 6’ wood board on board sight-tight fence.

5.  The 8’ chain link fence abutting Parcel H must meet I-1 setback requirements. 12/24/15 – To be removed due to fence belonging to adjacent property on Parcel H.

I discussed the updated comments with Mike Lyles. He will get me an updated site plan addressing the comments.

12/23/15 – Access from Central Avenue can be grandfathered per aerial photos and permit 7397-2013-U on Parcel K which indicates WMATA used the adjacent property for a storage yard, permit 18489-2013-U which was approved for a storage yard for WMATA with the site plan demonstrates the same access on Parcel 58 for this subject storage yard also aerial photos indicate the access has been in existence prior to the Subregion 4 DDOZ. Screening from requirements from Truck Way are still required due to the expansion of the storage yard. I discussed this with Bill Joyce and he will speak with Mike Lyles to update the site plan.

Per Legal Department a contract between Skye TMB and utility company to use this lot for utility vehicles to park on this property during emergency weather related emergencies does not make the proposed use a public use it is considered a storage yard.
