Valuation of Accrued Rights for Matrimonial Proceedings

In order for us to providea valuation of your accrued pension rights please complete and return the attached Consent Form to us as quickly as possible, this form gives us written authority to provide you (and your solicitor if applicable) with all the pensions information that will be necessary for matrimonial proceedings.

We may need to ask the Department for Work and Pensions for information, this will take a few weeks to obtain.

Please note that under the Pensions on Divorce etc (Provision of Information) Regulations 2000, I may also be ordered to provide similar information directly to the Court, and certain information (excluding a valuation of your pension benefits) to your spouse if requested to do so.

If you have a change of address and wish to have your pension record updated, please ensure you complete and return the enclosed change of address form along with your CETV application.

Divorce or annulment proceedings must have commenced under one of the following:
  • Part II of the Matrimonial Causes Act 1973 or Part III of the Matrimonial and Family Proceedings Act 1984 (England and Wales power in relation to domestic and overseas divorce, etc) or
  • Part III of the Matrimonial Causes (Northern Ireland) Order 1978, or Part IV of the Matrimonial and Family Proceedings (Northern Ireland) Order 1989 (corresponding Northern Ireland powers(, or
  • The Family Law (Scotland) Act 1985 or Part IV of the Matrimonial and Family Proceedings Act 1984 (correspo9nding Scottish powers)

Important: Please note the calculation may require Guaranteed Minimum Pension (GMP) details from HM Revenue and Customs which can take up to 8 weeks to receive, so please return the completed form as quickly as possible.

Charges for Administration

Produce the first valuation - CETV - of Local Government Pension Scheme benefits in a 12-month period. / Standard annual entitlement under Pension Schemes Act 1993 - to be provided within 3 months of relevant date / Nil

Provision of a second and subsequent valuation of pension benefits within 12 months of the initial valuation. / £150 + VAT(currently £180) per additional quote.
Implementation of a pension
sharing order including apportioning benefits, setting up an ex-spouse as a Pension Credit member or transferring a Pension Credit to another pension arrangement / To cover all administration costs from receipt of pension sharing order to completion of pension payments or transfer out. / £475 + VAT (currently £570)

Note

The full amount of the above charges must be paid before the relevant action is undertaken; the appropriate payment should be enclosed with requests for action. The County Council will, however, comply with the charging requirement specified by the court.

The following are payable in addition to the above:

  1. Any costs arising from the request of specialist, actuarial, legal etc, advice.
  2. Any cost imposed by the insurance company where a scheme member has an Additional Voluntary Contribution contract under the LGPS.

VAT is payable on all the above charges.
