Description / Religious preamble
Bequests:
-  to sister Joan Craddacott Lawson and friend Ann Maddever, now living with John Eliot Esquire £5 each, to be paid within 6 months of testator’s death
-  to George Braund of Black Torrington, Devon, as security for payment of £400 leant thereon, all in trust, all premises under mortgage, undivided moiety of land known as Two Broad Parks, formerly called Broadaparks, Lane End formerly called Twinnaways, Small Land formerly called Smalland, Vosper Meadow, formerly called the long Meadow, and the Bodle Park, formerly called Buddle Park, ‘or by whatever other names the said Fields or Closes of Land have been or now are called or known’, all in Trebursye in parish of St Thomas by Launceston, formerly estate of Richard Howell otherwise Thomas Howell deceased and since of William Howell;
also tithes of corn, grain, garb, hay, wool, lambs and calves and ‘all other tithes both great and small, and all Offerings, Profits and Advantages which shall or may at any time hereafter arise or be due for or by reason of the Rectory of the parish of Saint Thomas the Apostle’ out of these properties; also cottage called Peters’s house and barn together with the Broom Down containing about 9 acres, West Down about one and half acres, Twinnaways about two acres, Orchard Garden and two Quilletts about one acre, and the Marsh about three acres, together with a coppice about half an acre in Higher Trebursye, part of the Manor of Launceston Lands in parish of St Thomas by Launceston, which testator holds under a 99 year lease from George Sweet Esquire determinable on deaths of three named persons; also half of tenement in Higher Trebursye in St Thomas by Launceston called Vosper’s Tenement, consisting of The two Broad Parks, containing about five acres, Buddle Park containing about two acres, Lane End about one acre and three quarters, Smallland one acre and three quarters, The Marsh one acre and an Orchard one quarter of an acre, part of the manor of Launceston Lands, held by testator under another 99 year lease from George Sweet determinable on deaths of three named persons
-  to Christopher Lethbridge of Launceston, gentleman and Thomas Jackett of St Thomas, mason or the survivor of the two in trust to administer as follows:
-  to George Braund pay interest arising on £400 so long as it is chargeable to premises
-  to brother William Howell £40 yearly for life in quarterly payments, not to be subject to his debts
-  to nephew Thomas Richard Howell during life of his father William Howell, any surplus in estate
-  to widow Mary for life as long as she remains a widow, to nephew Thomas Richard Howell and his lawful male heirs, after death of William Howell, freeholds and tithes subject to the mortgage and subject to an annuity of £10. If nephew dies without any heirs who reach 21, estate passes to next eldest son of brother William Howell by Mary his present wife and his legal male heirs or thereafter to third, fourth, fifth son, etc; if none then estate passes to sisters of Thomas Richard Howell in same way; if none then estate goes equally to daughters of brother William Howell as tenants in common
-  to all living children of William Howell except the eldest son, who is entitled to freeholds and tithes, as tenants in common, after death of brother William Howell, leasehold estates subject to proportionable part of mortgage money due. If William Howell dies without leaving any younger children, leasehold premises go to testator’s sisters Joan Creddacott Lawson and Thomazine Howell.If Thomas Richard Howell tries to dispose of any of the lands and tithes, his legacy to be void, and to pass to those entitled under the will if he had already died
Trustees, Christopher Lethbridge and Thomas Jackett not to be accountable for any trust money other than that which they received by virtue of trusts aforesaid nor for loss to the trust not due to wilful neglect; lawful expenses to be reimbursed to trustees
