AT-WILL PRE-PAID/PRE-LABELEDPACKAGE PICK-UP AGREEMENT

This agreement is made between Goin' Postal insert your store’s city, located at insert your store’s address, and insert full name of customerof insert customer’s company name ("the customer")for free daily package pick-up at a facility located at insert address customer stipulates in insert city/town name. As a convenience to the customer, Goin' Postal will pick up, free of charge,the customer’s pre-paid UPS, DHL and/or FedEx ("the carrier") packages that bear labels that have been processed through the customer’s own accounts with said carriers and affixed to the packages by the customer, and Goin’ Postal will transport those pre-paid/pre-labeled packages to the Goin’ Postal store located at insert your store’s address and city. Those packages will later be picked up by the designated carriers’ drivers once the carriers’ drivers arrive at the Goin’ Postal store. If transport of the packages in the manner mentioned in this agreement is prohibited by law in the jurisdiction in which the Goin’ Postal store and/or the customer’s location are/is located, then this agreement is null and void and the parties may not enter into said agreement. It is the sole responsibility of those parties to research and ascertain the legality of such an arrangement, and both parties agree to hold harmless each other, the franchisor, and each other’s employees, associates, affiliates, landlords, and insurers.

The parties agree to the following terms:

Time of Pick-Up

Goin' Postal will arrive at insert address customer has stipulated at approximately insert time of day and indicate whether it is a.m. or p.m., Monday - Friday.

The customer or Goin' Postal may change the time of pick-up, upon request, in writing, to a time that is agreeable to both parties.

Place of Pick-Up

Packages are to be picked up by a Goin’ Postal employee from the customer’s address at insert customer’s pick-up address. The customer will have all the packages inside the location and ready to be loaded at the agreed upon time. If the location is to be unattended and unlocked, the customer agrees to accept any and all responsibility for this situation and for any resultant loss, damage, theft, or other situations arising from the facility being unlocked and unattended, and to hold harmless Goin’ Postal and its employees, franchisor, affiliates, associates, and insurers.

The customer or Goin' Postal may change the place of pick-up, upon request in writing, to a place that is agreeable to both parties.

Documentation of Packages to Be Transported

On each date of pick-up, the customer will provide 2 dated copies of a manifest/list of tracking numbers which correspond to the packages waiting within the facility (to be picked up by Goin’ Postal). The Goin’ Postal employee will verify each package and its corresponding tracking number, and will place his/her initials next to each tracking number on the list. This will be done for Copy #1 (customer’s copy) which will be left in the facility for the customer,and for Copy #2 (Goin’ Postal’s copy) which will be taken by the driver and kept on file at the Goin’ Postal located at insert the address of your store. Should there be a discrepancy in the manifest (an unaccounted for tracking number, a tracking number which doesn’t correspond to a package, a missing package, a tracking number with digits that cannot be accounted for, etc.), the Goin’ Postal employee will contact the customer IMMEDIATELY at this telephone number: ______.An alternate number for contact is: ______.

Goin' Postal can also scan individual tracking number barcodes prior to loading them into the vehicle, and can send the customer a list of the tracking numbers by email.

Transportation of Packages

The customer’s packages will be loaded into a covered vehicle and transported to the Goin' Postal store located at insert your store’s address for pick-up by the carrier. If such transport is prohibited by law in your jurisdiction, this agreement shall be null and void and neither party may participate in such an arrangement. It is up to both parties to research this in the city/town, state, and region in question and to act within the limits of the law.

Loss, Damage, Theft

Each item will be packaged and cushioned by the customer in accordance with each individual carrier’s guidelines in order to protect fragile items.

The customer retains all liability for packages packed by the customer, and is responsible for placing any and all claims that may arise from loss, damage, theft, etc. to packages processed using the customer’s own account number.

Goin' Postal essentially acts as a giant drop-box and is responsible for the safekeeping of the packages within the Goin’ Postal store once the parcels arrive at the store.

The individual carrier is responsible for the packages once that particular carrier’s driver scans them into the carrier’s system.

Claims must be made in writing by the customer to the carrier (UPS, FedEx, DHL) within 2 weeks of the shipping date.

Carriers pay claimsbased on timely filing, declared value coverage/insurance and verifiable replacement/repair cost, and the particular circumstances surrounding the specific claim.

Packaging Requests

Goin’ Postal will gladly package any items requested by the customer, will ship these items on Goin’ Postal’s account number, and will be responsible for placing claims for these items ONLY, should loss, damage, theft, etc. occur to these GP-packaged items. These items will need to be given to the Goin’ Postal driver separately, must be presented as an item that requires packaging, and must bear a completed GP Shipping Form in accordance with the chain’s policies. These items cannot be processed using the customer’s accounts with the carrier, but must be processed via Goin’ Postal’s account. Goin’ Postal will send an invoice to the customer for the packing and shipping of these particular items, and the customer agrees to pay said invoice immediately upon receipt. Failure to pay any invoice will result in immediate termination of this at-will agreement between the parties, and may result in litigation to collect sums owed to Goin’ Postal for services rendered.

Items Shipped to the Customer

In order for Goin’ Postal to receive items addressed to the customer, the customer is required to maintain a personal mailbox with Goin’ Postal and to complete the required forms. These items may be transported/delivered to the customer at the address listed in this agreement, upon request in writing, and the customer agrees to hold harmless Goin’ Postal and its employees, franchisor, associates, and insurers for any loss, damage, theft, etc. that may occur during said transport. If said transport is prohibited by law, the parties may not enter into this agreement.

Changes in Pick-Up Volume

If the customer’s daily pick-up volume changes to more than insert high end number ofpackages/day or less than insert low end number ofpackages/day, Goin' Postal reserves the right to change the pick-up time or the number of pick-ups in a week.

Termination of Agreement

The customer or Goin' Postal may terminate this agreement at anytime for any reasonwith a 30-day written notice.
