a)Cllr Mrs T Board’s permanent declaration of interest in accordance with LGA 2000: My beneficial interest in Breage Parish Council owned land registered V.G.621 Praa Green, is that my adjoining property has gate access.

b) To note declarations of interest in accordance with LGA 2000 - Members and officers to declare non-registerable interests or disclosable pecuniary interests (including details thereof) in respect of any items on this agenda and unless you have the benefit of a current and relevant dispensation in relation to these items you must:

(i)  not participate, or participate further, in any discussions of these items at the meeting;

(ii)  not participate in any vote, or further vote, taken on these items at the meeting; and

(iii)  remove yourself from the meeting while any discussion or vote takes place on these items, to the extent that you are required to absent yourself in accordance with the Council’s Standing Orders or other procedural rules.

Where a Member has a non-registerable interest in an item that does not benefit from a valid dispensation and that interest only arises from the Member’s participation in or Membership of a body whose objects or purposes are charitable, philanthropic or otherwise for the benefit of the community the Member may, (with the permission of the Chairman of the meeting or until such time as the Chairman directs the Member to stop) address the meeting to provide such information as they reasonably consider might inform the debate and decision to be made before complying with b).

6.  PUBLIC PARTICIPATION

a)  Each member of the public is entitled to speak once only in respect of business itemised on the agenda or in respect of something they wish to bring to the Parish Council’s attention for inclusion on a future agenda and may speak for a period of time which is at the Chairman’s discretion

b)  A question asked by a member of the public during this public participation session shall not require a response or debate

c)  The Chairman may direct that a response to a question posed by a member of the public be referred to a Councillor for oral response or to the Clerk for a written or oral response

d)  A record of the public participation session shall be included on a separate page in the minutes of the meeting

No time extension available for comment on this application. Councillors voted 2 to support, 2 to object and 2 no comment. As there was no clear majority the Clerk posted that: ‘no comment was made by the Parish Council’. The Officer has informed the Parish Council that it was determined that the proposal was not acceptable as a Non Material Amendment as the changes were too significant.

d) COMPLAINT RE. PLANNING COMMENTS

PA16/03966 - Mr Keith Reynolds – Greenvale, Godolphin Cross, Helston, Cornwall

The Clerk received a complaint from the applicant re. the Parish Council’s comment on the CC website: ‘Breage Parish Council requests that it be informed when the required bat and barn owl survey report is available. Council does not feel that it would be appropriate to make comment until this time as it finds the application unacceptable.’

The Clerk contacted the Planning Officer who confirmed he had taken it that the comment referred to the absent surveys and not the actual application and was told that an updated comment could be made.

To discuss and to resolve that the Clerk submit an updated comment from the minutes of the meeting on 6 June to CC Planning: ‘It was noted that the full bat and owl surveys that are needed had not yet been carried out. It was unanimously resolved that the Parish Council should not comment until these surveys have been received and viewed’

e)  TO CONFIRM THE PARISH COUNCIL’S DECISION

PA16/06499 - Mr M Gordon, M2 Developments - Land Adjacent To 10 The Links, Pengersick Lane, Praa Sands, PENZANCE

New dwelling with integral garage

After last month’s meeting the following was received from the Planning Officer:

I refer to the above application on which Breage Parish Council have advised the following: “Breage Parish Council felt that this should be a retrospective planning application as the build is already under way, obviously without conditional planning permission, and the house is actually named and up for sale so the Council objects to the application's validity.”

I have visited the site and also noticed some ground works had commenced, I have been advised by the agent that the site owner has been clearing the site and putting some hard-core down at the site entrance but has not carried out any works to construct a dwelling. Indeed on my site visit it did not look like any construction had begun on the dwelling such that the proposal is still correct and valid. The site already has planning permission on it for a dwelling such the principle has been established so that it can be subdivided and marketed. How estate agents market the plot is up to them but normally with such things there is a caveat that the plot is subject to planning.

It is my recommendation that the application be approved subject to conditions. Given the parish councils concerns with the proposal in line with the Councils Protocol can you confirm that you are happy for the application to be approved under delegated powers?

In accordance with the Protocol for Local Councils, you now have three options:

1. Agree with my recommendation.

2. Agree to disagree.

3. Maintain your objection to the proposal against my recommendation and request committee consideration by the planning committee (which I will then discuss with the Divisional Member who may or may not agree with your view).

Please tell me which option you wish to choose within 5 working days from the date of this communication. If option 3 is selected, please note that the Protocol explains the importance of a representative from your council attending and speaking at the planning committee meeting so the committee can fully understand your council’s reasons for proposing a decision which is contrary to that of the case officer.

If I do not hear from you within 5 working days, a delegated decision will be issued in accordance with my recommendation.

The Clerk contacted the Members who had voted – result not available in time for inclusion on the agenda.
