ORDINANCE #1844

An Ordinance of The Township of Bernards in SomersetCounty,

State of New Jersey, Establishing Protocol for all Public Body Meetings

NOW THEREFORE BE IT ORDAINED by the Township Committee of the Township of Bernards, County of Somerset, State of New Jersey as follows:

  1. Chapter II entitled “Administration” of the Bernards Township General Ordinances is hereby amended to add new Section 2-33 entitled “Protocol for Meetings”, as follows:

SECTION 2-33

PROTOCOL FOR MEETINGS

§2-33.1.

N.J.S.A. 10:4-6, the Open Public Meetings Act, applies to the following public bodies of the Township:

a.Township Committee

b.Planning Board

c.Zoning Board of Adjustment

d.Board of Health

e.Sewerage Authority

f.Shade Tree Commission

g.Environmental Commission

h.Board of Trustees of Free Public Library

i.Municipal Insurance Fund

j.Local Emergency Planning and Flood Mitigation Committee

§2-32.2.

The Open Public Meetings Act does not apply to the following public bodies of the Township; however, each of these public bodies shall permit public comment at their meetings, keep minutes, notice at least 48 hours in advance of any meetings by either the official newspaper of the Township or on the Township internet website the time, location, date and agenda for its meetings. All meetings of these public bodies shall be open to the public.

b.Ethics Board

c.Recreation, Parks and Pathways Advisory Committee

d.Agricultural Advisory Committee

e. Municipal Alliance Against Substance Abuse

f.Open Space Advisory Committee

g.Golf Advisory Committee

h.Deer Management Advisory Committee

i.Fire Safety Forum

  1. All other ordinances in conflict or inconsistent with this ordinance are hereby repealed, to the extent of such conflict or inconsistency. In the event of any inconsistencies between the provisions of this Ordinance and any prior ordinance of the Township of Bernards, the provisions hereof shall be determined to govern. All other parts, portions and provisions of the Revised General Ordinances of the Township of Bernards are hereby ratified and confirmed, except where inconsistent with the terms hereof.
  1. If any article, section, subsection, paragraph, sentence, clause or phrase of this Ordinance is, for any reason, held to be unconstitutional or invalid, such decision shall not affect the remaining portions of this Ordinance and they shall remain in full force and effect, and to this end the provisions of this ordinance are hereby declared severable.
  1. This ordinance shall take effect immediately upon final passage and publication according to law.

Ordinance #1844, was introduced and passed on first reading by the Township Committee of the Township of Bernards in the County of Somerset on 1/10/06 and then ordered to be published according to law/ It will be further considered for final passage and adoption at a public hearing held at a meeting of the Township Committee at the Municipal Building, 1 Collyer Lane, Basking Ridge, NJ in said township on 1/24/06, at 7:30 P.M., when and where, or at such time and place to which said meeting may be adjourned, all persons interested will be given an opportunity to be heard concerning said ordinance. Notice is hereby given that the Township of Bernards, Ordinance #1844 was introduced and passed on first reading at a meeting of the Township Committee, on 1/10/06 and was passed on final reading and adopted following a public hearing thereon at a regular meeting of the Governing Body of the Township of Bernards on 1/24/06.
