1ABOUT THIS APPENDIX

(a)This appendix sets out the terms of the Optus Fusion, Optus ‘yes’ Fusion, Optus ‘yes’ Fusion Liteand Optus ‘yes’ Fusion Plus Offers.

(b)The meaning of the words printed like this is set out in this appendix,at the end of the service descriptionfor the relevant service or in the consumer terms.

(c)This appendix is to be read in conjunction with the service description for each relevant service and the consumer terms.

(d)The Optus Fusion Offer, Optus ‘yes’ Fusion Offer (the Optus Fixed ‘yes’ Fusion Offer), Optus ‘yes’ Fusion Lite and the Optus Wireless ‘yes’ Fusion Offer and Optus ‘yes’ Fusion Plus Offer are collectively referred to in this Appendix, unless the context requires otherwise, as the Optus Fusion Offers.

2What AREthe Optus FusionOFFERS?

(a)The Optus FusionOffersaremade up of the following offers:

(i)The Optus Fusion Offer and the Optus ‘yes’ Fusion Offer, together the Optus Fixed ‘yes’ Fusion Offer;

(ii)The Optus ‘yes’ Fusion Lite Offer;

(iii)The Optus Wireless ‘yes’ Fusion Offer;

(iv)The Optus ‘yes’ Fusion Plus Offer;

(v)The Optus Family Value Pack Offer; and

(vi)The Optus Family Mobile Broadband Offer

which are specialsoffered under the consumer termsand relevant service descriptions.

(b)The Optus FusionOffers are governed by the terms in this appendix and, to the extent that the terms are not inconsistent with the terms set out in this appendix,by the terms of the consumer terms, and each relevant service description and standard pricing table.

3What do THE Optus FusionOFFERSallow you to do?

(a)The OptusFixed ‘yes’ FusionOffers, including Optus ‘yes’ Fusion Liteallow you to combine:

(i)Your Optus Broadband Service; being either:

(A)The Optus Cable Service; or

(B)The Optus DSL Direct Service

with

(ii)Your ‘Home PhoneService’ being either:

(A)The Optus Local Service and Optus Long Distance Service (if combined with the Optus Cable Service); or

(B)The Optus Local Direct Service and Optus Long Distance Service (if combined with the Optus DSL Direct Service);

and in return for paying a fixed monthly charge you receive included value for the services in the bundle.

(b)The Optus Wireless ‘yes’ Fusion Offer allows you to combine your Optus Wireless Services being your Optus Wireless Broadband Service with your Optus Wireless Telephony Service and Optus Long Distance Service, and in return for paying a fixed monthly charge you receive included value for the services in the bundle.

(i)If you connected between 31 March 2008 and 26 January 2009, the following pricing plans are offered under the Optus Wireless ‘yes’ Fusion Offer:

(A)The Optus Wireless ’yes’ Fusion $79 Plan with 2GB data allowance and other benefits offered for a $79 monthly charge;

(B)The Optus Wireless ‘yes’ fusion $89 Plan with 7GB data allowance and other benefits offered for a $89 monthly charge; and

Charges for the Optus Wireless yes’ Fusion $79 2GB and the Optus ‘yes’ Fusion $89 7GB pricing plans are set out in clause 6 and Table 8 below.

(ii)If you connectedbetween 27 January 2009 and 4 June 2009, the following pricing plans are offered under the Optus Wireless ‘yes’ Fusion Offer:

(A)The Optus Wireless ’yes’ Fusion $89 Plan with 2GB data allowance and other benefits offered for a $89 monthly charge;

(B)The Optus Wireless ‘yes’ Fusion $129 Plan with 7GB data allowance and other benefits offered for a $129 monthly charge; and

Charges for the Optus Wireless ‘yes’ Fusion $89 2GB and the Optus Wireless ‘yes’ Fusion $129 7GB pricing plans are set out in clause 6 and Table 9 below.

(iii)If you connect between 5 June 2009 and 30 September 2012, the following pricing plans are offered under the Optus Wireless ‘yes’ Fusion Offer:

(A)The Optus Wireless ‘yes’ Fusion $79 Plan with 2GB data allowance and other benefits offered for a $79 monthly charge;

(B)The Optus Wireless ‘yes’ Fusion $99 Plan with 7GB data allowance and other benefits offered for a $99 monthly charge;

Charges for the Optus Wireless ‘yes’ Fusion $79 2GB and the Optus Wireless ‘yes’ Fusion $99 7GB pricing plans are set out in clause 6 and Table 10 below.

(c)Optus Fixed ‘yes’ Fusion Offer:

(i)If you connected prior to 2 December 2007, the following threepricing plans are offered under the Optus FusionOffer:

(A)The Optus Fusion $69 Plan with 2GB data allowance and other benefits offered for a $69 monthly charge;

(B)The Optus Fusion $89 Plan with 7GB data allowance and other benefits offered for a $89 monthly charge; and

(C)The Optus Fusion $99 Plan with 20GB data allowance and other benefits offered for a $99 monthly charge.

Charges for the Optus Fusion $69, the Optus Fusion $89 and the Optus Fusion$99 pricing plansare set out in clause 6 and Table 1 below.

(ii)If you connectedbetween3 December 2007 and 6 September 2008, the following three pricing plans are offered under the Optus ‘yes’ Fusion Offer:

(A)The Optus ’yes’ Fusion $79 Plan with 2GB data allowance and other benefits offered for a $79 monthly charge;

(B)The Optus ‘yes’ fusion $89 Plan with 7GB data allowance and other benefits offered for a $89 monthly charge; and

(C)The Optus ‘yes’ Fusion $99 Plan with 20GB data allowance and other benefits offered for a $99 monthly charge.

Charges for the Optus ‘yes’ Fusion $79, the Optus ‘yes’ Fusion $89 and the Optus ‘yes’ Fusion $99 pricing plans are set out in clause 6 and Table 2 below.

(iii)If you connect between7 September 2008and19 September2009, the following pricing plans are offered under the Optus ‘yes’ Fusion Offer:

(A)The Optus ’yes’ Fusion $79 Plan with 4GB data allowance and other benefits offered for a $79 monthly charge;

(B)The Optus ‘yes’ fusion $89 Plan with 10GB data allowance and other benefits offered for a $89 monthly charge; and

(C)The Optus ‘yes’ Fusion $99 Plan with 20GB data allowance, unlimited calls to any Australian GSM mobile and other benefits offered for a $99 monthly charge.

(D)The Optus ‘yes’ Fusion $129 Plan with unlimited data allowance unthrottled up to 30GB, once the data reaches 30GB the service will then be speed limited to 256kbps until the end of the customer’s billing month, unlimited calls to any Australian GSM mobile and other benefits offered for a $129 monthly charge.

Charges for the Optus ‘yes’ Fusion $79, the Optus ‘yes’ Fusion $89, the Optus ‘yes’ Fusion $99 and the Optus ‘yes’ Fusion $129 pricing plans are set out in clause 6 and Table 3 below.

(iv)If you connect between20 September 2009 and 24 April 2010, the following pricing plans are offered under the Optus ‘yes’ Fusion Offer:

(A)The Optus ’yes’ Fusion $79 Plan with 4GB data allowance and other benefits offered for a $79 monthly charge;

(B)The Optus ‘yes’ Fusion $89 Plan with 10GB data allowance and other benefits offered for a $89 monthly charge;

(C)The Optus ‘yes’ Fusion $99 Plan with 20GB data allowance, unlimited calls to any Optus GSM mobile and other benefits offered for a $99 monthly charge;

(D)The Optus ‘yes’ Fusion $109 Plan with 20GB data allowance, unlimited calls to any Australian GSM mobile and other benefits offered for a $109 monthly charge; and

(E)The Optus ‘yes’ Fusion $129 Plan with unlimited data allowance unthrottled up to 30GB (once your data usage reaches 30GB during your billing month your service will be speed limited to 256kbps until the end of your billing month), unlimited calls to any Australian GSM mobile and other benefits offered for a $129 monthly charge.

(d)If you connect between 1 November 2009 and 24 April 2010, the following pricing plan is offered under the Optus ‘yes’ Fusion Offer to new and existing residential customers only:

(A)The Optus ‘yes’ Fusion $149 Plan with unlimited data allowance unthrottled up to 30GB (once your data usage reaches 30GB during your billing month your service will be speed limited to 256kbps until the end of your billing month), unlimited calls to any Australian GSM mobile and a ‘PlayStation3 pack’, as well as other benefits offered for a $149 monthly charge.

(B)“PlayStation3 pack” contains a PlayStation 3 console, 2 HD BluRay Movie Discs, Singstar PS3 game with 2 wired microphones and a BluetoothTM keyboard (BluetoothTM keyboard available until 14 January 2010). The BluetoothTM keyboard may be delivered separately and delivery may take up to 30 days from activation.

Charges for the Optus ‘yes’ Fusion $149 pricing plans are set out in clause 6 and Table 4 below.

(e)If you connected between 25 April 2010 and 27November 2010, the following pricing planswereoffered under the Optus ‘yes’ Fusion Offer:

(A)The Optus ’yes’ Fusion $79 Plan with 7GB data allowance, unlimited standard local and national calls, unlimited calls to Optus GSM Mobiles and other benefits offered for a $79 monthly charge;

(B)The Optus ‘yes’ Fusion $89 Plan with 12GB data allowance, unlimited standard local and national calls, unlimited calls to Optus GSM Mobiles, and other benefits offered for a $89 monthly charge;

(C)The Optus ‘yes’ Fusion $99 Plan with unlimited data allowance unthrottled up to 15GB (once your data usage reaches 15GB during your billing month your service will be speed limited to 256kbps until the end of your billing month), unlimited standard local and national calls, unlimited calls to Optus GSM Mobiles and other benefits offered for a $99 monthly charge;

(D)The Optus ‘yes’ Fusion $109 Plan with unlimited data allowance unthrottled up to 30GB (once your data usage reaches 30GB during your billing month your service will be speed limited to 256kbps until the end of your billing month), unlimited standard local and national calls, unlimited calls to Optus GSM Mobilesand other benefits offered for a $109 monthly charge; and

(E)The Optus ‘yes’ Fusion $129 Plan with unlimited data allowance unthrottled up to 50GB (once your data usage reaches 50GB during your billing month your service will be speed limited to 256kbps until the end of your billing month), unlimited standard local and national calls, and unlimited calls to any Australian GSM mobile (excluding Pivotel) and other benefits offered for a $129 monthly charge.

Charges for the Optus ‘yes’ Fusion $79, the Optus ‘yes’ Fusion $89, the Optus ‘yes’ Fusion $99 , the Optus ‘yes’ Fusion $109, and Optus ‘yes’ Fusion $129 pricing plans are set out in clause 6 and Table 5 below.

(f)If you connected between28November 2010 and December 11 2010, the following pricing planswere offered under the Optus ‘yes’ Fusion Offer:

(A)The Optus ‘yes’ Fusion $99 Plan with data allowance up to 500GB (once your data usage reaches 500GB during your billing month your service will be speed limited to 256kbps until the end of your billing month), unlimited standard local and national calls, unlimited standard calls to Optus GSM Mobiles and other benefits offered for a $99 monthly charge;

(B)The Optus ‘yes’ Fusion $109 Plan with data allowance up to 500GB (once your data usage reaches 500GB during your billing month your service will be speed limited to 256kbps until the end of your billing month), unlimited standard local and national calls, unlimited standard calls to Optus GSM Mobilesand other benefits offered for a $109 monthly charge; and

(C)The Optus ‘yes’ Fusion $129 Plan with data allowance up to 1000GB (once your data usage reaches 1000GB during your billing month your service will be speed limited to 256kbps until the end of your billing month), unlimited standard local and national calls, and unlimited standard calls to any Australian GSM mobile (excluding Pivotel) and other benefits offered for a $129 monthly charge.

Charges for the Optus ‘yes’ Fusion $99 , the Optus ‘yes’ Fusion $109, and Optus ‘yes’ Fusion $129 pricing plans are set out in clause 6 and Table 5 below.

(ii)If you connected between 12 December 2010 and 8 October 2012, the following pricing plansare offered under the Optus ‘yes’ Fusion Offer:

(A)The Optus ‘yes’ Fusion $79 Plan with data allowance up to 120GB (once your data usage reaches 120GB during your billing month your service will be speed limited to 256kbps until the end of your billing month), unlimited standard local and national calls, unlimited standard calls to Optus GSM Mobiles and other benefits offered for a $79 monthly charge;

(B)The Optus ‘yes’ Fusion $99 Plan with data allowance up to 500GB (once your data usage reaches 500GB during your billing month your service will be speed limited to 256kbps until the end of your billing month), unlimited standard local and national calls, unlimited standard calls to Optus GSM Mobiles and other benefits offered for a $99 monthly charge;

(C)The Optus ‘yes’ Fusion $109 Plan with data allowance up to 500GB (once your data usage reaches 500GB during your billing month your service will be speed limited to 256kbps until the end of your billing month), unlimited standard local and national calls, unlimited standard calls to Australian GSM mobiles (excluding Pivotel)and other benefits offered for a $109 monthly charge; and

(D)The Optus ‘yes’ Fusion $129 Plan with data allowance up to 1000GB (once your data usage reaches 1000GB during your billing month your service will be speed limited to 256kbps until the end of your billing month), unlimited standard local and national calls, and unlimited standard calls to Australian GSM mobiles (excluding Pivotel) and other benefits offered for a $129 monthly charge.
