AGREEMENT OF EMPLOYMENT

Made this (date) ______by and between CampExcel, LLC (therein called the Camp) of Toms River, New Jersey and ______(therein called the employee).

WHEREIN IT IS MUTUALLY AGREED AS FOLLOWS:

  1. The camp hires the Employee at its camp as a/an (position) ______and the employee accepts said employment for the season of 2012 beginning on or about June 19th and to end on or about August 16th. Employees will be hired only for the entire camp season. Including the compulsory training days and six weeks of the camp season. CampExcel requires that you be present for the entire 30 days of the camp season and training dates.
  2. The hourly rate of pay for the services to be rendered from the beginning of the season to the end of the season dates shown above is $ per hr. Employees will be paid every 2 weeks.
  3. Employee agrees to supervise and work with a group of campers as assigned, and to perform any and all duties to which he or she may assigned and further agrees to abide by all camp rules, regulations and policies, established by the camp. (It is hereby agreed that any and all rules and regulations of the Camp and any special clauses attached hereto are made part of this contract). Supervision of children IN the water when swimming is required of counselors at all times. Counselors not supervising children IN the water when the children are swimming are insubordinate which is cause for dismissal.
  4. The camp may dismiss the said employee should the employee’s physical condition, service, conduct, or influence be deemed unsatisfactory or inimical to the best interests of the Camp, or for other just cause, and in such case the employee will not be paid.
  5. If the employee is absent from Camp, the employee will not be paid. The Camp may dismiss said employee for excessive Absenteeism or Tardiness.
  6. Requests for excused absences, other than illness or death in the family, must be submitted in writing at least 1 week prior to the day requested.
  7. Excused absences are only determined by the director and at her discretion and will not be paid.
  8. Prearranged medical/dental appointments do not constitute excused absences. Staff members should schedule medical appointments at times that do not conflict with work hours.
  9. Illness is an excused absence. Should a staff member be so ill that it precludes them working at camp, they must call in by 7:00 am on the day that they are going to be absent.
  10. Absent staff members who are sick should be available throughout the day so that they can be reached in case of questions.
  11. Unexcused absences are grounds for immediate dismissal at the discretion of the camp director.
  12. The Camp will not be responsible for any injury suffered by employees unless in performance of camp duties and any such camp’s responsibilities are limited to only those benefits allowed employee from the Workmens Compensation Law of the State of New Jersey.
  13. When it is deemed necessary for the employee’s health, the Camp reserves the right to use medical, surgical or dental aid, in which case all such expenses shall be paid by the employees except where covered by the Workmens Compensation Law.
  14. The Employee understands and acknowledges that the camp enters into this Agreement based on the Camp’s current good faith estimate of its staffing needs for the coming season. If for any reason, and at any time, the Camp requires fewer staff members than it currently projects, the Camp may terminate this Agreement on notice to the Employee.
  15. The Camp may be prevented from conducting a camp season, or a full camp season, by an act of God or other occurrence beyond the control of the parties. If that should occur, the camp shall be excused from further performance under this Agreement on notice to the employee of the reason for nonperformance.
  16. The Camp is not responsible for employee’s equipment or personal belongings, when in transit or at Camp, if lost or damaged by fire, theft, etc.
  17. The employee warrants that he/she has not made any other employment agreement for the same period. Such warranties are material and conditions to this agreement. Any misrepresentation shall give the Camp the right to cancel this agreement.
  18. Employee may accept gratuities from parents or guardians of campers. However, employee may not solicit gratuities in any form from the parents or guardians of campers or campers themselves. Solicitation of a gratuity of any type is cause for dismissal.
  19. Employee agrees to provide references to CampExcel and gives permission to have those references verified.
  20. All medical forms, W-4 forms, contracts, copies of driver license and social security card (or acceptable substitute identification) must be returned, signed, to the office before camp begins. Fingerprinting and background check forms must be completed at least 4 weeks prior to the first date of training. Costs for fingerprinting will be paid by the employee. No paycheck will be issued without the aforementioned paperwork completed.
  21. Employee agrees to complete time sheets as required and understands that a paycheck will not be issued without an accurate time sheet completed. Employee understands that he/she will only be paid for assigned hours and that any additional hours must be approved by the Director.
  22. Bus/Van Counselors must be able to find transportation to the first stop on their route.
  23. A CDL Class C-Q, S and P endorsement If required-will be obtained no later than 60 days from the date of this contract or the contract will be null and void. Drivers must obtain their CDL Class C-Q, S and P endorsement License in order to obtain salary for driving.
  24. CampExcel reserves the right to terminate the employment of any staff member who pierces any part of their body other than their ears during the camp season. No staff member may wear jewelry in any pierced part of their body except their ears if piercing occurred prior to the camp season. All tattoos must be covered during Camp employment.
  25. The employee acknowledges he/she is employed by CampExcel and that the Camp maintains its own employee and client base, including campers and parental/guardian contacts which at all times remains the property of CampExcel. Therefore, the employee agrees not to solicit for employment any of CampExcel’s employees, or solicit the Camp’s clients (including campers, parents or other individuals associated with CampExcel) for participation in other similar camp service programs. This non-solicitation clause shall remain in effect for a period of five years from the date of this employee’s termination or separation from CampExcel.
  26. The employee acknowledges and understands that all information relative to his/her employment with Camp Excel (which includes but is not limited to, a client or camper’s personal information, information regarding business operations and staff, information regarding camp activities or program) is confidential and may not be shared with any person or entity outside of Camp Excel.
  27. The employee agrees not to compete with CampExcel by owning, operating or becoming employed with any competitor or other similar camp service program within a radius of 80 miles from CampExcel for a period of one year after termination from employment at CampExcel.
  28. It is hereby agreed that contents of this agreement are confidential and any breach of confidentiality will constitute just cause for termination of this agreement. Any disputes arising from employment or as a result of a breach of this Employment Contract shall be submitted to Arbitration for resolution in the jurisdiction of CampExcel.
  29. This contract contains the entire agreement between the parties, no modification thereof shall be valid unless in writing and signed by the parties hereto
