What is an encumbrance?
An‘encumbrance’isaformalobligationontheland,withthemostcommontypebeinga‘mortgage’.Other commonexamplesofencumbrancesinclude:
•RestrictiveCovenants:A‘restrictivecovenant’isawrittenagreement betweenownersof landrestrictingtheuseordevelopmentoftheland for the benefit of others, (eg. a limit of one dwelling or limits on types
ofbuildingmaterialstobeused).
•Section173Agreements:A‘section173agreement’isacontract betweenanownerof thelandandtheCouncilwhichsetsout limitationsontheuseordevelopmentoftheland.
•Easements:An‘easement’givesrightsto otherpartiesto usethe landorprovidefor servicesoraccesson,underorabovethesurface oftheland.
•Building Envelopes:A‘building envelope’defines the development boundariesfortheland.
Asidefrom mortgages,theaboveencumbrancescanpotentiallylimitor evenpreventcertaintypesof proposals.

A‘caveat’isarecordof aclaimfromapartyto aninterestintheland. Caveatsarenotnormallyrelevantto planningapplicationsasthey typicallyrelateto apurchaser, mortgageeorchargeeclaim,butcan sometimesincludeclaimsto acovenantoreasementontheland.These typesofcaveatsmayaffectyourproposal.
Other less common types of obligations may also be specified on title intheformof ‘notices’.Thesemayhaveaneffectonyourproposal, suchasanoticethat thebuildingonthelandislistedontheHeritage Register.
Whathappensiftheproposalcontravenesanencumbranceontitle?
Encumbrancesmayaffectorlimityourproposalorpreventit from proceeding.Section61(4)ofthe PlanningandEnvironmentAct 1987forexample,preventsaCouncilfrom grantingapermitif it wouldresultina breachof aregisteredrestrictivecovenant.If theproposalcontravenes anyencumbrance,contact theCouncilfor adviceonhowtoproceed.
Youmaybeableto modifyyourproposalto respondtotheissue.Ifnot,separateproceduresexistto changeorremovethevarioustypes ofencumbrancesfromthetitle.Theproceduresaregenerallyquite involvedandif theencumbrancerelatesto morethanthesubject property,theprocesswillincludenoticeto theaffected party.
You should seek advice from an appropriately qualified person, suchasasolicitor,if youneedtointerprettheeffect ofanencumbranceorif youseekto amendorremoveanencumbrance.
Why is title information required?
Title information confirms the location and dimensions of the land specified in the planning application and any obligations affecting what canbedoneonorwiththeland.
Aswellasdescribingtheland,afullcopyof thetitlewillincludea diagramorplanof thelandandwillidentifyanyencumbrances,caveats andnotices.
What is a ‘full’copy of the title?
Thetitleinformationaccompanyingyourapplicationmustincludea ‘registersearchstatement’andthetitlediagram,whichtogethermakeup thetitle. Inaddition,anyrelevantassociatedtitledocuments,knownas ‘instruments’,mustalsobeprovidedtomakeupafullcopyofthetitle.

Thedeclarationshouldbesignedbythepersonwhotakesresponsibility fortheaccuracyof alltheinformationthat isprovided.Thisdeclarationis asignedstatement thattheinformationincludedwiththeapplicationis trueandcorrectat thetimeof lodgement.
Thedeclarationcanbesignedbytheapplicantorowner.If theowneris nottheapplicant,theownermusteithersigntheapplicationformormustbe notified of the application which is acknowledged in the declaration.
Obtainingorattemptingto obtainapermitbywilfullymakingor causinganyfalserepresentationordeclaration,eitherorallyorinwriting, isanoffenceunderthe PlanningandEnvironmentAct 1987andcould result in a fine and/or cancellation of the permit.

Inorderto avoidanyconfusion,theCouncilwillcommunicateonly withthepersonwhoisalsoresponsiblefor providingfurtherdetails. Thecontact maybeaprofessionaladviser(e.g. architectorplanner) engagedto prepareormanagetheapplication.Toensureprompt communications,contact detailsshouldbegiven.
CheckwithCouncilhowtheypreferto communicatewithyouaboutthe application.If anemailaddressisprovidedthismaybethepreferred methodof communicationbetweenCouncilandtheapplicant/contact.
Theownerof thelandisthepersonororganisationwhoownsthelandatthetimetheapplicationismade.Whereaparceloflandhasbeensold andanapplicationmadepriorto settlement, theowner’s detailsshould be identified as those of the vendor.The owner can, but need not, be the contact ortheapplicant.
