The Work Session Meeting of the Governing Body of the Borough of Bloomingdale was held on the above date in the Council Chambers of the Municipal Building, 101 Hamburg Turnpike, Bloomingdale, NJ. Mayor Dunleavy called the meeting to order at 7:03 p.m.

PUBLIC NOTICE STATEMENT
Mayor Dunleavy stated that adequate notice of this meeting was posted in the Bloomingdale Municipal Building and provided to The Suburban Trends; The North Jersey Herald & News; and all other local news media on January 4, 2014.
EARLY PUBLIC COMMENT
Councilman D’Amato opened the meeting to Early Public Comment; seconded by Councilman Sondermeyer and carried on voice vote.
Since there was no one who wished to speak under Early Public Comment, Councilman D’Amato moved that it be closed; seconded by Councilman Sondermeyer and carried on voice vote.
REPORTS OF PROFESSIONALS, DEPARTMENT HEADS, COMMITTEES, LIAISON AND MAYOR’S REPORT
Municipal Clerk
Municipal Clerk stated that the Candlelight Walk will be held on September 11, 2014; lineup in Butler Park at 7 p.m. and proceed to Bloomingdale Sloan Park at 7:15 p.m.
Robert Kochka 5K Run
Councilman D’Amato noted that the memorial run for Robert Kochka will be held on Pride Day; information is on the website.
Pride Day
Mayor noted that Pride Day is September 27 from 12 to 5 at DeLazier Field; if anyone would like to be a vendor, please contact Mayor Dunleavy.
Office of Emergency Management
Councilwoman Hudson stated ta the Office of Emergency Management has received a donation of a used vehicle from a foundation out of Long Island, the Terry Farrell Foundation who passed away in 9-11.
Master Gardeners
Mayor noted that the master Gardeners will have a concert on September 20, 2014; information is on the website.
Mayor’s Report
Rafkind Road
This project is almost completed; there are a few punch list items to be done. After the Engineer prepares his report, an Assessment Committee will be form to get ready for assessing the homeowners involved; there will be hearings on the assessment before it is adopted.
Ballston Street
Mayor noted that the culvert and sidewalk repairs on Ballston is done.
Waterline replacement
Mayor stated that Caro Corporation will begin construction on the five roads for waterline replacement.
Bond Ordinance
We will be doing a bond ordinance for the Walter T. Bergen track as well as Star Lake Road improvement next meeting. In regard to the bathroom project at the Walter T. Bergen School it is moving slower than expected and Mayor anticipates it being done middle of the month.
Environmental Commission
Mayor noted that there are two resolutions on this evening that the Environmental Commission would like Mayor and Council to support.
Mayor noted that he toured Dragon Field Meadows Park and it is a beautiful site; the Bloomingdale Environment al Commission hopefully will be making some improveme4nts thee; this was the former Decker tract.

Councilman Yazdi moved that the following Consent Agenda be approved:

Councilwoman Hudson seconded the motion and it carried on voice vote.
PENDING BUSINESS
Second and final reading and public hearing of Ordinance No. 14-2014: Amending Chapter VII, Speed Limits
AN ORDINANCE OF THE BOROUGH OF BLOOMINGDALE, IN THE COUNTY OF PASSAIC AND STATE OF NEW JERSEY, AMENDING chapter VII, “Traffic”, of the code of the borough of Bloomingdale by amending sectin 7-26 “Speed Limits” WAS GIVEN SECOND AND FINAL READING AND CONSIDERATIN FOR ADOPTION AT THIS TIME.
Councilman Dellaripa moved that the ordinance be read by title; seconded by Councilman Costa and carried on voice vote.
The Municipal Clerk read the ordinance by title:
ORDINANCE No. 14-2014
OF THE GOVERNING BODY
OF THE BOROUGH OF BLOOMINGDALE
AN ORDINANCE OF THE BOROUGH OF BLOOMINGDALE, IN THE COUNTY OF PASSAIC AND STATE OF NEW JERSEY, AMENDING chapter VII, “traffic,” of the code of the borough of bloomingdale by amending section 7-26, “speed limits”
WHEREAS, Glen Wild Lake Association sought Title 39 enforcement for all roads within their community; and
WHEREAS, the Borough of Bloomingdale Police Department reviewed Glen Wild Lake Association’s request for Title 39 enforcement; and
WHEREAS, the Borough Engineer, along with the Borough Police performed an inspection of the roads at Glen Wild Lake and approved the roads for Title 39 enforcement; and
WHEREAS, the Chief of Police, upon consultation with the Borough Attorney, recommends such reduction of speed.
WHEREAS, the Chief of Police became aware of inconsistencies between the speed limit noted in the ordinance and the speed limit designated on the signs on certain roadways; and
WHEREAS, the Chief of Police investigated the inconsistencies and determined that the rates of speed noted on the signs were the correct rates; and
WHEREAS, the Chief of Police, upon consultation with the Borough Attorney, recommends correction of the ordinance to reflect the correct speed limit.
NOW THEREFORE, BE IT ORDAINED by the Mayor and Borough Council of the Borough of Bloomingdale, in the County of Passaic and State of New Jersey, as follows:
section 1. ChapterVII, “Traffic,” Part 1, “On-Street Traffic Regulations,” Section 7-26, “Speed Limits,” of the Code of the Borough of Bloomingdale is hereby amended to read as follows:
7-26 SPEED LIMITS.
Speed limits along designated streets shall be as designated below:

Paterson-Hamburg Turnpike (also known as All County Road 23, County Road 511 Alt. from Union Avenue to easterly Bloomingdale Borough line; and signed as Main Street to the easterly Bloomingdale Borough line) / a. Both / Thirty (30) miles per hour from the westerly Bloomingdale Borough line (Pequannock River) to the center of Glenwild Avenue (also known as County Road 147 and Carmentown Road)
b. Both / Twenty-five (25) miles per hour from the center of Glenwild Avenue (also known as County Road 147 and Carmentown Road) to the center of Union Avenue (also known as County Road 148 and County Road 511)

SECTION 2.All ordinances or parts of ordinances of the Borough of Bloomingdale inconsistent herewith are repealed to the extent of such inconsistency.
SECTION 3.If any section, subsection, clause or phrase of this ordinance is for any reason held to be unconstitutional or invalid by any court or competent jurisdiction, such decision shall not affect the remaining portion of this ordinance.
SECTION 4.This law shall take effect immediately upon final passage, approval and publication as required by law.
Councilman Hudson moved that the meeting be open to Public Hearing; seconded by Councilman Yazdi and carried on voice vote.
Since there was no one who wished to speak under the Public Hearing, CouncilmanYazdi moved that it be closed; seconded by Councilman Costa and carried on voice vote.
Councilman Yazdi moved for the adoption of this ordinance; seconded by Councilman Sondermeyer and carried as per the following roll call: Council Members: Cost a; D’Amato; Dellaripa; Hudson; Sondermeyer and Yazdi all YES.
INTRODUCTION OF NEW BUSINESS
Adoption of Resolution No. 2014-9.1: Submission of NJDOT application for Municipal Aid
Councilman Yazdi offered the following Resolution and moved for its adoption:
RESOLUTION 2014-9.1
APPROVAL TO SUBMIT A GRANT APPLICATION AND EXECUTE A GRANT AGREEMENT WITH THE NEW JERSEY DEPARTMENT OF TRANSPORTATION FOR THE REEVE AVENUE IMPROVEMENTS
WHEREAS, the Bloomingdale Mayor and Council desire to construct improvements to Reeve Avenue, including pavement resurfacing, sidewalk replacement, concrete curbs replacement, guide rail upgrades, traffic signs, traffic striping and storm drainage repairs; and,
WHEREAS, the Bloomingdale Mayor and Council desire to request aid from the State of New Jersey in the amount of $250,000.00.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the Bloomingdale Borough, formally approves the grant application for the above stated project.
BE IT FURTHER RESOLVED that the Mayor and Clerk are hereby authorized to submit an electronic grant application identified as MA-2015-Bloomingdale Borough-00094 to the New Jersey Department of Transportation on behalf of Bloomingdale Borough.
BE IT FURTHER RESOLVED that the Mayor and Clerk are hereby authorized to sign the grant agreement on behalf of Bloomingdale Borough and that their signature constitutes acceptance of the terms and conditions of the grant agreement and approves the execution of the grant agreement.
Councilman Costa seconded the motion and it carried as per the following roll call: CouncilMembers D’Amato; Dellaripa; Hudson; Sondermeyer; Yazdi and Costa all YES.
Resignation of Richard A. Murek as a Member of the Planning Board
Councilman Yazdi moved to accept the resignation of Richard Murek, with regret, as a member of the Planning Board; seconded by Councilman D’Amato and carried on voice vote. We are seeking a replacement for his seat.
Adoption of Resolution NO. 2014-9.2: Change of title for Shirley Rumore as Violations Clerk
Councilman Yazdi offered the following resolution and movedfor its adoption:

Part Time Deputy Court Administrator
WHEREAS, Shirley Rumore was hired on May 27, 2008 as a Part Time Deputy Court Administrator effective June 1, 2008;
WHEREAS, there is a need to change her title to a Violations Clerk for the Municipal Court;
NOW, THEREFORE, BE IT RESOLVED, that Shirley Rumore’s title be change from Part-time Deputy Court Administrator to part time Violations Clerk at a salary of $19.22/hr.
Councilwoman Hudson seconded the motion and it carried on voice vote with all members voting YES.
Adoption of Resolution No. 2014-9.3: Hiring of part time per diem Deputy Court Administrator as needed
Councilman Yazdi offered the following Resolution and moved for its adoption:

Be it resolved that authorization be given to hire a part-time Deputy Court Administrator when needed on a per diem basis at $25/hour.

Adoption of Resolution No. 2014-9.4: Opposing A1775: Forest Steward Ship Bill
Councilman Costa offered the following resolution and moved for its adoption:

Opposing A1775 – Forest Steward Ship
WHEREAS, A-1775 the Forest Stewardship Bill promotes commercial logging which is not forest stewardship; and
WHEREAS, Forest Stewardship Council (FSC) standards are voluntary and bear no force of law; and
WHEREAS, both the Governor and the DEP rejected the Forest Stewardship Council certification; and
WHEREAS, FSC standards and current DEP forestry management programs are not subject to regulations under various important NJ environmental laws that protect wetlands, water quality, soil erosion, steep slopes, flood hazards and the Highlands Act; and
WHEREAS, revenues generates from logging operations would be allocated back to the DEP forest program….thus the more logging that takes place, the more money is generated to support DEP staffing; and
WHEREAS, the bill fails to address urban forestry gals such as encouraging afforestation of vacant and underutilized agricultural lands to increase New Jersey forest cover;
NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council urge our New Jersey State Officials to oppose this bill
Councilman D’Amato seconded the motion and it carried on voice vote with all Council Members voting YES.
Adoption of Resolution No. 2014-9.5: Prescribed Burn Bill
Councilman Costa offered the following resolution and moved for its adoption:

Opposing A1275 – Prescribed Burn Bill
WHEREAS, A-1275 authorizes prescribed burning in certain circumstances; and
WHEREAS, this bill reduces liability standards for those conducting burns. If your house was burned down or property damaged, you probably would not be able to sue to be compensated; and
WHEREAS, this bill allows Fire marshals to conduct burns on private property without the landowners consent; and
WHEREAS, this bill exempts prescribed burns from the State Air Pollution Control Act thus allowing unrestricted adverse consequences on air quality and public health; and
WHEREAS, this bill would apply statewide, including North Jersey hardwood forests adjacent to densely populated areas where significant public health, air quality, nuisance and land use conflicts exist;
NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council urge our New Jersey State Officials to oppose this bill

Adoption of Resolution No. 2014-9.6: Custodian of Petty Cash/Library
Councilman Sondermeyer offered the following resolution and moved for its adoption:

TO CHANGE CUSTODIAN OF PETTY CASH FUND FOR
BLOOMINGDALE FREE PUBLIC LIBRARY
WHEREAS, T. Rubin was custodian of the Bloomingdale Free Public Library Petty Cash Fund, and
WHEREAS, in accordance with N.J.S.A. 40:5-21, the Library Board of Trustees of the Borough of Bloomingdale is changing custodian to Patricia Adam Perugino; and
WHEREAS, Patricia Adam Perugino is bonded in the amount of $25,000 by virtue of a surety bond.
NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the Borough of Bloomingdale, County of Passaic hereby authorizes such action and two copies of this resolution be filed with the Division of Local Government Services, New Jersey Department of Community Affairs for approval

Adoption of Resolution No. 2014-9.8: Hiring of Kaitlin Kopshaw and Emily Dunleavy for Covering Shelter and ACO coverage
Councilman Cost offered the following Resolution and moved for its adoption:

WHEREAS, based on these interviews, it was determined that the following was the successful candidate:

- Kaitlin Kopshaw
NOW BE IT RESOLVED, that the candidate listed above be hired on a per-diem basis help for the Animal Shelter and Animal Shelter Coverage

Adoption of Resolution No. 2014-9.9: Chapter 159 Body Armor

Authorizing the Insertion into the FY2013 Municipal Budget Pursuant to N.J.S.A. 40A:4-87
(Chapter 159, P.L. 1948) of a Special Item of Revenue in the Form of a State of New Jersey BodyArmor Grant
WHEREAS, the Governing Body (“Governing Body”) of the Borough of Bloomingdale
(“Borough”) finds and declares that N.J.S.A. 40A:4-87 provides that the Director of the Division of Local Government Services (“Director”), within the State of New Jersey Department of Community Affairs, may approve the insertion of any special item of revenue in the budget of any county or municipality; and
WHEREAS, the Governing Body further finds and declares that N.J.S.A. 40A:4-87 provides that the Director may also approve the insertion of any item of appropriation for an equal amount; and
WHEREAS, the Governing Body further finds and declares that it is in the best interests of the citizens of the Borough to request approval of the insertion into the Borough’s FY2014 Municipal Budget of an item of revenue based upon a grant secured by the Borough from the State of New Jersey;
