Occupational Therapists and the Law
Date: April 30th and May 1st, 2014
Venue: St. Mary’s Hospital, Phoenix Park. Dublin
This two day workshop focuses on medicolegal issues relevant to OT managers. It has been funded by the HSE and organised by AOTI. La Touche Training will deliver this workshop.
Aims of the Training:
· To enhance OT managers knowledge and skills with regard to medicolegal issues associated with clinical practice.
· To ensure that OT managers understand their responsibilities and are aware of how they can be held accountable.
· To improve communication and recording standards amongst Occupational Therapy managers
Program
Day 1
· Accountability- How OTs can be held responsible for their actions or any inactions on their part. Professional Regulation is covered in this section
· Recent cases and their consequences - Halappanaver Inquest, Corbally V The Medical Council
· Negligence and Duty of Care –What do Negligence and Duty of Care mean? How is this relevant for OTs?
· Record Keeping/Information Governance –The importance of record keeping, the common pitfalls, guidelines on record keeping, HIQA and HSE guidance on recording, confidentiality, Freedom of Information and Data Protection.
· Consent and Capacity –The current legal position, The National Consent Policy 2013, The Assisted Decision-Making Capacity Bill 2013
Day 2
· Consent and Capacitycontinued
· Best Practice in Recording and Report Writing –how to write an excellent report relying on your records, how to deal with requests for reports, obligations around providing court reports, sample report template, feedback on current practices
· Overview of witness preparation and giving evidence –the Irish Legal System, subpoenas, how to properly prepare to give evidence, how to give clear testimony in the witness box, questioning techniques used in cross examination
Who can Apply?
· OT Managers who are available to attend the full two days
· Members and non members of AOTI are welcome to apply.
· OT Managers can apply regardless of work location. HSE managers will be given priority.

· Places are limited.
· Late or incomplete applications may not be accepted.
· Successful applicants will be notified that they have a place at the workshop. If a very large number of applications are received unsuccessful applicants may not be notified. If this occurs an update will be placed on the AOTI website as a news item to advise that the applications have been processed and successful applicants informed.
· Suitable applicants who are not allocated a place will automatically be placed on a waiting list and contacted if vacancies arise.
· If you are offered a place at the workshop you will be asked to send in a non refundable fee of €20 to the AOTI office to secure your place at the workshop. Please do NOT send this in until you have been offered a place.
· We may contact participants who attended the workshop to invite them to prepare a small reflection on the workshop for the AOTI newsletter.
