AN ORDINANCE TO REGULATE SEWAGE DISPOSAL SYSTEMS IN AREAS OF CONCERN, REPEALING ORDINANCE 32 AND AMENDING ORDINANCE #21 OF THE CITY OF SWAN VALLEY, IDAHO

WHEREAS, the City of Swan Valley the need for increase prevention of pollution to the ground water with in the city limits.

NOW THEREFORE, the City of Swan valley ordains as follows:

SECTION 1: PURPOSE

In order to protect the health and welfare of the City of Swan Valley and prevent the ground water in Swan Valley from becoming polluted, all new sewage treatment systems, must be a complex alternative system, providing increased treatment over a standard system as found in Idaho “Rules for Individual and Subsurface Sewage Disposal Systems”. This rule applies in an “Area of Concern.”

SECTION 2: DEFINITIONS (applies to this ordinance)

a)Normal High Groundwater:The normal high groundwater level is the highest elevation of groundwater that is maintained or exceeded for a continuous period of six (6) weeks a year.

b)Area of Concern. Defined as areas based on ground water elevations at ten feet, or less, from the ground surface, soil types, slopes, flood areas, wet lands, and proximity to permanent streams or ponds.

c)Complex Alternative System. Complex Alternative System:Defined as any system listed in IDAPA 58.01.03.006.01.b. Individual/Subsurface Sewage Disposal Rules.

d)Standard System:A standard, or basic alternative system, is any system not listed under IDAPA 58.01.03.006.01.b. Individual/Subsurface Sewage Disposal Rules.

e)Pollution. Any chemical, biological, or physical substance whether it be solid, liquid, gas, or a quality thereof, which if released into the environment can, by itself or in combination with other substances, create a public nuisance or render that environment harmful, detrimental, or injurious to public health, safety or welfare or to domestic, commercial, industrial, agricultural, recreational, aesthetic, or other beneficial uses.

SECTION 3: PERMITS

Sewer permits must be obtained from District Seven Health Department after receiving preliminary approval from the City of Swan Valley. The City of Swan Valley preliminary approval will be at a cost of $25.00 for record processing and tracking of proposed system for individuals that are installing a septic system without applying for a building permit.

SECTION 4: INSTALLATION

Installation shall comply with all State Board of Health rules and regulations and inspections will be conducted by District 7 Health Department.

SECTION 5: PENALTIES

Any person, firm or corporation violating any of the provisions of this ordinance, or failing to comply therewith, shall upon conviction in municipal court, be subject to a fine not to exceed $300, and each day of each provision being violated shall constitute a separate violation.
