Notes: (1) Principal cases and their following notes are assigned only when listed above (assigned cases are italicized). (2) Each case/problem debate is at the initial trial level (i.e, do not use a higher court result as a reason for your argument in the trial court). (3) I occasionally assign only a case’s following notes; e.g., Day 1, n.2-3 to unassigned Schmier case. (4) * = rugged facts—focus on issue presented, not the facts. (5) Oral grade (one of three course grades) = 10 points, which will be based on your moot court presentations. Each person will have maybe a half-dozen. (6) There will be a grade deduction for each “unprepared.” Get a buddy. As in practice, there are no ex parte communications with the court after assignments are made. (7) You will have a 10-point practical (takehome) midterm, e.g., drafting a demurrer, based on last semester’s final exam & an example provided in the online course (webpage) supplement. (8) Prior exams: I will provide these once I know the class membership. DO NOT give this information to anyone else, b/c profs at other schools use these old exams. (9) Weekly Q & A: Lady Luck will call on various class members, to review the previous week’s materials. This will help with your long-term memory, as well as provide a review of key course concepts. (10) Most of these matters are addressed in the TJSL Cal Civ Pro Course Description you read (i.e., had access to) prior to the start of classes in my welcoming e-mail message. (11) See class weeks 6.1 & 14.2→ no classes those days; one Saturday depo demo class will be scheduled instead.
