REPORT OF THE SPECIAL COMMITTEE REGARDING THE NAZARIA-I-PAKISTAN FOUNDATION (REPEAL) BILL 2008 (BILL NO. 3 OF 2008)

The Nazaria-i-Pakistan Foundation (Repeal) Bill 2008 (Bill No. 3 of 2008) (Annexed) was referred to the Special Committee on 6 June, 2008. The Committee considered the bill in its meeting held on 2 July, 2008.

3.Mr Orya Maqbool Jan, Secretary, Information, Culture and Youth Affairs Department and Mr Mohsin Abbas Syed, Director, Law and Parliamentary Affairs Department represented their Departments. Mr Maqsood Ahmad Malik, Secretary, Provincial Assembly of the Punjab functioned as ex-officio Secretary to the Committee.

4.After detailed discussion on the aims and objects of the bill, the Committee, unanimously, decided to recommend that the bill as introduced, may be passed by the Assembly.

THE NAZARIA-I-PAKISTAN FOUNDATION (REPEAL) BILL 2008

to repeal the Nazaria-i-Pakistan Foundation Act, 1997 (XII of 1997).

Whereas it is expedient to repeal the Nazaria-i-Pakistan Foundation Act, 1997 (XII of 1997) for the purposes hereinafter appearing;

It is hereby enacted as follows:-

1.Short title and commencement.– (1) This Act may be cited as the Nazaria-i-Pakistan Foundation (Repeal) Act 2008.

(2)It shall come into force at once.

2.Repeal, revival and succession.– (1) The Nazaria-i-Pakistan Foundation Act, 1997 (XII of 1997) is hereby repealed.

(2)Notwithstanding the repeal of the Act XII of 1997 –

“(a) the Nazaria-i-Pakistan Trust, registered under the Societies Registration Act 1860 (XXI of 1860) which stood dissolved under section 13 of the Act, shall stand revived;

(b)the Nazaria-i-Pakistan Trust shall be governed under the provisions of the Societies Registration Act, 1860 (XXI of 1860);

(c)all rights, properties, assets or liabilities of the Nazaria-i-Pakistan Foundation shall stand transferred to the Nazaria-i-Pakistan Trust as its rights, properties, assets or liabilities; and

(d)an action taken, thing done, right acquired, liability imposed or any proceedings initiated under the Act shall not be affected.”

3.Repeal.– The Nazaria-i-Pakistan Foundation (Repeal) Ordinance 2008 (VI of 2008) is hereby repealed.
