DIESEL EMISSIONREDUCTIONACT

Pursuantto N.Y.EnvironmentalConservation Law§19-0323 ofthe(“theLaw”)itisa requirementthatheavydutydiesel vehiclesinexcessof8,500poundsusethebest availableretrofittechnology(“BART”)and ultra-low sulfurdieselfuel(“ULSD”).The requirementof theLaw appliestoallvehiclesowned,operatedbyor on behalfof,or leased byStateagenciesand Stateorregionalpublicauthorities.Italsorequiresthatsuch vehiclesowned,operated byoron behalfof, orleasedbyStateagenciesand Stateorregionalpublicauthoritieswithmorethanhalf ofits governingbodyappointed bythe GovernorutilizeBART.

TheLawmay be applicableto vehiclesused bycontractvendors“on behalfof”Stateagencies andpublicauthoritiesandrequirecertainreportsfromcontractvendors.AllheavydutydieselvehiclesmusthaveBARTbyDecember31, 2015(unlessfurtherextendedbyLaw). The Law alsoprovides a listofexemptedvehicles.Regulationssetforthin 6 NYCRR Parts 248and 249providefurtherguidance.TheBidder herebycertifiesandwarrantsthatallheavy dutyvehicles,asdefined inNYECL§19-0323, to beused underthiscontract,willcomplywith thespecifications andprovisions ofNYECL §19-0323, and 6NYCRRParts 248and 249.
