NEW MEXICO PROFESSIONAL BIG GAME HUNTING, INC
TERMS AND CONDITIONS
All hunts include two hunters with one guide except when special arrangement have been Made to be one hunter with one guide; meals which include breakfast, sack lunch, and dinner; Lodging in bunk houses or tent camps; care of trophy including caping of heads and transportation to meat processor.
Hunts do not include license fees, meat processing, taxidermy, alcohol, and transportation to and from Airport. If Unit Preference is left open, the hunter agrees to accept New Mexico Professional Big Game Hunting, Inc.’s choice. License fees and bag limits are subject to change by Commission without notice and the hunter accepts and understands this. No representation is made that a given hunt is quality, high demand or standard. Due to printing updates or lack of, or changes made by New Mexico Department of Game and Fish, some advertising statements may or may not remain accurate and the hunter accepts and understands this.
Deposits are non-refundable. Payment in full for hunt will be paid 30 days prior to arrival with cash, cashiers check, or money order. No personal checks will be accepted for balance due on a hunt after the initial deposit. When using credit cards for payment, applicable credit card charges will be borne by the hunter. The hunter further agrees all sales are final and agrees not to instigate a charge back, dispute claim with a credit card company against New Mexico Professional Big Game Hunting, Inc. and/or Largo Café and Motel.
Hunting is a strenuous, physical exercise requiringstamina and good conditioning. The weather in New Mexico can vary greatly over a short period of time, and extreme conditions of adverse weather may be encountered. The hunter recognizes these facts and represents that he is in good health and good physical condition so that he can participate in hunts in New Mexico and Arizona; unless he is handicapped and participating in the special Handicap hunts.
Hunting is an activity requiring the use of weapons such as firearms and bows, which can produce injury. It requires hazardous activities in the wilderness. The hunter recognizes and accepts all risks which can arise during hunting. The hunter holds harmless, forgives, releases and waives any claims which he may ever have against New Mexico Professional Big Game Hunting,Inc. for injuries, losses or damages of any nature arising from or incurred in hunting and other activities with New Mexico Professional Big Game Hunting, Inc.
New Mexico Professional Big Game Hunting, Inc. will use its best efforts to provide quality guiding and outfitting services to the best of its abilities. New Mexico Professional Big Game Hunting, Inc. cannot and does not guarantee good weather or a successful kill of game, not that the hunter will kill a trophy animal, and the hunter accepts these terms. Neither the weather nor the results of the hunt are guaranteed.
The hunter authorizes New Mexico Professional Big Game Hunting, Inc. to use any photos of him/her and/or any game animal he/she harvests for promotional purposes.
From time to time in our modern society, disputes arise and the hunter agrees that NewMexico law shall govern this contract and the legal obligations of New Mexico Professional BigGame Hunting, Inc. The hunter also agrees that the District Court of Catron County, New Mexico, shall be the exclusive and sole venue for all suits which may arise out of any disputes concerning this contract and the services provided by New Mexico Professional Big GameHunting, Inc. In the event suit is filed, the prevailing party shall be entitled to reimbursement of Their attorney fees.
The hunter agrees that he will abide by all state and federal laws at all times and will not engage in any conduct which may subject New Mexico Professional Big Game Hunting, Inc., its Employees, guides or customers to investigation or prosecution.
New Mexico Professional Big Game Hunting, Inc. is operating under a special use permit with the USDA Forest Service on the Gila, Cibola, Carson, Lincoln, and Apache Sitgreaves National Forests.
GRANTOR, hereby make, constitute and appoint MICK C. CHAPEL and/or JOHN CHAPEL, Officers of New Mexico Professional Big Game Hunting, Inc., as my attorney-in-fact to execute New Mexico and Arizona special hunt license applications in my name, place and stead, on my behalf. This Power of Attorney shall not be revoked by disability or incapacity of the Grantor, and shall otherwise continue in full force and effect until revoked by a subsequent writing or until the date of December 31, 2015, whichever shall occur first. IN WITNESS WEREOF, I have hereunto set my hand the ______day of ______, 2015.
