Definition of Terms

  1. Child Abuse-refers to the maltreatment of a child, habitual or not,

which includes any of the following:

  1. Psychological or physical abuse, neglect, cruelty, sexual abuse and emotional maltreatment;
  1. Any act by deeds or words which debases, degrades or demeans the intrinsic worth and dignity if a human being;
  1. Unreasonable deprivation of the child’s basic needs for survival, such as food and shelter; or
  1. Failure to immediate give medical treatment to an injured child resulting in serious impairment of his or her growth and development or in the child’s permanent incapacity or death (Sec. 3 [b], RA 7610)
  1. Corporal Punishment- refers to a kind of punishment or penalty imposed for an alleged or actual offense, which is carried out or inflicted for the purpose of discipline, training or control, by a teacher, school administrator, an adult, or any other child who has been given or has assumed authority or responsibility for punishment or discipline. It includes physical, humiliation or degrading punishment.
  1. Child- refers to any person below eighteen (18) years of age or those over but are unable to fully take care of themselves or protect themselves from abuse, neglect, cruelty, exploitation or discrimination because of a physical or mental disability or condition; (RA 7610). For purpose of this Department Order, the term also includes pupils or students who may be eighteen (18) years of age or order but are in school.
  1. Children in School- refers to bona fide pupils, students or learners who are enrolled in the basic education system, whether regular, irregular, transferee or repeater, including those who have been temporarily out of school, who are in school or learning centers premises or participating in school sanctioned activities.
  1. Pupil, Students or Learner- means a child who regularly attends classes in any level of the basic education system, under the supervision and tutelage of a teacher or facilitator.
  1. School Personnel- means the person, singly or collectively; working in a public or a private school. They are classified as follows:
  1. “School Head” refers to the chief executive officer or administrator of a public or private school or learning center.
  1. “Other school Officials” includes other school officers, including teachers, who are occupying supervisory positions or positions of responsibility, and are involved in policy formulation or implementation in a school.
  1. “Academic Personnel” includes all school personnel who are formally engaged in actual teaching service or in research assignments, either on a full-time or a part- time basis, as well as those who possess certain prescribed academic functions directly supportive of teaching such as registrars, librarians, guidance counselor, researchers and other persons. They may include school officials who are responsible for academic matters, and other school officials.
  1. “Other Personnel” includes all other non academic personnel in the school, whatever may be the nature of their appointment and status of employment.
  1. Child Protection- refers to program, services, procedures and structures that are intended to prevent and respond to abuse, neglect, exploitation, discrimination and violence.
  1. Parents- refers to biological parents, step-parents, adoptive parents and the common-law spouse or partner of the parent;
  1. Guardians or Custodians– refers to legal guardians, foster parents, and other persons, including relatives or even non-relatives, who have physical custody of the child.
  1. School Visitor or Guest- refers to any persons who visit the school and any officials business with the school, and any person who does not have any official business but is found within the premises of the school. This may include those who are within the school premises for certain reasons, e.g. student teachers, catechists, service providers, suppliers, bidders, parents and guardians of other children.
  1. Bullying or Peer Abuse- refers to willful aggressive behavior that is directed, towards a particular victim who may be out-numbered, younger, weak, with disability, less confident, or otherwise vulnerable. More particularly:
  1. Discrimination against children- refers to an act of exclusion, distinction, restriction or preference which is based on any ground such as age, ethnicity, sex, sexual orientation and gender identify, language, religion, political or other opinion, national or social origin, property, birth, being infected or affected by Human Immunodeficiency Virus and Acquired Immune Deficiency Syndrome (AIDS), being pregnant, being a child in conflict with the law, being a child with disability or other status or condition, and which has the purpose or effect of nullifying or impairing the recognition, enjoyment or exercise by all persons, on an equal footing, of all rights and freedoms.
  1. Child exploitation- refers to the use of children for someone else’s advantage, gratification or profit often resulting in an unjust, cruel and harmful treatment of the child. These activities disrupt the child’s normal physical or mental health, education, moral or social emotional development. It covers situations of manipulation, misuse, abuse, victimization, oppression or ill-treatment.

These are two (2) main forms of child exploitation that are recognized:

  1. Sexual exploitation- refers to the abuse of a position of

vulnerability, differential power, or trust, for sexual purpose.

  1. Economic exploitation- refers to the use of the child in work or other activities for the benefit of others. Economic exploitation involves a certain gain or profit through the production, distribution and consumption of goods and services. This includes, but is not limited to, illegal child labor, as defined in RA 9231.
  1. Violence against children committed in schools- refers to a single act or a series of acts committed by school administrators, academic and non-academic personnel against a child, which result in or is likely to result in physical, sexual, psychological harm or suffering, or other abuse including threats of such acts, battery, assault, coercion, harassment arbitrary deprivation of liberty. It includes, but is not limited to, the following acts:
  1. Psychological violence refers to acts that inflict bodily or physical harm. It includes assigning children to perform tasks which are hazardous to their physical well-being.
  1. Sexual violence refers to acts that are sexual in nature. It includes, but is not limited to:

a)Rape, sexual harassment, acts of lasciviousness, making demeaning and sexually suggestive remarks, physically attacking the sexual parts of the victim’s body;

b)Forcing the child to watch obscene publications and incidentshows or forcing the child to do indecent sexual acts and/or to engaged or be involved in, the creation or distribution of such films, indecent publication or material; and

c)acts causing or attempting to cause the child to engage in any sexual activity by force, threat of force, physical or other harm or threat of physical or other harm or coercion, or through inducements, gifts or favors.

  1. Psychological violence refers to acts or missions causing or likely to cause mental or emotional suffering of the child, such as but not limited to intimidation, harassment, stalking, damage to property, public ridicule or humiliation, deduction or threat of deduction from grade or merit as a form of punishment, and repeated verbal abuse.
  1. Other acts of violence of a physical, sexual or psychological nature that is prejudicial to the best interest of the child.
  1. Bullying or Peer Abuse- refers to willful aggressive behavior that is directed, towards a particular victim who may be out-numbered, younger, weak, with disability, less confident, or otherwise vulnerable.
  1. Cyber-bullying- is any conduct defined in the preceding paragraph, as resulting in harassment, intimidation, or humiliation, through electronic means or other technology, such as, but not limited to texting, email, instant messaging, chatting, internet, social networking websites or other platforms of formats.

School - Based - Child Protection Policy

The school is committed to ensure that policies and procedures on child protection are compiled and monitored. It is also a need to ensure that all students or learners, personnel, parents, guardian and visitors are aware of the child protection policy.

POLICY STATEMENT

NEW CUYAPO ELEMENTARY SCHOOL upholds the protection and rights of every student from any form of problems and abuses

encounteredin school and community.

The institute advocates the welfare of students by:

  1. Promoting and promulgating child protection and programs through information and education campaign. (IEC)
  2. Monitoring and assessing of the problems and abuses encountered in school and community.
  3. Exercise the parental authority and responsibility over the child while under the school personnel supervision, instruction and custody. Responsibility apply in all activities whether inside or outside the premises of the school, entity or institution
  4. Keep them in their company support, educate and instruct them by right precept and good example.
  5. Give them love and affection and advice and counsel companionship and understanding.
  6. Enhance, protect preserve and maintain their physical and mental health at all times.
  7. Furnish them with good and wholesome educational materials, supervise their activities, recreation and association with others, protect them from bad company and prevent from acquiring habits detrimental to their health, studies and morals.
  8. Represent them in all matters affecting their interests.
  9. Inculcate their value of respect and obedience.
  10. Practice positive and non-violent discipline as maybe required under the circumstances provided that in no case of corporal punishment be inflicted upon them.
  11. Perform such other duties as are imposed by law upon them as substitute parents or guardians and
  12. School personnel shall also strictly comply with schools child protection policy.
  1. Abide by the mission and vision of DepEd.
  2. Protect students from abuse.
  3. Monitoring and assessment of complaints and events
  4. Anecdotal reports through graphical presentation of every end school year data gathered.

Code of conduct

Every school shall maintain the students positive attitude and practice good moral principles so that every student will learn to appreciate their cultural heritage, develop their sense of identity and belongingness in the society. This code of conduct helps to promote order and sense of security in the school campus.

Conduct Inside the School Premises

  1. Drunkenness or under the influence of liquor, bringing intoxicating drinks inside or outside the school’s vicinity
  2. Unauthorized carrying of deadly weapons i.e. explosives, sharp blade weapons or other similar objects that could inflict injury or even kill.
  3. Involvement to a fight, assault or in any trouble either individually or in groups to fellow students, teachers and school personnel
  4. Creating or instigating mischievous acts/scandal which leads to interruption of classes and or orderliness of school daily routine.
  5. Display of immoral conduct possession or and dissemination of pornographic pictures reading materials, uttering or writing obscene language
  6. Vandalism, defacement or destruction of any school facilities
  7. Threatening of any fellow students, school personnel or non-students either orally or in written form
  8. Possession or trafficking or prohibited drugs of any kind or under its state of influence while inside or outside of the school campus during school days.
  9. Organizing or joining associations, group, societies, clubs, fraternities and sororities not sanctioned or officially recognized by the school authorities.
  10. Act of gangsters or hooligans
  11. Stealing school properties which includes plants, animals and all things found inside the campus
  12. Forging or tampering of any official school document in any form
  13. Gross misconduct i.e. oral or by gesture, offensive assault or provocation
  14. Gambling of any kind
  15. Display of acts of lusciousness
  16. Smoking inside the school campus
  17. Bringing of cell phone inside the school campus is strictly prohibited. cell phones used during the class hours and caught by the teacher or any school personnel will be confiscated
  18. Dishonesty
  19. Discourtesy
  20. Impoliteness to any occupant or non-occupant of the school
  21. Disobedience
  22. Spreading destructive news or gossip
  23. Wearing of earrings for boys
  24. Untidy and offensive indecent attire
  25. Truancy
  26. Habitual tardiness
  27. Loitering
  28. Littering of garbage
  29. Maintain the cleanliness and orderliness in the classroom and campus.
  30. Maintain harmonious relationship with each other by respecting each other rights and responsibilities.

Conduct Outside the School Premises

Uphold the good name of the school by being loyal and true to her,

Maintain good character and good disposition all the time

Maintain constant communication and harmonious relationship with parents and stakeholders.

Tardiness

All Pupils are expected in school 15 minutes before the time.

Official time will be from 7:15 – 11l30 noon, 1:00 – 4:15pm

Habitual tardiness requires admission slip.

Dishonesty and Cheating during examination.

Always absent from class, shouts and make unnecessary noise during class hours

Plays in the ground without permission

Cutting classes

Vandalism

Show disrespect to teachers and other person in authority.

Membership in illegal gangs or fraternities

Falsification of public documents like forgery, tampering of documents and etc.

Involves in any form of gambling during school days

Bullying in the form of physical/mental abuse, harassment, intimidation, and humiliation.

Action and Penalty

1st Offense – Report to the Teacher Adviser

2nd Offense – Report to Guidance Counselor

3rd Offense – Report to the Principal with parents notice and written

warning on anecdotal record.

4th Offense – Advise to transfer to other school or institution

Attendance

Attend flag raising and flag retreat ceremonies and other related activities of the school.

A pupil who has been absent from classes should present his/her teacher written note signed by his/her parent/guardian and duly noted by school guidance counsellor.

Students are encouraged to attend classes regularly and avoid cutting classes.

Allowable absence is only 10% of the total school days per school year.

A prolonged absence due to to illness must be verified by a written note from the parent/guardian together with the doctor’s certificate.

A pupil who leaves the room with permission of the teacher but remains outside unnecessarily for a long period of time will be marked absent.
