1. PURPOSE OF THIS ROCK UP NETBALL (RUN) LICENCE AGREEMENT

The purpose of this Licence Agreement is to outline the:

-Requirements of obtaining a Rock Up Netball licence

-Suite of products, packages and services issued under a licence

-Roles and responsibilities of both Netball Victoria (NV) and the licence holder

  1. NETBALL VICTORIA

2.1.What is Netball Victoria?

NV is a not-for-profit organisation responsible for the management and development of netball in Victoria. NV's core function is to identify and meet the needs of netball players, coaches, umpires, administrators, associations and clubs, and in doing so enhance participation experiences and encourage the uptake of netball in Victoria.

NV’s mission, vision and values are as follows:

Mission:Netball Victoria exists to enrich Victorian communities through the sport of netball;

Vision: More people are involved in netball more often; and

Values: Teamwork, Accountability, Integrity, Innovation and Empowerment.

2.2.Netball Victoria’s Strategic Objectives

2.2.1.Netball Victoria’s Strategic Plan for Success 2014 - 2018:

(a)Goal 1 – Increase Participation

  • More entry level programs for children and juniors;
  • New programs for students, males and older people to get into or back into netball;
  • New netball programs around fitness and fun;
  • Removing barriers to participation; and
  • Creating new ways for people to engage with netball.

  • Creating facilities for netball;
  • Growing strong and skilled Associations, Leagues and Clubs, volunteers and staff;

  1. ROCK UP NETBALL (RUN)

RUNhas been developed in conjunction with VicHealth to provide a ‘pay as you play’ opportunity for all fitness and skill levels, to participate in netball. The program caters for participants14 years and older. The initiative provides a platform for flexible participation in a fun and social environment and is represented across three areas:

  1. TRAIN - Incorporates the basic skills of playing netball in a fun and friendly environment with relaxed match play to finish. If you’re new to the sport or returning to netball, this program is for you.
  2. PLAY - Rock Up at an allocated time, either by yourself or with friends to play a game in a flexible, non-competitive environment. Scores will not be kept and positions can be changed as you go.
  3. SOCIAL COMPETITION - Mixed and Ladies competitions are offered to those who want to play netball in a fun, social, friendly environment. Keeping in line with netballs more traditional format, participants will have a more structured netball experience.

Minimum Standards for each program:

TRAIN

•1 hour program

•Combination of skills, modified games and match play

PLAY

•One off festivals – round robin format

•Length of games – 10-15 minutes

•Rolling substitutions allowed

SOCIAL COMPETITIONS

•12-week season including finals

•Game length 30 – 60 minutes

•Minimum 5 players per team on court

•Players can play for several teams in any given night. This will assist with ‘fill ins’

•Mixed Competitions – Minimum 1 participant from each ‘gender’. The use of this term is intended to encompass all people with diverse sex and/or gender identities.

3.1.WHAT IS A RUN LICENCE HOLDER?

3.1.1.A RUN licence is available to NV affiliates/providers to apply for under the newly created RUN Licence Agreement which is offered to participants at an affordable cost.

3.1.2.Under this licence agreement, NV Affiliates, private operators, companies limited by guarantee or local government venues (bodies) have the option to deliver asuite of RUN products and Social Netball competitions.

3.1.3.This agreement offers licence holders the opportunity to introduce new participants to netball in a short season/competition (maximum 12 weeks, including finals).

3.1.4.NV Affiliates/providers must apply to NV to deliver a RUN competition. Each application will be individually assessed and will need to be approved prior to any competition or programcommencing. Applications will only be approved if all the required information is provided to NV and associated criteria met (see section 5).

3.1.5.Once approved by NV, aRUN Licence holder is authorised to deliver programs and competitions without registering individual members with NV (See section 6 for package options in more detail).

3.1.6.Instead of participants paying an individual NV membership fee, they will pay per session for TRAIN and PLAY and a team fee per season for social competitions.

3.1.7.Please note that players do not become members of NV if they participate in a Rock Up Netball program or competition. Teams are not classified as ‘members’ either.

  1. TERMS AND CONDITIONS OF A RUN LICENCE HOLDER

4.1.Building and Contents Insurance

4.1.1.The licence holder must have its own Building and Contents Insurance - this is not provided as part of the licence agreement with Netball Victoria.

4.2.Public and Products Liability

4.2.1.NV affiliates are automatically covered for Public Liability cover under the NV Public Liability Insurance Program

4.2.2.Providers must ensure you have your own Public Liability Insurance policy, a copy of your Public Liability Certificate of Currency must be provided as proof of cover and detail the following minimum limits of liability;

4.2.2.2.Professional Indemnity / Errors and Omissions$2,000,000

4.3.Personal Accident Insurance

4.3.1.NV Affiliates: New participants are provided with Personal Accident and Public Liability Insurance

4.3.2.Non-NV Affiliates:New participants can be provided with Personal Accident insurance through an insurance package (see section 7).

4.3.2.1.If you hold a current Personal Accident Insurance Policy, you must provide a Certificate of Currency as proof of cover, which includes cover for the following:

  • Death and Capital Benefits
  • Non-Medicare Medical Cover
  • Loss of Income Cover
  • Cover for participation in netball related activities (RUN-Train, Play and Social Competitions)
  • Note: All participants must be provided with Personal Accident Insurance through one of the above options.
  • New RUN participants do not become members of NV and are not provided with a membership card.
  • All umpires and coaches are required to be full NV members and hold a current working with children check.
  • Coaches must be endorsed by NV to runTRAIN or PLAY prior to delivery.
  • The agreement applies to competitions and programs for ages 14 years and above.
  • A RUN licence holder must be approved by NV before delivering any RUN competitions or programs.
  • All teams participating in a RUN competition must pay the team registration fee regardless of whether their playersare full NV members or not.
  • NV Affiliates/providers are required to keep accurate records of all registered participants for insurance purposes and to ensure NV complies with the reporting obligations to VicHealth (player numbers, frequency, volume of participation and participant details). Online registrations are preferred to ensure all data is accessible by NV before the competition commences.
  • NV affiliates must register all participant and team data into MyNetball through the RUN registration type and entered in to MyNetball monthly.
  • Providers must ensure that team and individual registrations are processed through the RUN registration platform. Additional data not collected via the RUN platform must be sent monthly to NV via the ‘RUN Participant Data’ excel spreadsheet.
  • RUN and VicHealth branding guidelines must be adhered to at all times:
  • Represent the RUN and VicHealth brand in a positive manner
  • Not make a statement either orally or in writing which is likely to case damage or loss to RUN or VicHealth
  • Where possible acknowledge RUN and VicHealth in all announcements, marketing and promotion.
  • Appropriate use of the RUN and VicHealth logo
  • Maximum number of 12 players per team per game. No maximum number of players per squad per season.
  • Relaxed rules
  • Uniforms – Teams will not be excluded if they do not wear a netball skirt, dress or matching uniforms. Teams will be expected to wear the same coloured bibs. It is expected that the umpires will ensure safe clothing and footwear is worn by the participants.
  • Game Rules – Umpires to ensure the game is umpired fairly, ensuring rules are explained to participants if they are new to the sport.
  • RUN licence is per annum from the date of signed agreement. The licence fee will be set up through a direct debit form (see Appendix B) and will incur charges at the start of each licence year. At the start of a new agreement, a new RUN licence will be published and signed by the holder and NV. Please note, if you choose to end your licence at the end of the agreed year, we require 28 days’ notice prior to the end date on the agreement. This notice must be in writing and will allow NV to cancel the direct debit.

  2. Applications to deliver a Rock Up Netball Social Competition will be approved by Netball Victoria on a case by case basis. Approval will be determined by the following criteria:
  3. Time and Location of competition – To ensure a RUN social competition does not conflict with existing Netball Victoria competitions in the same area.
  4. Demand for competition – Lack of participation/competition opportunities in the area. NV will aim to understand what you currently deliver and what you intend to deliver.
  5. Target Audience – New or existing netball players.

7.2.Licence fees and payment structures:

7.2.1.All licence fees packages must be paid in full prior to program commencing. Any licence holders that does not comply will lose their RUN licence.

7.2.2.NV Affiliates will be invoiced monthly for team registration fee.

7.2.3.NON-NV Affiliates team registration must be paid online via the RUN platform.

7.3.Licence holders who wish to utilise the RUN platform to collect Social Competition ‘weekly fees’ and/or Train and Play online payments,can subscribe to the existing online payment platform. The annual fees are outlined below:

  1. PROCESS OF REGISTRATION

On approval by Netball Victoria, a Licence Agreement will be sent to the applicant. This agreement needs to be signed by the affiliate/private provider and returned to Netball Victoria prior to the commencement of the program/competition either via email - or postal – PO Box 60, North Melbourne, Vic, 3051.

RUN licence holderswill also be required to complete the RUN Program/CompetitionsForm (Appendix A) for each competition/program they intend to run during the licence agreement period. This form needs to be submitted to NV no later than three weeks prior to the intended commencement of the competition/program. Only once the programs/competitions have been approved and signed by NV can they be delivered. Commencement of any program/competition prior to approval by NV, may result in immediate loss of licence.

APPENDIX B – DIRECT DEBIT REQUEST SERVICE AGREEMENT AND FORM

  • Direct Debit Request Service Agreement

This is your Direct Debit Service Agreement with Netball Victoria 497566 ABN: 83 704 752 745. It explains what your obligations are when undertaking a Direct Debit arrangement with us. It also details what our obligations are to you as your Direct Debit provider.
Please keep this agreement for future reference. It forms part of the terms and conditions of your Direct Debit Request (DDR) and should be read in conjunction with your DDR authorisation.
Definitions / accountmeans the account held at yourfinancial institution from which we are authorised to arrange for funds to be debited.
agreement means this Direct Debit Request Service Agreement between you and us.
banking day means a day other than a Saturday or a Sunday or a public holiday listed throughout Australia.
debit day means the day that payment by you to us is due.
debit payment means a particular transaction where a debit is made.
direct debit request means the Direct Debit Request between us and you.
usorwemeans Netball Victoria (the Debit User) you have authorised by requesting a Direct Debit Request.
youmeans the customer who has signed or authorised by other means the Direct Debit Request.
yourfinancial institution means the financial institution nominated by you on the DDR at which the account is maintained.
1.Debiting your account / 1.1By signing a Direct Debit Request or by providing us with a valid instruction, you have authorised us to arrange for funds to be debited from your account.You should refer to the Direct Debit Request and this agreement for the terms of the arrangement between us and you.
1.2We will only arrange for funds to be debited from your account as authorised in the Direct Debit Request.
or
We will only arrange for funds to be debited from your account if we have sent to the address nominated by you in the Direct Debit Request, a billing advice which specifies the amount payable by you to us and when it is due.
1.3If the debit day falls on a day that is not a banking day, we may direct your financial institution to debit your account on the following banking day. If you are unsure about which day your account has or will be debited you should ask your financial institution.
2.Amendments by us / 2.1We may vary any details of this agreement or a Direct Debit Request at any time by giving you at least fourteen (14) days written notice.
3.Amendments by you / 3.1You may change*, stop or defer a debit payment, or terminate this agreement by providing us with at least fourteen (14 days) notification by writing to:

4.Your obligations / 4.1It is your responsibility to ensure that there are sufficient clear funds available in your account to allow a debit payment to be made in accordance with the Direct Debit Request.
4.2If there are insufficient clear funds in your account to meet a debit payment:
(a)you may be charged a fee and/or interest by your financial institution;
(b)you may also incur fees or charges imposed or incurred by us; and
(c) you must arrange for the debit payment to be made by another method or arrange for sufficient clear funds to be in your account by an agreed time so that we can process the debit payment.
4.3You should check your account statement to verify that the amounts debited from your account are correct
5Dispute / 5.1If you believe that there has been an error in debiting your account,you should notify us directly on 03 9321 2217 or via email and confirm that notice in writing with us as soon as possible so that we can resolve your query more quickly. Alternatively you can take it up directly with your financial institution.
5.2If we conclude as a result of our investigations that your account has been incorrectly debited we will respond to your query by arranging for yourfinancial institution to adjust your account (including interest and charges) accordingly. We will also notify you in writing of the amount by which your account has been adjusted.
5.3If we conclude as a result of our investigations that your account has not been incorrectly debited we will respond to your query by providing you with reasons and any evidence for this finding in writing.
6.Accounts / You should check:
(a)with your financial institution whether direct debiting is available from your account as direct debiting is not available on all accounts offered by financial institutions.
(b)your account details which you have provided to us are correct by checking them against a recent account statement; and
(c)with your financial institution before completing the Direct Debit Request if you have any queries about how to complete the Direct Debit Request.
7.Confidentiality / 7.1We will keep any information (including your account details) in your Direct Debit Request confidential. We will make reasonable efforts to keep any such information that we have about you secure and to ensure that any of our employees or agents who have access to information about you do not make any unauthorised use, modification, reproduction or disclosure of that information.
7.2We will only disclose information that we have about you:
(a)to the extent specifically required by law; or
(b)for the purposes of this agreement (including disclosing information in connection with any query or claim).
