Employment Agreement

This Employment Agreement is made and entered into on this day of ______by and between (called as “The Employer”). And MR.______, National with passport no. ______ (Hereafter called “The Employee”)

Whereas the Employer desire to employ the Employee for his construction work in ______project on the conditions mentioned hereafter and whereas the Employee covenants to work faithfully in conformity with the Employer’s and with the Employer’s instruction.

Now, in consideration of the mutual covenants herein contained, both parties have agreed as follows.

Basic Terms of the Contract:

  1. Employee’s Job Title or Positions
  2. Basic monthly salary:

The basic salary shall not be below the minimum wages according to the laws of the country of employment or the minimum wages fixed by the Govt. of Labour supplying country, whichever is higher.

  1. Duration of contract:

The duration of contract should not be less than 2 years. But in special cases where salary is comparatively higher than the normal, lesser duration may be considered.

  1. Traveling Expenses :

Both way air passages shall be borne by the employer

  1. Accommodation:

The employer shall provide suitable accommodation at free of cost. In case of working in a community where lodging can be rented and employer wishes to pay cash in lieu of rent, it shall be paid at a rate suitable to the locality.

Food: The employer shall provide three meals per day to the employee free of charge or 25% of the basic salary.

Working days and Working Hours: Normally working days shall be 6 days per week and one day pain holiday per week and working hours be 8 hours per day 48 hours per week.

Overtime: In case the employer requests the worker to work overtime or on holiday, the employer shall pay for overtime at 1.5% of the basic salary rate.

Leave Benefits: The employer shall clearly state the weekly holidays, annual holiday, sick leave and annual vacation specifying number of days, payment of wages or other compensation which shall be according to the laws of the country of employments.

Medical treatment: The employer shall provide necessary medical treatment free of cost to his employee.

The employer shall provide fee emergency medical and dental services including medicine.

Insurance: The employer shall provide necessary insurance against death or injury according to the laws of the country of employment.

Renewal of contract: The contract is renewable with mutual agreement of both the employer and the employee.

Other terms and conditions: Other terms and conditions favorable to the employee not covered hereby and which are provided by the laws of the country of employment shall apply and form part of this contract.


Certification: The Employer and the employee certify that they have read the agreement and that fully understand, it’s terms and conditions and both further certify that the going terms and condition together with the application constitute, their entire agreement and that any other agreement or understanding a side form further, this contract shall be considered null and void.

AGENCY AGREEMENT

This agreement is entered into between M/S …………… state of ……… here in called ‘’The First Party” and M/S KC International Pvt. Ltd. P.O.Box. No. 13886, KMC -2 Lazimpat, Kathmandu Nepal with contact no. Tel.9771-4440633, 4440636 here after called ‘’The Second Party”.

The partner here to have negotiated and finalized this agreement for ‘’Recruitment of Manpower” from Nepal on the following terms and conditions.

1.  The First Party: here by agrees to appoint The Second Party as their lawful attorney and agents for requirements and placements of Nepali Workers for them.

2.  The First Party: Agrees to inform .The Second Party of their requirement of the manpower from time to time whenever they have demands for manpower. It is also agreed that necessary Demand Letter. Power of Attorney and the specimen contracts will be provided for mobilization for the workers.

3.  The Second Party: Agrees to mobilize the required manpower on receipt of the demand by advertising news papers and short listing application by the pre-selection though personal interview and trade test for the final selection by the first party’s representative. If the final selection to be done by the Second Party on the behalf of the First Party medical test and the processing Visa by The Second Party.

4.  The First Party: agrees to process visas for the selection candidates with in 30 days from the date of receipt of completed documents at their office .In case of delays the second party should be informed about the reason and approximate time by which the visa will be ready.

5.  The Second Party: Agrees placement workers at the place of employment with in a minimum period of 50 days and maximum period of 45 days from the date of receipt of visa at their office.

6.  The First Party: Agrees to fulfill at the conditions agreed upon by the both parties regarding accommodations salary and other service condition and make sure that the recruited workers are paid their salary monthly on regular basis and in time.

7.  Both parties here to have agrees that this agreement will be valid for two years from the date of signing initially and shall be considered renewed automatically for further period on the same terms and conditions, unless terminated by either party in writing.

Both the parties here to have discussed all the above matter in details and agrees to all terms and conditions stipulated in this agreement and out their signature in two identical originals, one to kept by each party.
