A.Vice Chairman Robison called the meeting to order at 7:01 p.m.

C.CONSENT AGENDA:

1.Discussion, consideration and possible action on the minutes of the July 14, 2015 special meeting.

There was no discussion therefore Commissioner Chronister made the MOTION to APPROVE the minutes of the July 14, 2015 Special meeting. Commissioner Kindiger was the SECOND and the vote was:

AYES: Chronister, Stevenson, Kindiger, Robison

NAYES: None

ABSTAIN: McReynolds

ABSENT: Proctor, Jensen

2.Discussion, consideration and possible action on the minutes of the July 28, 2015 meeting.

There was no discussion therefore Commissioner Chronister made the MOTION to APPROVE the minutes of the July 28, 2015 Special meeting. Commissioner McReynolds was the SECOND and the vote was:

AYES: Chronister, Stevenson, Kindiger, Robison, McReynolds

NAYES: None

ABSENT: Proctor, Jensen

D.DISCUSSION ITEMS

  1. A. To conduct a public hearing of a request by Helena Chemical Company for a change in zoning from I-2 Heavy Industrial to I-3 Heavy Industrial at 310 East Jensen (part of the East Half of the NW/4 of Section 28, Township 12 North, Range 7 West of the Indian Meridian, Canadian County, Oklahoma)

Vice-Chair Robison opened the Public Hearing at 7:04 p.m.

Dale Cox explained that Helena wants to build a liquid and dry storage for fertilizer adding to

the existing business. Cox said the City asked them to rezone to conform to the new code.

Roger Pippins,who owns property abutting Helena,said he would like to see the sensitive

borders be required for the proposed expansion. He does not want it near his property.

Vice-Chair Robison closed the Public Hearing at 7:07 p.m.

B. Kindiger asked if Helena can’t meet the setback standards then it seems we have our answer. Chronister said that the MPC and City Council can relax some of the sensitive border standards. He went on to explain the benefits of the rezone. Chronister said he would like to waive the setback standards.

Robison clarified that the use of the property is not changing. Pippins said he understood that a rezone would require any development to adhere to the sensitive border standards.

Stevenson and McReynolds missed the initial meeting involving Helena so they asked to see the site plans provided.

Kindiger brought up the explosive fertilizers which Cox was quick to respond that Helena does not store ammonia nitrate. Bobby Shelton also with Helena provided the MSDS sheets for the products they store.

Commissioner Chronister made the MOTION to APPROVE the request by Helena to rezone from the old (I-2) to the new (I-3) Heavy Industrial. Commissioner Kindiger made the SECOND to the motion and the vote was:

  1. A.To conduct a public hearing of a request by Helena Chemical Company for a Conditional Use Permit (CUP) for bulk fertilizer storage at 310 East Jensen (part of the East Half of the NW/4 of Section 28, Township 12 North, Range 7 West of the Indian Meridian, Canadian County, Oklahoma)

Robison opened the Public Hearing at 7:28 p.m.

Pippins voiced concerns of the liquid tanks and them sitting on the ground. Cox explained

thatthere is a bladder inside the steel containments.

Pippins said if the sensitive border standards doesn’t apply then he feels we are violating the

code. Chronister said we are actually enforcing the sensitive borders standard we are just

relaxing the setback requirements. The noise, dust and lighting standards will still apply.

The vice-chairman closed the Public Hearing at 7:36 p.m.

B. Discussion, consideration and possible action of a request by Helena Chemical Company for a Conditional Use Permit (CUP) for bulk fertilizer storage at 310 East Jensen (part of the East Half of the NW/4 of Section 28, Township 12 North, Range 7 West of the Indian Meridian, Canadian County, Oklahoma)

Vice-Chairman Robison said we have had an official request for comprehensive list of chemicals that will be stored. He asked Cox to put together the list and have it turned to Shelly Dalla Rosa within 48 hours. Cox agreed.

Chronister and Robison asked about hours of operation and equipment that would emit noise. Lighting and fencing were minimally discussed as well.

Chronister brought up landscaping requirements saying that will help aesthetically. Pippins asked about fencing. Vice-Chair Robison said it appears a fence is required between an industrially zoned property that abuts residential use.

Robison made the MOTION toRECOMMEND the CUP request for Helena with these conditions:

  1. Supply a comprehensive list of stored materials that is not allowed to change without review and approval
  2. Sensitive border standards apply with the exception of the setback requirements

McReynolds SECONDED the motion and the vote was:

AYES: Kindiger, Robison, McReynolds,Chronister, Stevenson

NAYES: None

ABSENT: Proctor, Jensen

Commissioner Chronister made the MOTION to ADJOURN and was SECONDEDby
