Purpose

It is the policy of Kohl’s Department Stores, Inc. (the "Company") to promote the safety and well-being of our associates through the following procedures for the safe operation of motor vehicles. This attempt to reduce the impact of motor vehicle accidents and violations, as well as to manage the Company’s liability risk shall be a commitment of all Company associates.
Scope:
This policy covers the safe use and operation of all motor vehicles driven by the Company’s associates while on Company Business. Also included are those non-associates who are permitted to drive any Company Vehicle as permitted under this Policy.
Definitions:
Company Vehicle: A vehicle owned, leased or rented by the Company (through its associates or otherwise), or any of the Company’s corporate affiliates, with the exception of vehicles issued to Executive Committee members, which are governed by a separate policy.
Associate Vehicle: Any personal vehicle, other than a Company Vehicle, being driven by an Associate while on Company Business.
Company Business: Arising out of, or in course and scope of conducting business for the Company .
Driver: Any individual who operates a Company Vehicle or Associate Vehicle.
Policy
A. Company Vehicle Procedures
  1. Associates are authorized to operate any Company Vehicle assigned to them. No other people, including Spouses are authorized to operate a Company Vehicle except in an emergency, or as approved in advance by the Travel Department for special circumstances related to relocation of associates.
  2. Associates are authorized to use an Associate Vehicle only when instructed to do so by their Supervisor.
  3. Safety restraints (seatbelts and shoulder harnesses) are required to be worn by the driver and all passengers while operating or riding in a Company Vehicle or Associate Vehicle. The Driver of such vehicle is responsible for enforcing seat belt use by all occupants. Associates must ensure that all safety restraints are maintained in good operating condition. When the Company Vehicle is driven for personal use, Driver must require all children and infants riding in the Company Vehicle to be properly secured in an appropriate child restraint system. No children should accompany associates on Company Business.
  1. Drivers are to comply with all motor vehicle traffic laws while operating a Company Vehicle or Associate Vehicle, including laws relating to the driving while intoxicated and driving under the influence.
  2. Drivers are required to have a valid driver's license and comply with all conditions on the license.
  3. Drivers are prohibited from operating a Company Vehicle or Associate Vehicle while their judgement is impaired. Such impairment may be caused by consumption of alcoholic beverages, drugs, medication, or fatigue.
  4. Drivers are prohibited from overloading and/or overcrowding a vehicle. It is the guideline to not carry more passengers than the number of occupant restraints in the vehicle.
  5. Firearms are not permitted in any Company Vehicle or Associate Vehicle.
  6. Hazardous substances are not to be transported on any Company Vehicle or Associate Vehicle. Non-hazardous materials transported in the driving compartment that have the potential to cause injury, as a result of a sudden movement, must be secured.
  7. Drivers are prohibited from the transportation of hitchhikers or strangers.
  8. Every Driver has the responsibility to drive defensively. Make driving your first priority. Do not be distracted from driving while eating or drinking.
  9. For the purpose of this policy, the term Communication Device refers to Cellular Phones, Blackberries and Laptops or the use of Kohl’s systems through KRAnywhere and KMAnywhere. Associates are responsible for the safe use of their Communication Devices while operating a motor vehicle. Associates are required to use a hands-free device when using a Communication Device for business-related purposes while operating a motor vehicle. Activities that cannot be conducted with a hands-free device, such as texting, typing or dialing while operating a motor vehicle are prohibited. In these instances, the driver should find a safe pace to pull over and secure the vehicle before texting, typing or dialing on a Communication Device.
  10. This policy applies to all Associates (Exempt and Non-Exempt) who may be communicating business information while operating a motor vehicle.
  11. This policy applies regardless of if the car or Communication Device is company owned or supplied.
  12. It is the responsibility of every Driver to operate the Company Vehicle or Associate Vehicle in accordance with the laws, ordinances, and regulations of the jurisdiction in which it is being operated.
  13. Associates are prohibited from operating motorcycles on Company Business.
B. Company Vehicle Maintenance
  1. Safe vehicles are a priority for any safety and accident reduction effort. All associates shall ensure that any Company Vehicle or Associate Vehicle is in safe operating condition.
  2. Associates are required at a minimum to maintain Company Vehicles as recommended by manufacturer’s specifications for preventative and scheduled maintenance.
  3. Associates must read and understand the exact protection offered in the manufacturer’s owner’s manual of any Company Vehicle. Suspected mechanical problems are to be repaired prior to the warranty expiration date.
C. Vehicle Accidents
In the event of an accident the associate must:
  1. Contact a police officer, state trooper and/or applicable policing authority. A police report must be obtained.
  2. Gather the following information at the accident scene and submit to the Risk Management Department and current insurance carrier.
•Name of vehicle owner
•Name of other driver(s)
•Names of injured
•Witnesses - for or against
•Names and badge number of investigating officer
•Time and location of accident
•Weather conditions
•Traffic conditions
•Description of accident
  1. Contact their manager and the Risk Management Department within 24 hours of the accident.
  2. Employee must comply with state laws and file written reports with state, county and city authorities in accordance with the laws of the applicable jurisdiction in the event of an accident.
  3. If the associate is utilizing an Associate Vehicle, you must notify your insurance carrier as your insurance is primary, first coverage for the accident and any resulting damage, loss or expense.
Associates are not authorized to and shall not express opinion as to fault or liability, agree to any settlement on behalf of Kohl’s Department Stores, Inc. or sign any statements other than documents required by the police authorities.
D. Performance of Driver
  1. A Company Vehicle is a privilege provided at the option of the Company and is not a right of employment. The Company has the right at its sole discretion to terminate this privilege.
  1. The Company reserves the right to review the driving record of any Associate, or prospective Associate, who may from time-to-time operate a Company Vehicle or Associate Vehicle.
  2. The Company may revoke driving privileges and/or seek full reimbursement from a Driver from any loss, damage or expense incurred by Company due to the negligence of the Driver, at any time for any reason.
