Teresa Waight - SALES CONTRACT.

On purchasing a Teresa Waightpuppy you are required to sign the following contract. This is to safeguard the puppy / dog for the rest of his / her life.

As a breeder I strongly feel that those that breed should be responsible for the puppies they produce therefore if for any reason the original owner cannot / or is unwilling to keep the dog the following terms must be adhered to and by signing this contract you acknowledge that you understand my terms and conditions of sale.

  1. Certain breeds of dogs may be affected by disease, some of which are genetic, or partly genetic in origin. I believe the above puppy to be in good health, but give no warranty to its health.
  1. You are advised to take the puppy to your Veterinary surgeon for a general health check within four days of the purchase date. The check and any associated test, examinations and certificates, will be at your expense as you hereby acknowledge. I shall not be responsible for any medical costs incidental to the puppy after you receive the puppy. I guarantee the above-described puppy to be healthy at time of the sale. I do not assume any liability for any injury to said puppy after time of sale. If there is a problem with the puppy, your veterinarian and our Veterinarian must agree weather health reasons existed before time of purchase, provided the puppy has been properly cared for in your possession. As the said puppy will have already been checked by my veterinary surgeon, prior sale.
  2. If your puppy has a congenital umbilical hernia we are not liable to pay for any operation your vet may say is required. As umbilical hernias are not life threatening and are common amongst Lhasa apsos. The puppy can lead a long and happy trouble free life with an umbilical hernia.
  3. If the veterinary surgeon finds a problem (except hernias), which in opinion renders the puppy unfit for sale, you may return the puppy for an exchange of another puppy of the same breed, quality and sex. The replacement will be subject to availability (within approximately 8 months). The puppy will be replaced; NO moneys will be refunded, provided that;
  4. You specifically confirm that we will not be held responsible for the distress caused by the return of the puppy.
  5. You are solely liable for any costs associated with the return of the puppy.
  6. The puppy is returned within 5 days of sale in the state in which it was sold.
  7. You provide a written statement from your veterinary surgeon setting out problem and including the name of the puppy.
  8. If the puppy dies within 24 hours of purchase, You must have an autopsy performed by a licensed veterinarian at your expense to determine the cause of death. If the cause of death is due to problems existed before time of purchase and after our veterinarian has examined the puppy, a replacement puppy will be given. The replacement puppy will be of same equal value. A replacement will only take place if the above puppy has been properly cared for in your possession. UNDER NO CIRCUMSTANCES WILL A REPLACEMENT OF A DOG TAKE PLACE IF THE ABOVE CONDITIONS ARE NOT MET. The puppy must be returned within 24 hours after which time replacement of the puppy is forfeited.
  9. No replacement will be made for temperament as this is environmental and your responsibility. As responsible breeder I expect that this puppy be properly socialized. As breeder I do everything possible to breed dogs of sound mind (temperament) and body. Some responsibility is yours as to proper feeding, exercise, socializing and training, of which all have a bearing on the end results of sound adult dog.
  10. You guarantee that the puppy will not be transferred to a third party, without our express permission in writing under any circumstances. If this clause is breached, and I am forced to locate the puppy, you acknowledge that you will be liable for the cost of recovery, including overseas recovery if the puppy is found to be exported, whether or not you knew the puppy was exported.
  11. You guarantee that your fencing is sufficient to keep an active dog within your grounds and that this puppy will not be kept permanently in a kennel, or tied up, and will not be regularly left unattended for periods longer than 8 hours (said puppy/dog must have food and drinking water for the time you are away from them).
  12. You confirm that you will properly house, feed, water and exercise this dog and will arrange for appropriate veterinary attention, if and when need.
  13. Should you have any tests undertaken on this dog including tests for eyes problems, which could be of interest to me, due to their possible effect on future breeding programmes, a copy of the results will be sent to me.
  1. However: IF THE PUPPY HAS BEEN BOUGHT BY SOMEONE FROM OVERSEAS, and is intened to live overseas: I will arrange air shipment of the said puppy, however, you will pay the cost of any and all arrangements and expenses for commercial shipment of the said puppy. The puppy will be shipped airfreight. I prefer not to commercially ship a puppy before 16 weeks of age. I shall not be responsible for the safety of the puppy while in transit to your place of residence, to include any and all incurred injuries as a result of transportation accidents.
  2. This puppy/dog is sold as a PET only.
  3. If said puppy/dog becomes lost or stolen, you agree to notify me immediately. I will not be responsible for this loss and I will not refund the purchase price of the puppy, nor will I give another puppy for replacement you also agree not to sell, trade or dispose of this puppy.
  4. You agree to advise us twice yearly of the dogs progress by virtue of phone calls, letters, emails and / or photographs and will not hesitate to contact me with any problems or questions that you may have concerning the ownership of the dog.
  5. You guarantee that if for any reason you are unable/ unwilling to keep the puppy/dog at anytime he/ she will be returned to Teresa Waight for re-homing. NEITHER REFUND NOR REPLACEMENT OF PUPPY WILL BE GIVEN.Please inform family members or put it in your will that, If there is nobody that can have the puppy/dog if you die, Teresa Waight will always have them back with a view to rehome depending on age of puppy/dog. If one of your family members do take your puppy/dog on they will need to inform Teresa Waight so new contact can be done.
  6. You will inform me of any change of address and / or telephone numbers during the ownership of the dog.
  7. It is also understood that I may examine and make inquiries about said puppy at any time. If not satisfied with the condition of puppy/dog or the conditions, in which it is kept, said puppy/ Dog can or may be removed immediately; NEITHER REFUND NOR REPLACEMENT OF PUPPY/Dog WILL BE GIVEN. Any veterinary services needed DUE TO; I negligence or lack of care, will be your responsibility and payable to me.
  8. If for ANY of the reason above the Puppy/Dog is removed you will need to pay a fee of £1000 to Treatsntrix (Teresa Waight) for breaching this contact, so that Treatsntrix (Teresa Waight) have time to retrain (if needed) and rehome, the signing of this contact says you are in agreement with this charge.

This contract contains the entire agreement between the parties and no statement or verbal agreements made by either party that are not contained in this written contract shall be valid or binding. This contract may not be modified or altered except in writing and signed by both parties. Violations of this contract will constitute BREACH of CONTRACT, prosecutable by law, and may result in mandatory confiscation and return of the puppy to Teresa Waight.

I have read and understand the stipulations of the contract and voluntarily agree to all elements, stipulations and provisions herein.

Note: Contract not binding until signed by both buyer and seller. Upon signature completion, this contract will become a legal and binding document, as agreed by buyer and seller.
