Connections 4 Kids

I. BACKGROUND:

The purpose of this RFP is to identify Expanding Quality and Infant Toddler (EQIT) Instructors with whom to contract for the Spring 2011 EQIT Class and RELATE Coaching.

II. SUBMISSION REQUIREMENTS:

1.  Submittals, in three (3) copies (one copy shall be marked “original”), bearing the title “Spring 2011 Expanding Quality and Infant Toddler (EQIT) Class and RELATE Coaching” will be received no later than 4:00 PM local time prevailing, on February 11, 2011 to:

2. Any proposal or addenda pertaining thereto received after the announced time and date for submittal, whether by mail or otherwise, will be rejected. It is the sole
responsibility of the bidder to ensure envelopes containing their bids are date stamped by the Department of Social Services on behalf of the Council. All proposals and/or any addenda pertaining thereto that are received after the closing date will not be reviewed and will be returned, unopened to the proposer. No exceptions will be allowed. However, nothing in this RFP precludes the Council from requesting additional information at any time during the procurement process.

3. Proposal will not be accepted via Fax machine or Internet E-mail.

4. To ensure confidentiality of the document, all proposals must be packaged, sealed and show the following information on the outside of the package: -- Confidential – Do not open

III. GENERAL TERMS AND CONDITONS:

1. PROPOSAL PROCESS:

· According to the State Department of Education only Moffat, Rio Blanco, Routt and Garfield County residents may be considered.

· Bidders are to submit written proposals which present their qualifications , references, and understanding of the work performed. The proposal should be prepared simply and economically and should provide all the information which it considers pertinent to its qualifications for the project and which respond to the scope of work listed herein. Emphasis should be placed on completeness of services offered, and be clear and concise in content.

· All proposed fees and costs must be disclosed in the proposal.

· Proposals which do not completely address all the requests will be considered non-responsive and will be excluded from consideration.

· Bidders shall include with their submittals the “Pricing Sheet” (attached), and the “Signature Sheet” (attached).

2. INDEMNIFICATION AND HOLD HARMLESS: The Bidder who is selected as the

Contractor shall, at his/her own expense, protect, defend, indemnify, save and hold harmless the

County of Moffat, and the Connections for Kids Early Childhood Council, and its elected and appointed officers, employees, servants and agents from all claims, damages, lawsuits, costs and

Expenses including, but not limited to, all costs from
administrative proceedings, court costs and attorney fees that the County of Moffat and its
elected and appointed officers, employees, servants and agents may incur as a result of the acts, omissions or negligence of the Contractor or its employees, servants, agents or subcontractors
that may arise out of the agreement.

The Contractor’s indemnification responsibility under this section shall include the sum of damages, costs and expenses which are in excess of the sum of damages, costs and expenses which are paid out in behalf of or reimbursed to the County, its officers, employees, servants and agents by the insurance coverage obtained and/or maintained by the Contractor.

3. NOTIFICATION OF IMMIGRATION COMPLIANCE REQUIREMENT: If Contractor has any employees or subcontractors, Contractor shall comply with §8-17.5-101 C.R.S., et seq., regarding Illegal Aliens - Public Contracts for Services, and this Contract. By execution of this Contract, Contractor certifies that it does not knowingly employ or contract with an illegal alien who will perform work under this Contract and that Contractor will participate in either the E-Verify Program or Department Program in order to confirm the eligibility of all employees who are newly hired for employment to perform work under this Contract.

A.  Contractor shall not:

(i)  Knowingly employ or contract with an illegal alien to perform work under this Contract; or

(ii)  Enter into a contract with a subcontractor who fails to certify to Contractor that the subcontractor shall not knowingly employ or contract with an illegal alien to perform work under this Contract.

B. Contractor has confirmed the employment eligibility of all employees who are newly hired for employment to perform Work under this Contract through participation in either the E-Verify Program or Department Program.

C. Contractor shall not use either the E-Verify Program or Department Program to undertake pre-employment screening of job applicants while this Contract is in effect.

D. If Contractor obtains actual knowledge that a subcontractor performing work under this Contract knowingly employs or contracts with an illegal alien, Contractor shall:

(i)  Notify the subcontractor and the County within three days that Contractor has actual knowledge that the subcontractor is employing or contracting with an illegal alien; and

(ii)  Terminate the subcontract with the subcontractor if within three days of receiving the notice required pursuant to the preceding sub-subparagraph of this subparagraph, the subcontractor does not stop employing or contracting with the illegal alien; except that Contractor shall not terminate the contract with the subcontractor if during such three days the subcontractor provides information to establish that the subcontractor has not knowingly employed or contracted with an illegal alien.

E. Contractor shall comply with any reasonable request by the Department of Labor and Employment made in the course of an investigation that the Department is undertaking pursuant to the authority established in §8-17.5-102(5), C.R.S.

F. If Contractor violates this provision of this Contract, the County may terminate the Contract for a breach of contract. If the Contract is so terminated, Contractor shall be liable for actual and consequential damages to the County as required by law.

G. The County will notify the Office of the Secretary of State if Contractor violates this provision of this Contract and the County terminates the Contract for such breach.

4. INSURANCE: The Bidder who is selected as the Contractor shall purchase and maintain insurance not less than the limits set forth below. All coverage shall be with insurance
companies licensed and admitted to do business in the State of Colorado.

· Worker's Disability Compensation Insurance including Employers Liability Coverage in accordance with all applicable Statutes of the State of Colorado.

· Professional Liability Insurance on an “Occurrence Basis” with limits of liability not less than $1,000,000 per claim and $1,000,000 aggregate.

· Motor Vehicle Liability Insurance, including Colorado No-Fault Coverage, with limits of liability of not less than $1,000,000 per occurrence combined single limit Bodily Injury and Property Damage. Coverage shall include all owned vehicles, all non-owned
vehicles and all hired vehicles.

· Cancellation Notice - All insurances described above shall include an endorsement

stating the following: “It is understood and agreed that thirty (30) days advanced written notice of cancellation, non-renewal, reduction and/or material change shall be sent to: Moffat County Attorney, 221 W. Victory Way, Suite 120, Craig, Colorado 81625.”

Proof of Insurance - The vendor shall provide to the Council at the time the contracts are returned by it for execution, two (2) copies of certificates of insurance for each of the policies mentioned above. If so requested, certified copies of all policies will be furnished.

5. RIGHT OF REJECTION: The Council reserves the right to reject any or all bids, to waive any informalities or irregularities in bids, and/or to negotiate separately the terms and conditions of all or any part of the bids as determined to be in the Council’s best interests at its sole discretion.

6. QUESTIONS: Questions shall be submitted to Coordinator via EMAIL/PHONE/ADDRESS. An addendum of the responses to the questions will be sent to all bidders.

IV. SELECTION, AWARD & TIMELINE

1. BID OPENING: On February 14, 2011 at 2:00 PM the Council, at the Council’s Policy and Governance Committee meeting will publicly open and record the bid amounts.

2. PRESENTATIONS: Upon receipt and evaluation of the responses, selected bidders may be required to make in-person presentations to the Council.

3. BASIS FOR AWARD: Information and/or factors gathered during interviews, negotiations and any reference checks, in addition to the evaluation criteria stated in the RFP, if any, and any other information or factors deemed relevant by the Council, shall be utilized in the final award.

The award of this proposal will be on a Total Proposal basis.

4. NOTICE OF AWARD: Bidders will be notified by mail.

7. CONTRACT APPROVAL: The Moffat County Board of Commissioners must approve the contract resulting from this solicitation. This process typically takes four (4) weeks from the date the successful Contractor is identified. The County will prepare a formal contract specific to this solicitation for execution by the successful Contractor. The award of this bid is contingent upon the County and the bidder entering into a mutually agreeable contract.

V. SCOPE OF WORK

Any public relations regarding the EQIT or RELATE Coaching must be facilitated through Connections 4 Kids Coordinator.

Expressing problems and issues related to the Council in the community and with students rather than directly with the Council may result in terminating the contract.

EQIT

§  Teacher to be part of 48 hour EQIT team course to be held from approximately March 1, 2011 and ending approximately May 31, 2011 according to the EQ Curriculum set by the Department of Education as written. Any desired variation of course change should be noted in proposal.

§  Classes will be held at a location yet to be determined in Craig, CO.

§  Successful candidates will create a training plan that indicates who is responsible for working with students and reviewing assignments. Training plan will be turned in to Connections 4 Kids Coordinator before classes start.

§  Any requested curriculum changes are to be discussed with Connections 4 Kids Coordinator prior to making the change.

§  In addition to class instruction, teachers are responsible for sign in/sign out sheet, attachment EQ-1, for each date class is held, turned in with billing form, attachment EQ-2, no later than the 5th day of the following month.

§  Materials and equipment needed for class shall be checked out no earlier than two weeks before each module and returned within two weeks course completion.

§  Any public relations related to the EQIT course will be positively reflect Connections 4 Kids to promote future EQIT Course needs.

RELATE Coaching

§  Successful candidate(s) will be given an allowance of hours to be used for coaching offered to all participants in the EQIT course who commit to completing the full 48 hour course.

§  All coaching hours are to be completed by May 31, 2011.

§  Encourage students to utilize coaching and arrange observation times according to caregivers work schedule.

§  Utilize the Respect, Reflect, and Relate recommended order for coaching process according to the EQ RELATE Coaching Manual.

§  All Coaching activities will be done in person.

§  Digital camera will be supplied by Connections 4 Kids for use during coaching, film development or hard copies is prohibited.

§  Coach completes the EQ Coaching Visit Form at the time of visit giving yellow copy to care giver and retaining white copy to be turned in to Connections 4 Kids at the end of the contract period.

§  Coach completes the EQ Coaching Log, attachment EQ-3, to be turned in with billing form, attachment EQ-2, no later than the 5th working day of the following month.

§  Submit course documentation as needed or required by the Department of Education to Connections 4 Kids.
