The meeting was called to order by Mayor Davies-Dunhour at 4:30 p.m.

Mayor Davies-Dunhour announced that the meeting was now open. Adequate notice of the meeting was provided by posting a copy of the time and place on the Municipal Clerk’s bulletin board and mailing a copy of same to the Press on January 4, 2017.

Mayor Davies-Dunhour made the following statement and asked for a moment of silence after the flag salute.

As you all know two tragic incidents occurred in our country in the last week. Eight people killed and eleven injured in an act of terrorism in Lower Manhattan on October 31.

26 people killed and 20 injured at the First Baptist Church in Sutherland Texas on November 6.

We cannot accept these acts of violence and terror as the new world we live in and go about our business without acknowledging the inhumanity of such acts. This cannot become our world.

Please remain standing after the Pledge of Allegiance for a moment of silence to honor the victims, their families and the first responders involved in these two horrific incidents.

HEARING OF THE PUBLIC ON MEMORIALS, RESOLUTIONS, PETITIONS & COMPLAINTS

Matthew Pappas, President of Brandywine Developers said the memo he sent was collaborated feedback from numerous contractors.

He said contractors as a whole have to do a better job of policing and regulating existing ordinances. The bottom line is respect along with communication.

He suggested possibly making it mandatory for any contractor pulling a permit to have some type of form letter that can be circulated to the blocks adjacent to the site. It would introduce the company, list principals, cell phones, email addresses, it is a very effective tool.

The enforcement of ordinances has to be discussed. The burden on the construction and police departments currently, and with these additions, you have to give them a fighting chance. Suggesting possibly a part or full time position code enforcement official, such a position exists in Avalon and many other municipalities. Something the Borough should think about.

New proposed ordinances, a. no demolition between July 1 and Labor Day, as noted in the previous work session, yes, this is the way it is written in Avalon and it has worked out very well. He has an issue with the pilings, and talking to other colleagues, it would have a crippling effect. If we don’t have final plans and a permit before July 1st in order to drive those pilings, that job is pushed back until September 15th. What that would do from a scheduling standpoint, only so many pile drivers, surveyors, etc. We have to spread out start dates and delivery dates. We would have everything starting in September and try to finish up by the season, which is not realistic. If you can demo prior

to the moratorium, and then drive pilings when it is ready, you have a fighting chance of getting the project done by the next season.

Councilmember Kramar asked how long it takes to demo a house. Mr. Pappas said an average house demolition is a day, footing and concrete work the next day and then site grading. Driving pilings on most projects is a half day. Avalon allows driving pilings in July and August. He said out of all the new ordinances proposed, that is his biggest concern and he speaks for all his colleagues, it would be tragic.

Councilmember Kramar asked if he could define heavy equipment. He said that is difficult. Possible starting a compressor, fort lift, genie boons? He also added radios in his letter. You would have to specify what heavy equipment is for enforcement purposes. Questions about the emptying of dumpsters making noise and landscapers starting mowers?

No work on Sunday is not an issue. Same in Avalon. No work on Holidays not an issue.

Interior work only on Saturday, leaving a lot of grey area, and will be hard to enforce.

Councilmember Kramar asked Mr. Pappas, if in all the things listed here, as a compromise, if we did away with (a) and kept all the others would he be ok? Mr. Pappas said he would be thrilled if we got rid of (a), it is by far the biggest one that hurts business.

Mayor said we will bring this up in two weeks, but in the meantime who will take the lead to set up meetings? Council said Administrator will, she just needs to know who will be in on these meetings. Councilmember Lane said too much gets brought in from different areas, you don’t resolve anything with a huge group. It will be Councilmember Lane, Parzych and Krafczek. Councilmember Lane said take it back to A&F, which would be Lane, Krafczek and Gallagher. Mr. Pappas said he will be the contact and would like Mike from Construction and a representative from Police included.

Regular Meeting November 7, 2017

RESOLUTION 2017-S-212- (Purchase Police Tahoe - COOP)

Upon motion of Councilmember Ray Parzych

WHEREAS, the Borough of Stone Harbor entered into the Cranford Police Cooperative Pricing System (47-CPCPS) by Resolution 2008-S-47 in February, 2008 for the purpose of purchasing equipment; and

WHEREAS, the Borough Police Department will be using this System to purchase a 2018 Chevrolet Tahoe AWD PC1 Pursuit per quote from Mall Chevrolet, 75 Haddonfield Road, Cherry Hill, N.J. 08022 for $ 40,129 and the purchase was advertised on October 23, 2017.

NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of the Borough of Stone Harbor, County of Cape May, State of New Jersey on this 7th day of November, 2017 that the purchase of a 2018 Chevrolet Tahoe AWD PC1 Pursuit for the Stone Harbor Police Department at $ 40,129 be approved.

RESOLUTION 2017-S-213– (Refund Hydrant Meter Rental)

Council Meeting: November 7, 2017

Refund $1500.00 Hydrant Meter Rental Deposit

WHEREAS, pursuant to Section 542-13D of the Borough’s General Code, Great Lakes Dredge & Dock Company, deposited a $1500.00 hydrant meter rental deposit; and

WHEREAS, upon completion of the local improvement, Great Lakes Dredge & Dock Company returned the hydrant meter to Public Works; and

WHEREAS, the Utilities Collector has requested that a refund be issued to Great Lakes Dredge & Dock Company in the amount of $1500.00.

NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Stone Harbor in the County of Cape May and State of New Jersey on this 7th day of November 2017 that a refund check in the amount of $1500.00 be issued to Great Lakes Dredge & Dock Company, 2122 York Rd, Oak Brook IL 60523-1981, to refund their Hydrant Meter Rental Deposit.

RESOLUTION 2017-S-214– (Support Sustainable Purchasing Policy)

Resolution of Support from Local Governing Body of the Sustainable Purchasing Policy for the Borough of Stone Harbor

WHEREAS, a sustainable community seek to optimize quality of life for its residents by ensuring that its environment, economic and social objectives are balance and mutually supportive; and

WHEREAS, The Borough of Stone Harbor strives to save tax dollars, assure clean land, air and water, improve working and living environments; and

WHEREAS, The Borough of Stone Harbor is participating in the Sustainable Jersey Program; and

WHEREAS, one of the actions recommended by the Sustainable Jersey Program is the adoption of a sustainable purchasing policy; and

WHEREAS, the Borough of Stone Harbor has established a Green Team consisting of local

officials, community leaders, and Borough Employees and they have recommended that a sustainable purchasing policy be adopted; and

WHEREAS, the sustainable purchasing policy encourages the Borough to :

·  Institute practices that reduce waste by increasing product efficiency and effectiveness, and

·  Purchase products that minimize environmental impacts, toxics, pollution, and hazards to worker and community safety to the greatest extent practical, and

·  Purchase products that include recycled content, are durable and long lasting, conserve energy and water, use agricultural fibers and residues, reduce greenhouse gas emissions, use unbleached or chlorine free manufacturing processes, are lead-free and mercury-free, and use wood from sustainably harvested forests (FSC) when and where possible.

THEREFORE, the Borough Council of the Borough of Stone Harbor has determined that Stone Harbor should adopt a sustainable purchasing policy under Executive Policies titled Sustainable Purchasing Policy, Number F-011

THEREFORE, be it resolved, that this policy shall be distributed to all Department and Division Heads, and that it will be published to the municipal website.

RESOLUTION 2017-S-215 (Chapter 159 – Dump Station Grant)

WHEREAS, NJS 40A: 4-87 provides that the Director of the Division of Local Government Services may approve the insertion of any special item of revenue in the budget of any county or municipality when such item shall have been made available by law and the amount thereof was not determined at the time of the adoption of the budget, and

WHEREAS, the Director may also approve the insertion of an appropriation for the equal amount;

SECTION I

NOW THEREFORE, BE IT RESOLVED, that the Borough Council of the Borough of Stone Harbor, in the County of Cape May, New Jersey, hereby requests the Director of the Division of Local Government Service to approve the insertion of items of revenue in the budget of the year 2017

RESOLUTION 2017-S-218 (COOP – South Jersey Gas Bid)

ACCEPTING A BID

NATURAL GAS COOP

WHEREAS, three (3) bids were received by the County of Camden, the Lead Agent for South Jersey Power Cooperative (SJPC) on October 17, 2017 for the Supply and Delivery of Natural Gas to various South Jersey Power Cooperative locations; and

WHEREAS, Borough of Stone Harbor passed Resolution 2008-S-119 on June 3, 2008, authorizing participation in a Cooperative Bid for Natural Gas with the assistance of Cape May County; and

WHEREAS, South Jersey Energy Company was the lowest responsible bidder for Lot 1B, 2B, 3B, 4B and 5B in Appendix A, which is the Fixed All-Inclusive Product for a term of 24 months commencing with the first meter read after November 20, 2017 and terminating November, 2019, at the dekatherm prices listed in South Jersey Energy Company’s Proposal for Bid A-29/2017 attached; and

WHEREAS, the Board of Chosen Freeholders of the County of Camden has recommended that the contract be awarded South Jersey Energy Company, 1 North White Horse Pike, P.O. Box 152, Hammonton, New Jersey 08037; and

WHEREAS, the Borough of Stone Harbor’s Chief Financial Officer has determined that sufficient funds are available for this award as evidenced by the Chief Financial Officer’s Certification attached hereto; and

NOW, THEREFORE, BE IT RESOLVED by the Borough Council of the Borough of Stone Harbor, County of Cape May, State of New Jersey, duly assembled in public session this 7th day of November, 2017 as follows;
