The invocation was given by Todd Smith, Mayor Hansen then led everyone in the
‘Pledge of Allegiance’.
Mayor Hansen excused Councilmember Hart who recently had an unexpected surgery and is home healing up.
The Council reviewed the minutes from the last meeting and the payroll and accounts payable. Councilmember Prescott moved to dispense with the reading of the September 19th, 2012 minutes and approve them as written along with the payroll and accounts payable for September, 2012. Councilmember Smith seconded the motion. All in favor, motion carried.

Demian Guthmiller, of 31 West 3rd South, introduced himself to the Mayor and Council and expressed his interest in being on the Planning and Zoning Commission because he likes the town and wants to help anyway he can. Mr. Guthmiller has lived in Soda Springs for about 4 months and works at Agrium as a chemical engineer. Mr. Guthmiller mentioned that he was born in Seattle, Washington, worked for Micron in Boise and recently moved from Georgia and is also a Veteran of the U.S. Air Force. Mr. Guthmiller explained that he really wanted to live in Idaho and would like to stay in Soda Springs for a long time. Councilmember Lee asked if he had served on boards or done volunteering in the past. Mr. Guthmiller stated that he had served on different committees through his previous employments and has done volunteer work like rebuilding churches, helped with the Special Olympics and recently volunteered to spray weeds for the local Forest Service. Mayor Hansen asked about his family. Mr. Guthmiller has been married eleven years to his wife Gina and they have a 3 year old daughter. The Mayor thanked Mr. Guthmiller for coming and stated that it was refreshing to have someone come forward and express

interest in serving the Community. The Mayor recommended that Mr. Guthmiller submit a resume to Councilmember Prescott who is the liaison to the Planning and Zoning Commission.
The Mayor and Council viewed an up-to-date photo of the Wastewater Treatment Plant (WWTP) project. Director Skinner detailed the progress of the project and discussed at length the concrete issue. A warranty from the supplier and contractor is currently being negotiated to cover repairs to the concrete if needed in the future. The City is asking for a 5 year minimum on durability issues and a full description of the aggregate issues. Director Skinner mentioned that Forsgren Associates will hold a training workshop on phosphorus removal here at City Hall on Thursday, October 11, 2012.
The WWTP pay applications were reviewed. The four requests from Edstrom Construction included two for labor and two for equipment & materials totaling $945,176. Director Skinner mentioned that to date that puts disbursements from the DEQ loans at 24% on the 1st loan and 40% on the 2nd loan which is just over $3 million total. Councilmember Smith commended the contractor and the engineers on having no change orders so far and moved to approve the pay applications as presented. Councilmember Lee seconded the motion. All in favor, motion carried.
Director Skinner mentioned that the Soda Screamer half marathon is scheduled to be held on October 13th. Gene Lish was contacted about the City helping to prepare for the event. Director Skinner noted that in the past the City has sponsored the event in order for it to fall under the City’s liability insurance. The Council assumed no representative had been in to request the sponsorship because of a change in leadership. Director Skinner agreed the requests to set up for the marathon were reasonable and typical of what the City has done in the past. Councilmember Smith moved to approve the sponsorship of the annual Soda Screamer half marathon requesting a copy of the Idaho Transportation Department’s special events permit. Councilmember Prescott seconded the motion. All in favor, motion carried.
Shirley Carver of 800 East 4th North, along with Brock Farnworth who read a letter written by Mrs. Carver’s granddaughter, Sara Tyler explained the drainage problem that causes water to settle in her driveway. In the winter it becomes built up ice and is very dangerous. Mrs. Carver feels it is the City’s responsibility to correct the drainage problem. The Council viewed photos of the area and discussed the drainage issue at length. Director Skinner agrees it is a big problem. Mrs. Carver also mentioned the problem with the weeds and thistles on the vacant lots. Mayor Hansen suggested reviewing the City Code to determine whose responsibility it is for the grade of the curb & gutter.
Director Skinner discussed several locations in town that he is receiving complaints about and asked for direction from the Council on how to handle. The Mayor and Council viewed photos of the properties with un-kept lawns, junk, and old cars. Mayor Hansen suggested

that the owners be sent a copy of the code that applies and be given 30 days to clean up.
Director Skinner also mentioned a concern about a property where an old mobile home has been dismantled and is being used as fill and will be buried. Attorney Nelson mentioned that the City may not have an ordinance in place to enforce these types of clean-up. Director Skinner mentioned that he thought it would fall under the nuisance ordinance. Director Skinner and Attorney Nelson will review the code.
Councilmember Smith moved to approve entering into executive session pursuant to I.C. 67-2345(1)(b) to consider the evaluation of a public employee. Councilmember Prescott seconded the motion. A roll call showed the following vote:

Councilmember Prescott moved to exit executive session, seconded by Councilmember Smith. All in favor, motion carried.
