MINUTES OF THE BALLYRAGGET ELECTORAL AREA MEETING held at COUNCIL CHAMBER, COUNTY HALL, KILKENNY, on MONDAY, 17TH SEPTEMBER, 2007 AT 12 noon

and M. O’Neill, Castlecomer Area Office.

At the outset Cllr. M. Shortall wished Brian Cavanagh, Cllr . M.H. Cavanagh’s son a speedy recovery as he has been ill. All members passed on their good wishes. Cllr. Cavanagh thanked the members for their good wishes and also thanked the City Council and staff where Brian had worked during the summer.

1. Minutes of previous meeting held on 29th June, 2007.

The minutes were proposed by Cllr. J. Brennan, seconded by Cllr. M. Shortall and passed.

2. Multi Annual Roads Programme – Improvement Works.

P.Beubry circulated all present with a sheet showing the Proposals for the next

three years – coloured green year 2008, coloured yellow year 2009 and coloured

brown year 2010. A discussion took place on the proposals and P. Beubry

pointed out that if they wished to add any further roads, a road already on the

proposal would have to be dropped. The members discussed proposed works on

road at Castlegardens Housing Estate, Ballyragget. A builder is presently

completing a number of houses in the estate and the members felt that some of

the cost of works on the road in the estate should be met from Housing funds.

T.Walsh pointed out that such monies would have to come out of the housing

maintenance budget which already was very low and the roads budget would be

more substantial. It was also pointed out that the roads in the estate were already

in poor condition before the builder started any work on the houses. The

members are to consider the proposals and the matter is to receive further

discussion – it was suggested that same be discussed at meeting to be held with

Arcon Mines and Monday, 19th November, 2007 was provisionally agreed.

3. Agree date for December Electoral Area Meeting.

It was agreed that the December meeting would take place at 12 noon on

Monday, 17th December, 2007.

4. Agree time for Special Meeting of Electoral Area Members

scheduled for 15th of October – Arcon Mines.

The 15th of October does not suit Cllr. C.Connery and it was agreed that all the

members would like to be present at the meeting with Arcon. Cllr. Cavanagh

said that Arcon had requested the meeting but had not said what it was

about. Cllr. Cavanagh said they already called a meeting in Galmoy and

offered all the buildings on site to the parish. T. Walsh pointed out that they

have a number of conditions to comply with under planning conditions. T.

Walsh said that Arcon should be asked to make it their own meeting and book a

room themselves for same in Kilkenny and not have it as a meeting of the

Ballyragget Electoral Area as no one knew exactly what the meeting was for.

The members requested that Arcon clarifies the purpose of the meeting

and submit an agenda for the meeting. It was agreed that Cllr. Cavanagh,

T. Walsh and J. McCormack contact Arcon and ask for an agenda for the

meeting. Monday, 19th November was provisionally suggested as a possible

date for the proposed meeting.

5. Any other business

Extinguishment of Public Right of Way at Muckalee,

Ballyfoyle – Road No. LT 18643

Further correspondence from Joseph Fitzpatrick, W.A. Smithwich & Son,

Solicitors, was circulated to the members at the meeting. The members

discussed the matter and wanted to get legal advice before making a decision. It

was agreed that T. Walsh refer the letters to John Harte, Solicitor, for any further

observations he may wish to make. Following receipt of reply from J. Harte, the

members are to make a decision on whether to start the extinguishment of

the right of way process which would then have to go before the full meeting of

the Council.

Cllr. Connery enquired about the bus bay at Ballyragget

Cllr. J. Brennan brought up about the speed limit on the Ballyragget Road,

Castlecomer. P.Beubry clarified that this location has been included in the current

Speed Limit review.

Cllr.Cavanagh brought up about the Motorway and how the contractors had just

closed the Graine Road themselves one day.

Cllr. M. Shortall enquired about the recreational facilities in Ballyragget and T.

Walsh informed him that nothing had happened yet.

A vote of congratulations was passed on the recent All Ireland win by the hurlers.

Cllr. Connery also congratulated the camogie team.

This concluded the business of the meeting.
