1/5/04 ELECTION OF CHAIRMAN
It was RESOLVED that Mr. John Bullimore be appointed Chairman of the Council for the ensuing year.

It was RESOLVED that Mr. Don Tempest be appointed Vice-Chairman of the Council for the ensuing year.

Matters arising from the Minutes:
234/4/04:- A reply was received from Melton Borough Council indicating that it would be difficult to supply costs of cleaning pavements only as contractors undertook other functions within the parish.
227/4/04:- A reply was received from Councillor P. Roffey regarding proposals for a re-cycling centre at the former Asfordby Mine Site and a reply was received from Leics. County Council with a progress report regarding the restoration of the mine spoil tip.

Consideration was given to applications for planning permission as notified by the Borough Council as follows:-

RESOLVED that the following observations be made to Melton Borough Council:
04/00393/OUT:- In view of the controversial nature of this application, the associated appeal and objections fromthe parish council and neighbours, it should be considered byCommittee and notdealt with under delegated powers as is proposed. Asfordby Parish Council believes that the application contravenes many of the planning policies in the Adopted Melton Local Plan and these have been indicated where appropriate.

Planning Policy BE1 (G)
1. Access to the site is unsuitable due to its close proximity to Sarson Close, the adjacent entrance to the Parish Hall, entrances to two new nearby housing developments and a recently installed bus stop used by school buses. Within 150 yards of the Parish Hall along Main Street there will be a potential for a total of 245 vehicles entering and exiting Main Street if the application is permitted. Recent changes to the bus service have resulted in eight passings of double decker buses on Main Street per hour and there is substantial on street parking in the vicinity of the development along Main Street. Is the access road adoptable and do the proposedradii meet adoption standards? If the County Council do not propose to adopt the road the application should be refused. It appears from the plan submitted that, to achieve the proposed radii, it is necessary to cross the corner of the adjacent Parish Hall car park. No permission for this has been given.
2.Are the width of the access road and the private shared drive sufficient for emergency vehicles, etc. to gain access to the development?
Planning Policy H18 (C) and BE1
3. The proposed density of the development is too great and the proposed units too high. A precedent should not be set for three storey properties in a village setting. Melton Borough Council’s planning guidance states that the separation between property frontages should be a minimum of 23 metres but the proposals allow for only 21 metres to permit a greater density on the site.
4. The site is only suitable for one bungalow. Please note that a recent survey of residents’ views undertaken by the Parish Council showed a need for bungalows and larger houses.

5. No proposed lighting is shown on the plans and the block-paved area in particular if unlit would invite anti-social behaviour.
Planning Policy T2 & H18 (B)
6. Plots 4, 7, 9 and 11 are likely to have extreme difficulty in reversing out of their properties, particularly if there is a vehicle parked opposite.
7. The proposed width of pavements within the development is not consistent and pavements are not provided to all properties. In some cases the pavements are so narrow that they would not permit access for prams, pushchairs and wheelchairs. Are they, therefore, adoptable? The block- paved areas with the likelihood of 14 cars on an unlit area would create considerable potential for a serious accident to occur.

8. The applicant has failed to demonstrate that account has been taken of the need for good layout and design which is safe and considers:
a. crime prevention,
b. community safety considerations,
c. focuses on the quality of the living environments being created and
d. gives priority to the needs of pedestrians
and, therefore, the application does not reflect the guidance set out in PPG3.
9. High fencing would be required at the developer’s expense along the boundary with the Parish Hall football pitch to protect the new properties. The applicant suggested to the Planning Authority that a gate into the adjacent park would solve the problem and later offered the Planning Authority £2,000 towards the cost of a fence, acknowledging the need for protection. Neither of these options are adequate solutions to the problems that will be caused by footballs and golfballs if the development goes ahead. The projected costs of providing a suitable high mesh fence along the boundary would be approximately £7,500 and three years

maintenance would add an additional £750. At a recent Sunday football match, footballs went over the hedge into the proposed development area on six separate occasions and, as the pitch is in regular use several time a week, there is considerable potential for injury to residents and damage to property occurring. The applicant claimed at a Development Committee Meeting that a children’s play area near to the football pitch had not been protected in this way and, therefore, there was no need for his development to be protected. The difference is that there is a 1 metre high fence around the toddlers’ play area and parents supervising their children can clearly see the football pitch and whether anyone is playing and can, therefore, make an educated decision as to whether or not to permit their children to use the play area. Projectiles do not suddenly materialise over the hedge! The pitch has been in use for the past 65 years and is currently used by three Asfordby football teams. With this in mind the Parish Council feels that, if you are minded to permit the application, the applicant should meet the full cost of the fence, as his profits should not be subsidised by the ratepayers of Asfordby Parish.
To summarise, the Parish Council is not against development within the Parish but is certainly against badly planned developments and access roads that are unadoptable. There are other unadopted roads in Asfordby Parish and these are creating considerable problems as the years go by. To permit more of these in the twenty first century is, in the Parish Council’s opinion, unacceptable. The Parish Council’s concerns are all about access, road width, adequate provision ofpavements, density, future maintenance of roads and overall health and safety.
04/00308/FUL, 04/00385/FUL & 04/00387/CON:- The Parish Council supports these three applications for planning permission.
04/00358/FUL:- This application should be considered by the Development Committee in view of the previous refusal and sensitive nature of the proposal, i.e. it is within the village conservation area. The proposed entrance to the site would involve the demolition and part reconstruction of an ancient high wall (part of the village's heritage) bordering Mill Lane and, on this basis, the Parish Council objects to the application. Concern was also expressed aboutthe proposed position of the access opposite to Dalgliesh Way and the large number of vehicles that could require access to a five bedroom property.
13/5/04 APPLICATION TO FELL A NORWAY MAPLE AND A SYCAMORE TREE
An application was received to fell a Norway Maple and a Sycamore Tree protected by a Tree Preservation Order at The Grove, Asfordby.
RESOLVED that the following observations be made to Leics. County Council:-
Sadly, the Parish Council must support the application to fell the trees in view of the damage caused to the adjacent property. It is hoped thatsuitable replacement trees will be planted by the applicant.
